3. Accordingly, State Farm desires to obtain the
records currently in Kemper's possession and in order to compel
same, would like to have a subpoena issued by the Cumberland
County Court of Common Pleas directing Kemper to provide State
Farm with all records in its file pertaining to Charles Taylor.
4. Thus, State Farm hereby requests that a
miscellaneous docket be opened in order to obtain such a subpoena
to compel Kemper to provide said records to State Farm.
WHEREFORE, Defendant, State Farm Mutual Automobile
Insurance Company respectfully requests that this Honorable Court
allow it to open a miscellaneous docket in order to obtain a
subpoena to compel Kemper Insurance Company to provide state Farm
with all records in its possession concerning the matters
currently no pending in Delaware.

AND NOW, comes Defendant, State Farm Mutual Automobile
Insurance Company ("State Farm"), by and through is counsel,
Reynolds & Havas, a Professional cOlporation, and hereby files
this Petition to Open a Miscellaneous Docket, averring the
following in support thereof:
1, state Farm is currently a Defendant in two first
party medical benefits claims cases currently pending in the
courts of the State of Delaware (Charles Tavlor v, State Farm,
Arbitration Docket 0698AR158 and Charles Tavlor v, state Farm,
Arbitration Docket 0998AR381),
2. Kemper Insurance Company ("Kemper"), 5001 Louise
Drive, Suite 102, Mechanicsburg, Cumberland county, Pennsylvania,
17055, as a workman's compensation carrier, is currently in
possession of certain medical and other insurance records which
state Farm needs in order to prepare its defenses in the above-
