6. Pursuanllo the lerms of lhe contract, defendanl Lewis u.t:per was to conslruct the
garage for the sum of $9,360.00.
7. Plaintiffs made a $5,000.00 down payment to Lewis Leeper. Mr. Lt.'cpcr initiated
construction by digging footers and installing ccmenl block, but soon lhercafter ceased work.
8. Defendanl Bill Shumaker prcsenled himself to plainlilfs indica ling lhat he had an
agreement with Lewis Leeper by which he would complele the conslruclion of lhe garage with
the additional payments under the contract being made directly 10 him.
9. Plaintiffs paid Bill Shumaker the sum of $2,000.00. Mr. Shumaker performed
some work by constructing four walls, attaching plywood, setting rafters and installing a partial
roof, but he never did anything further to comp1ele the project.
10. It was discovered that the work was defective and that the construction that was
completed was not up to minimum building code standards, with the result that some of the
project had to be reconstructed.
11. Despite repeated requests to defendant Lewis Leeper and defendant Bill
Shumaker, no effort has been made to correCl problems or to complele the project.
12. Plaintiffs directly made payments for the following, all of which were
contemplated in the original contract:
a. $1,450.08 for rafters,
b. $1,018.67 for concrete,
c. $632.00 for labor to install the concrele,
d. $1,116.00 for garage doors,
e. $54.56 for equipment rental,
f. $149.00 for stone,

g. $2,435.77 for misccllant.'Ous building material
for a lotal of $6,856.08.
13. Plaintiffs hired J. Rkhard Myers to complete the construction of the Wlragc at a
cosl of $2,250.00.
14. Plaintiffs performed labor in the conslruclion of lhe garage lhat has a value of

were forced to have their vehicles slorcd at another location at a COSl of$972.oo.
16. Plaintiffs are entitled to have the garage completely and properly conslructed for
the original contract price of $9,360.00. Plaintiffs will have spent $12,078.08 for maleria1, labor
and off site aulomobile slorage in addition 10 the $7,000.00 previously paid to defendants, or a
totalof$19,028.08. This represents excess costs to plaintiffs for the completion of this project in
the amount of$9,718.08.

WHEREFORE, plaintiffs pray this Honorable Court to enter judgment in their favor
and against defendant Lewis Leeper and against defendant Bill Shumaker in the amount of
$9,718.08 plus interest and costs of this matter.
