Douglas, Esquire, and for the defendant, John Flounlacker,
Esquire.
This is a wrongful death and survival action arising
out of a vehicle accident that occurred in the evening of
April 8, 1998, Defendant Cook was operating a tractor pulling
a large manure spreader, There were no lights on the manure
-,
spreader, Plaintiff, decedent, Eric Fullas, age 16, rear ended
the manure spreader and was killed, Liability is at issue as
well as contributory negligence.

The case is continued this term because the parties
are negotiating entering into an agreement for binding
arbitration, If the arbitration does not occur or the case is
not settled, plaintiff will relist the case for the September

term, and the case need not be re-pretried. Counsel, however,

should call the case for trial so that it is placed on the

final trial list, If tried here, the estimated time of trial
is two and a half to three days.

3. The petitioner, Robert J. Fullas, is all .ldult individual f\'siding at 137
Old Cabin Hollow Rd., Franklin Township, York Cuunty, Pennsylvania.
4. The respondent, Douglas A. Cook, is an adult individual residing at
1100 Mt. Zion Road, Dillsburg, York County, Pennsylvania.
5. The decedent, Erik J. Fullas, was the son of Sharon L. Fullas and Robert
J. Fullas.
6. Erik J. Fullas was born on July 6, 1981 and was sixteen years old at the
time of his death.
7. On or about April 8, 1998, at approximately 9:21 PM, the decedent, Erik
J. Fullas died as the result of the injuries he received in the motor vehicle
accident that occurred on April 8, 1998.
8. Erik J. Fullas died intestate and had no children at the time of his
death.
9. Erik J. Fullas died instantly as result of his injuries.
10. The petitioners are the sole surviving heirs of the decedent.
11. At the time of the accident, the respondent, Douglas A. Cook, was
insured by Old Guard Mutual Insurance Company.
12. To settle the wrongful death claim the petitioners, in their individual
capacity, are agreeable to accept Eight Hundred Thousand Dollars ($800,000.00)
in full and final settlement for the wrongful death of their son, Erik J. Fullas.
12. To settle the survival action brought on behalf of the Estate of Erik J.
Fullas, the petitioners, in their capacity as administratrix (or), are agreeable to
