day of February. 1999, the plaintiffs in the above-captioned
action. Wesley J. Young and Amanda I. Young. represented by John J. Baranski, Jr., Esquire,
LA W OFFICES OF HAROLD S. IRWIN, III. and the defendants. George Hackenberger and
Chris Hackenberger. represented by Philip C. Briganti, Esquire, LEGAL SERVICES, INC.,
hereby stipulate as follows:
1. A judgment in the amount of $441.83 shall be entered in favor of Plaintiffs. However,
Plaintiffs will not execute upon said judgment unless Defendants fail to satisfy it by June 30,
1999.
2. A judgment for possession of residential real property located at 315 Pinedale Road,
Lower Frankford Township, Cumberland County, Pennsylvania, shall be entered in favor of
Plaintiffs. However, Defendants shall be pcnnitted to continue to occupy said premises until
March 31, 1999, and Plaintiffs will not execute upon the judgment for possession until after this
date. provided that Defendants make the following payments to Plaintiffs:
A. $640.10 by February I. 1999, thc receipt of which Plaintiffs hereby

acknowledge.

C. $320.05 hy Fehruary 22. 1999
D. $611.27 hy March I. 1999. However. in the event Defendants arc unable to
pay the March I. 1999 installment by that date. PJaintifis agree to extend the time for payment to
March 5, 1999.
In the event Defendants fail to make any of these payments on the dates indicated. Plaintiffs may
immediately execute upon the judgment for possession.
3. Except as set forth herein. Plaintiffs and Defendants shall be released from any and all
claims the undersigned parties have or may have arising from their Installment Sales Agreement
dated June II, 1998. Under no circumstances shall Plaintiffs' execution of the foregoing
Stipulation for Judgment be interpreted as a release of Defendants from the payment terms
outlined in Paragraphs I, 2.B.. 2.C. and 2.D.. or from liability for any damages caused by
Defendants to the premises beyond ordinary wear and tear during their occupancy thereof.

Defendants have failed to reinstate the Agreement in accordance with the provisions thereof.

INSTALLMENT SALES AGREEMENT
TillS AGREEMENT, made as of this ((f... day of June, 1997, by and between
WESLEY J. YOUNG llnd AMANDA I, YOUNG, his wife, of 3703 Enola Road, Newville,
Cumberland County, Pennsylvania 17241 (hereinafter referred to as "SELLER"), and GEORGE
HACKENBERGER llnd CHRIS HACKENBERGER, his wife, of J 15 Pinedale Road,
Carlisle, Cumberland County, Pennsylvania 170 I J (hereinafter referred to as "PURCHASER").
NOW THIS AGREEMENT WITNESSE:rH THAT:
For and in consideration of the mutual covenants and promises hereinafter set forth, and
intending to be legally bound, the parties hereto mutually agree as follows:
I. Seller agrees to sell, grant and convey unto the Purchaser, and Purchaser agrees to
purchase and accept the conveyance of the property with the improvements thereon located at
J 15 Pinedale Road, Carlisle, Cumberland County, Pennsylvania ("Property"), as more particularly
described on Exhibit "A", attached hereto and incorporated herein by reference pursuant to the
terms and conditions as set forth herein.
2. Purchaser agrees to pay the sum of Seventy-five Thousand and no/lOa
($75,000.00) Dollars to Seller, said purchase price being payable in equal monthly installments of
Five Hundred Seventy-six and 69/100 ($576.69) Dollars, said monthly installments commencing
on July I, 1997. Said monthly payments shall be applied first to interest on the unpaid balance of
the purchase price at a rate of Eight and 501100 percent (8.50%) per annum, and the balance
thereof applied to the reduction of the unpaid principal balance of the purchase price. The said
monthly payment shall be due on the I st day of each month subsequent to the commencement
date as stated herein. In the event that any monthly or annual payment is not received by the
Seller on or before the fifth (5th) day after the same becomes due, the Purchaser shall pay a late
charge of live percent (500%) of the payment due ($28.83) The monthly payments shall
continue until June I, 1999 (unless extended in writing by the mutual agreement of the parties), at
which time the Seller agrees to convey the property in fee simple, by special warranty deed, free
and clear of all encumbrances, except easements, building and use restrictions, visible or of record
and the Purchaser agrees tQpay the balance of the purchase price in cash.
3. Purchaser agrees to keep the Property in a good state of repair. Purchaser agrees
not to make any substantial alterations in the condition of the Property without first securing
written consent of Seller. However, in the event that Purchaser becomes in default as set forth in
this agreement, any and all improvements which Purchaser has made to the Property will be and
become the property of Seller as of the date of default and will remain with the Property.
4. The Purchaser agrees at its expense, to keep the building on the Property insured
against fire, with extended coverage, with a company authorized to do business within the
Commonwealth of Pennsylvania and is acceptable to Seller, for a sufficient sum to cover the
unpaid purchase price, said insurance to be carried in the name of Seller, loss payable first to
Seller and the remainder to the Purchaser, as their interest may appear.
5. Purchaser shall be entitled to possession of the Property on July], ]997.
6. Purchaser hereby assumes all risk and responsibility for any accidents, injury or
damage to persons or property and to itself and any others on the Property. The Purchaser shall

defend, indemnifY and hold harmless the Seller from and against all actual or potential claims,
demands, liabilities, damages, losses and out.of.pockel expenses including reasonable attorneys'
fees whether or not reduced to judgment, order or award, on account of any and all injury or
damage to persons or property associated with the Property.
7. All real estate taxes with regard to the current year will be prorated as of the date
of the execution of this Agreement. Therealler, Purchaser will be responsible for the payment of
all subsequent real estate taxes and to provide proof of payment thereof upon request of Seller.
All real estate transfer taxes upon final settlement and conveyance of the deed as provided herein
shall be paid equally by the parties hereto. If, however, Purchaser at any time shall request Seller
to convey the Property to a third party, Seller shall be relieved of paYing any transfer tax
associated therewith and the same shall be the sole responsibility of the Purcha~er or the third
.
party. In addition to the above, all the utilities shall be prorated as of the date of this Agreement.
Thereafter, Purchaser will be responsible for payment of all utilities and any other services
performed which are associated with the Property.
8. Purchaser understands and agrees that the property is being purchased "as is" and
Seller IS making no representations or warranties with regard to the condition of the
improvements located on the property.
9. Upon default by the Purchaser in tendering any of the monthly payments due
hereunder or in performance of any other obligations under this Agreement, for a period
exceeding thirty (30) days, Seller may declare this Agreement to be terminated, retaining all
payments made to that time as liquidated damages and in such event, the Prothonotary or any
attorney of any court of record of Cumberland County is hereby authorized to appear for and to

confess judgment in an applicable action of ejectment against said Purchaser, its successors and
assigns and in favor of the said Seller, its successors and assigns for the Property described on
Exhibit" A" au ached hereto and to direct the immediate issuing of a Writ of Possession with Writ
of Execution for costs, including attorneys' fee of no less than live percent (5%) of the unpaid
balance of the purchase price, without notice and without asking leave of Court, or at the option
of Seller, said Prothonotary or aUorney is hereby authorized to confess judgment against the
Purchaser and in favor the Seller for the entire unpaid balance of the purchase price, together with
costs, interest, insurance payments, etc., and with no less than five percent (5%) added thereon as
an attorney fee.

1 O. The interest of the Purchaser conveyed by this Agreement shall not be assignable
by sale, assignment, lease, pledge, subleasing or otherwise, in whole or in part, without the prior
wriuen consent of the Seller. In the event such assignment, pledge, etc., is accepted, the rights
stipulated in Paragraph Nine shall accrue to the Seller.
11. In the event Seller defaults in the payment of any liens on the property, Purchaser
sball have the right to pay on said obligation and receive credit toward its monthly payment as set
forth above.
12. Failure by Seller to insist on strict performance by Purchaser of any of the terms of
this Agreement shall not be construed as a waiver, release or relinquishment thereof This
Agreement shall inure to and be binding upon the successors and assigns of the parties hereto.

13. The provisions of this Agreement shall be construed and enforced in accordance
with the laws of the Commonwealth of Pennsylvania. This Agreement represents the entire

agreement and understanding between the parties hereto and there arc no other terms, obligations,
covenants, representations, statements or conditions, oral or otherwise, of any kind whatsoever
concerning this sale. The provisions of this Agreement supersede any and all prior writings
between the parties hereto. Any modification, changes or additions to this Agreement must be
made in writing and executed by the parties hereto. Wherein used in this Agreement, unless the
context otherwise clearly requires; the plural shall include the singular and vice versa; the use of
any particular gender shall include any other applicable genders; and the words "hereof", "herein"
and similar compounds of the word "here" shall mean and refer to this entire Agreement and not
to any particular provision or paragraph hereof unless so stated.
14. Time is hereby declared to be of the essence with regard to this Agreement.
15. All payments, notices and other communications given or delivered under this
Agreement shall be in writing and be deemed to have been given when personally delivered,
mailed by first-class mail, return receipt requested, or delivered by express courier service. All
payments, notices, demands and other communications to the Seller or Purchaser will, unless
another address is specified in writing, be sent to the addresses indicated below:

or at such other address at which eilher party nolifies lhe other in writing.
16. If Seller is unable to give good title 10 Purchaser as set forth above, Purchaser shall
have the option of laking such title as may be able to be given with no reduction in the purchase
price. It is stipulated and agreed between the parties that the reasonable rental value of the
premises is equal to the monthly payments to be paid under this agreement and that if Purchaser
terminates this agreement due 10 Seller's inability to give good title, Purchaser shall be entitled to
the return of the original downpayment and any annual payments made pursuant to this
agreement.
