company. as liahilily insurance carrier lilr Ihe defendanl, will pay on hehalfofthe minor
plaiulifJ: Ihe total sum ofSS~.7S2,OO. The aforesaid set(lemenl is a slruetured settlcment which
will pay S 12,500,00 in cash al the time of settlement. and the remaining S42,252.00 will be
paid in the lonll of a structured selllement which will pay to the minor plaintiff commcneing OIl
age IX, on April 28, 2012, the minor plaintiffwill be paid the sum ofS7,500.00, and on April
28.2015, the sum ofSI2,SOO.OO will he paid to thc minor plaintiff: and when thc minor
plaintiffallains the age 01'25 years on April 28, 2019, a lump sum payment of$22,252.00 will
he paid to the minor plaintiff, The annuity will be placed with First Colony Life Insurance
Company with an assignment to Jameslown Life Insurance Company.

a hearing on the pdition on Wednesday. December 30, 1998 at 2:00 o'clock p.m., in
Courtroom No.4 of the Cumberland County Courthouse, at which hearing thc minor plaintift:
hcr Itlthcr, and hcr mothcr. thc pctitioncr, as parcnts and natural guardians, wcrc prcscnt, and
their attomey. David C. Clcavcr. was also prcscnt, a1,d thc Court having hcard cvidcncc ofthc
naturc of the accident and "fthc naturc of the plaintiffs injurics, and it appcaring to thc Court }
thatlhc tOI,d scttlcmcnt 1l1l' the cause of action of the minor is a structured settlcmcnt which
will pay lothc minor the sum ofS 12.500,00 at this limc, of which 57,500,00 is to bc paid to
David C, Cleaver. P.c. as attorncy's fees. plus cost of S 115.05, thc balancc of which, or the
sum ofS4.884.95 shall bc paid by David C. Clcavcr_ Esquirc. into a Fcderally insurcd interest
bearing account in thc namc of thc minor with a notation to placed thereon that no funds shall
be withdrawn prior to the minor attaining the age of 18 years without Order of Court, and that
the balance of thc scttlemcnt is a structurcd settlcmcnt which shall bc provided by an annuity to
bc providcd by First Colony Life Insurancc Company, an A++ ratcd life carrier, with ownership
assigncd to Jamestown Lifc Insurancc Company, who shall be obligatcd to make the following
paymcnts to thc minor atlhe following datcs and timcs:
