TIDAY, Contractor IN TI Ili COURT OF ('OMMON PL!?AS 01: CUMBERLAND COUNTY, PI-'NNSYLVANIA No y :L f 1 / (_) term 1998 STIPULATION AGAINST LIENS WHEREAS, Drive, Mechanicsburg, Pennsylvania, 17055, is about to execute contemporaneously herewith, a contract with RICH VALLEY ASSOCIATES of 3609 Gettysburg Road, Camp Hill, PA 17011, providing for this Stipulation Against Liens as general contractor for the original erection and construction of a dwelling on Lot 7 in Rich Valley Manor Phase 11, more particularly bounded and described as follows: ALL that certain tract or parcel of land situate in Silver Spring Township, Cumberland County, Pennsylvania, more particularly bounded and described as follows: BEGINNING at a point, said point being located on the Western Right-of-Way line of Carothers Circle at the common front property corner of Lots #6 and #7 and being referenced from the end ofa curve connecting the Northern Right-of-Way line of Willow Mill Park Road with the Western Right-of-Way line of Carothers Circle, North 44 degrees 49 minutes 30 seconds West, a distance of 296.10 feet to a point; thence along Lot #6, South 45 degrees 10 minutes 30 seconds West, a distance of 410.00 feet to a point Pt Lot #5 of Rich Valley Manor, Phase IL thence along a portion of Lot #5 and along a portion of Lot 114, North 44 degrees 49 FRED A. TIDAY, Building Contractor, with an office at 19 Skyline minutes 30 seconds West, it distance 01'328 74 tact to a point al Lot o8 of, Rich Valley Manor. Phase 11. thence along Lot 1t8, North 45 degrees 10 minutes 30 seconds East, a distance of 386.20 feet to a point on the Western Right-ol=Way line of Carothers Circle; thence along the Western Right-of-Way line ol'Carothers Circle on the arc ol'a curve, curving to the felt, having a radius of 50.00 feet and an arc length of 31.07 feet to a point; thence along the same on the are ol'a curve, curving to the right, having a radius of 25.00 feet and an arc length of 21.03 feet to a point; thence along the same, South 44 degrees 49 minutes 30 seconds Bast, a distance of 283.74 feet to a point, said point being the place of BEGINNING. BEING Lot #7 on Rich Valley Manor Phase 11 Plan aforesaid containing 134,260.63 square feet or 3.08 acres, more or less.. ALSO BEING a part of the premises which JOSEPH T. SIMPSON and HELEN M. SIMPSON, his wife, by their deed dated January 16, 1978, and recorded January 16, 1978, in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania, in Deed Book P-27, Page 647, granted and conveyed to JERRY T. SIMPSON and HILARY M. SIMPSON, his wife. NOW THIS ' 0' Day of November, 1998, at the time and immediately before the execution of the principal contract, and before any authority has been given by the said RICH VALLEY ASSOCIATES to the said FRED A. TIDAY, to commence work on the said building, or purchase materials for the same, as consideration of the making of the said contract with RICH VALLEY ASSOCIATES and the further consideration of One Dollar ($1.00) paid to it by RICH VALLEY ASSOCIATES, it is agreed that no lien shall be tiled against the building by the Contractor, or any sub-contractor, nor by any of the material men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection and construction of said building or other work with respect thereto.
