HU1ehison, individually,
22, Admitted with clarification, It is admitted that James W, Hutchison, Jr, co-

personal guarantees on behalf of Hutch Construction, Inc, However, James W, Hutchison, Jr, did
execute a credit application in 1974 on his own behalftldlb/a Hutch Construction, Plaintiff
extended credit to James W. Hutchison, Jr, based upon that credit application, In that no credit
application was supplied to Plaintiff by Hutch Construction, Inc, no credit was ever extended to
that entity by Plain1iff.
23, Denied, It is denied that there was prior notification to Plaintiff that James
Hutchison individually would no longer be using his credit line established in his individual
capacity and that all purchases and responsibilities for payment of same would be that ofHu1ch
Construction, Inc, It is denied that Plaintiff continued to erroneously request payment from co-
defendant James Hutchison for alleged obligations of Hutch Construction, Inc, To the contrary,
2
all obligations due and owing and requested under Ihis Complaint are those of James W,
Hutchison, Jr, IId/b/a HUlch Construction,
