PRE-TRIAL MEMORANDUM
Defendants, Eric ). Comeau, Hope Comeau and Maia Comeau, by their attorneys, Broujos
& Gilroy, P.c., set forth the following in accordance with Cumberland County Rule of
Civil Procedure 21 2-4:
In 1994, Maia Comeau started attending Skidmore College in New York. Maia is the
daughter of Defendants Eric ). Comeau and Hope Comeau, Maia attended Skidmore for
one (1) full year in 1 994/1 995 and for half of her sophomore year, In conjunction with
this schooling, both Mr. and Mrs. Comeau and their daughter executed promissory notes
for various tuition costs.
Maia stopped attending Skidmore in 1995. The Comeaus made monthly payments on
this loan through 1997.
In February of 1998, Mr. Comeau lost his full time employment. He remained
unemployed through August of 1998 at which time he suffered a disabling stroke. Mr.
Comeau is now unable to work and is collecting social security disability. Prior to Mr.
Comeau's problems, Mrs. Comeau was not employed on a full time basis. She has since
sought full time employment.

Skidmore College has been unwilling to restructure the loan or in any other way
compromise the situation to address the Comeaus current unfortunate financial situation.

With regards to damages, the Comeaus agree with the complaint as it relates to the
principal balance owing on the 2 loans, $21,466.00 for one loan and $10,880.00 for
another loan. They also agree with accumulated interest claims.

At Issue Is the claim of late fees and the claim of allorney's fees. It Is admllled that the
loan documentation allows for the collection of allorneys fees Incurred. However, the
complaint, upon filing, claims allorneys fees of approximately S 1 2,000,00, These fees
were calculated at the rate of 33%, The primary issue Is the attorney's fees owing,

Defendants do not anticipate any exhibits being entered except the exhibits the Plaintiff
would enter.

Defendants' witnesses will be Attorney James D. Flower, Jr. who will be called as an
expert witness to testify on the issue of attorneys fees In this type of litigation.

On settlement negotiations, Defendants have recently tendered an offer to the Plaintiffs in
a last ditch effort to get this case resolved. The only other alteruative to the Defendants
may be to file bankruptcy. If the case cannot be sellled, Defendants may Institute
bankruptcy proceedings shortly before the scheduled trial. Defendants have sought an
unsecured personal loan from a local bank and would use the money from that loan to pay
the Plaintiff's a lump sum payment for general release of all claims.

PROMISSORY NOTE
!/We promise to pay to Skidmorp Colleoc (the "Institution"),
or order, the sum of Tw<>ntv Two Thoullllnd Dollars ($22000.00) or
such lesser amount as I/we have borrowed as indicated on the
books and/or records of the Institution (the "Loan Amount"),
together with interest thereon as set forth below. I/we
understand that the Institution may sell, assign or transfer this
Note to another party. The Institution or any other !larty who
takes this Note by sale, assignment or transfer and who is
entitled to receive payments unde~ this Note is called the
"Holder" .
TERMS, CONDITIONS AND DISCLOSURES
1. Loan Amount. The Loan Amount shall
fOlloWing dates: (i) $11000.00 on 09/01/1994;
01/16/1995; and (iii) $0.00 on N/A.

2. Interest. Interest shall accrue on the unpaid balance
of the Loan Amount at an annual rate of 6.950%, beginning on the
date of each disbursement of principal referred to in paragraph 1
of this Note and continuing until the Loan Amount has been paid
in full.
3. PaYment Terms. I/We will make a payment of interest
only on the unpaid balance of the Loan Amount commencing on
10/16/1994 and on the li day of each month thereafter to and
including 01/16/1995. Thereafter, I/We will make payments of
principal in 180 consecutive, substantially equal monthly
installments, together with interest on the unpaid balance of the
Loan Amount, commencing on 02/16/1995 and.on the 16 day of each
month thereafter to and including 01/16/2010, when the entire
unpaid balance of the Loan Amount, together with the accrued and
unpaid interest, shall become due.
4. Late Charoe. If the Holder fails to receive any payment
required by this Note within 15 days of its due date, a late
charge of $25.00 shall become immediately due and must be paid no
later than the due date of the next scheduled payment.
5. ApPlication of PaYments. Each payment under this Note
shall be applied by the Holder first to the payment of any late
charge (s), then to the payment of accrued interest and then to
the payment of the Loan Amount.
6. PrepaYment. I/We may orecay the Loan Amount in whole or
in part at any time without per.~lty.
7. Place of Pavrnents. All payments under this Note shall
be made to the Holder c/o EduServ TechnOlogies, Inc., P.O. Box
70095, Charlotte, N.C. :8272-0095,:", to a different place if
requi,red by the Holder,
8, !:;ertification. I/We certify that (i) the entire
proceeds of this Note will be used for the tuition and/or related
educational expenses of the Student, (ii) the Student is not in
default on any Federal or other educational assistance loan, and
(iii) the Student has not failed or refused to refund any
educational grant required to be refunded.
9. Default. I/We understand that if (a) I/we fail to make
any payment requil'ed under this Note within 30 calendar days of
its due date or (b) any certification I/we made in Section 8 of
this Note proves to have been materially false when made, the
entire unpaid indebtedness, including the Loan Amount and all
accrued interest thereon, shall, at the option of the Holder,
become immediately due and payable and, at the option of the
Holder, the anuual rate of interest charged on the unpaid balance
of the Loan Amount may be increased to fourteen percent (14 'l<) ,
and !/we will be required to pay all attorney's fees, collection
agency fees, and other costs and charges necessary for the
collection of any amounts due under this Note.
10. Credit Bureau. If! am/we are determined to be in
default under the terms of this Note, the Holder may disclose
that I/we have defaulted along with other relevant information to
credit bureau organizations.
11. Notices. Unless applicable law requires a different
method, any notice that must be given to me/us under this Note
will be given by delivering it or by mailing it by first class
mail to me/us at the address set forth below or at a different
address if I/we give the Holder a notice of my/our different
address.
12. Oblioations of Persons Under this Note, If more than
one person signs this Note, each person is fully and personally

PROMISSORY NOTE
I/We promise to pay to Skidmore Colleqe (the "Institution"),
or order, the sum of Twentv One Thousand Nine Hundred Eiqhtv Six
Dollars ($21986.00) or such lesser amount as I/we have borrowed
as indicated on the books and/or records of the Institution (the
"Loan Amount"), together with interest thereon as set forth
below. I/we understand that the Institution may sell, assign or
transfer this Note to another party. The Institution or any
other party who takes this Note by sale, assignment or transfer
and who is entitled to receive payments under this Note is called
the "Holder".
TERMS, CONDITIONS AND DISCLOSURES
1. Loan Amount. The Loan Amount shall

the Institution, or (c) 05/31/1998 (the "Separation Date").
Thereafter, I/we will make payments of principal in 180
consecutive, substantially equal monthly 'installments, together
with interest on the unpaid balance of the Loan Amount,
commencing on the 15 day of the first month after the Separation
Date and on the 15 day of each month thereafter to and including
06/15/2013, when the entire unpaid balance of the Loan Amount,
together with all accrued and unpaid interest, shall become due.
4. Late Charqe. If the Holder fails to receive any payment
required by this Note within 15 days of its due date, a late
charge of $25.00 shall become immediately due and must be paid no
later than the due date of the next scheduled payment.
5. Apolication of Pavments. Each payment under this Note
shall be applied by the Holder first to the payment of any late
charge (5), then to the payment of accrued interest and then to
the payment of the Loan Amount.
6. Preoavrnent. I/We may prepay the Loan Amount in whole or
in part at any time without penalty.

default on any Federal or other educational assistance loan, and

9. Default. I/We understand that if (a) I/we fail to make
any payment required under this Note within 30 calendar days of
its due date or (b) any certification I/we made in Section 8 of
this Note proves to have been materially false when made, the
entire unpaid indebtedness, including the Loan Amount and all
accrued interest thereon, shall, at the option of the Holder,
become immediately due and payable and, at the option of the
Holder, the an~ual rate of interest charged on the unpaid balance
of the Loan Amount may be increased to fourteen percent (14%),
and I/we will be required to pay all attorney's fees, collection
agency fees, and other costs and charges necessary for the
collection of any amounts due under this Note.
10. Credit Bureau. I f I am/we are determined to be in
default under the terms of this Note, the Holder may disclose
that I/we have defaulted along with other relevant information to
credit bureau organizations.
11. Notices. Unless applicable law requires a different
method, any notice that must be given to me/us under this Note
will be given by delivering it or by mailing it by first class
mail to me/us at the address set forth below or at a different
address if I/we give the Holder a notice of my/our different
address,
12. Obliqations of Persons Under this Note. If more than
one person signs this Note, each person is fully and personally
obligated to keep all of the promises made in this Note,
including the promise to pay the full amount owed. The Holder

and directed as follows:

it is ordered
I. The Mother, O1risty L. Gephart, and the Father, Ryan E. Iskric,
shall have shared legal custody of Ryan Eugene Gephart, born November l6,
1998. Each parent shall have an equal right, to be exercised jointly with
the other parent, to make all major non-emergency decisions affecting the
Child's general well-being including, but not limited to, all decisions
regarding his health, education and religion.
2. The Mother shall have primary physical custody of the Child.
3. The Father shall have partial physical custody of the Child on
alternating weekends on both Saturday and Sunday from 10:00 a.m. until 6:00
p.m., beginning Saturday, January 23, 1999. In addition, the Father shall
have custody of the Child every Tuesday from 3:00 p.m. until 7:00 p.m.,
beginning January 19, 1999.
4. The following holidays shall be divided into two parts, with the
first part running from 10:00 a.m. until 3:00 p.m. on the holiday and the
second part running from 3:00 p.m. until 7:00 p.m. on the holiday:
Christmas, Thanksgiving, Easter, Memorial Day, July 4th and Labor Day. The
parties shall determine which party shall have the first or second part of
each holiday by mutual agreement.
5. The Father shall have custody of the Child every year on Father's
Day and the Mother shall have custody of the Child every year on Mother's
Day, with the specific times to be arranged by mutual agreement of the
parties.
6. The holiday custody schedule shall take precedence over and shall
supersede the regular custody schedule.
7. The Father shall not take the Child to his place of employment
during the Father's work hours.
8. The party receiving custody of the Child shall be responsible to
provide transportation for the exchange of custody.
9. Neither party shall use illegal drugs or alcohol during his or her
periods of custody with the Child.
10. In the event ei ther party intends to take the Child out of town,
that party shall provide advance notice to the other party and a telephone
number where that party can be reached in the event o( an emergency.
11. ~li8 Order is entered pursuant to an agre~nent o( the parties at a
Custody Conciliation Conference. '['he parties n.1Y nodHy the provisions of
this Order by ~Jtual consent. In the absence ot mutual consent, the terms
