3, With respect to holidays:
A. Mother shall be entitled to have the children
Mother's Day; Father shall be entitled to have the children
Father's Day at times mutually agreed upon by the parties,
B. The Ch~ist~as Holiday shall be divided in segments
and alternated yearly with Mother having Segment A (December
24 at Noon to December 25 at noon) for 1999 and Father having
Segment B (December 25 at noon to December 26 at noon).
C. The parties shall alternate the following holidays:
Easter, Memorial Day, Fourth of July, Labor Day, Thanksgiving
and New Year's Eve. The pick up and drop off times shall be
as mutually agreed to by the parties.
4. Father shall be entitled to two (2) non-consecutive weeks
of uninterrupted partial custody of the children without the other
exercising visitation, unless the parties mutually agree to do so,
during the summer with thirty (30) days notice to the other of the
weeks each wishes.
Mother shall be entitled to two (2) non-

5. Father shall be responsible for picking up the children at
the beginning of his periods of partial custody and returning the
children at the end of his periods of partial custody,

other parent, and neither parent shall say or do anything which
would cast the other parent in an unfavorable or negative light to
the children, it being specifically agreed that neither parent
shall make any detrimental or disparaging comments about the
other parent to the children or in the presence of the children
that would in any way denigrate the other parent.
7. Both parents shall attempt, by all possible means, to
foster the children's relationship with the other parent. Both
parents realize and appreciate that it is critical for the
children's health and development that the children feel good about
and loving towards both parents and that both parents play a major
role in helping to achieve this goal.
S. Plaintiff and Defendant shall communicate directly
concerning the children or the visitation schedule and will not
communicate through third parties unless there is an emergency
necessitating such communication.
9. Both parties shall keep the other informed of their
current telephone number and address.

3. With respect to holid~ys:

would cast the other parent in an unfavorable or negative light to
the children, it being specifically agreed that neither parent
shall make any detrimental or disparaging comments about the
other parent to the children or in the presence of the children
that would in any way denigrate the other parent.
7. Both parents shall attempt, by all possible means, to
foster the children's relationship with the ot~er parent. Both
parents realize and appreciate that it is critical for the
children's health and development that the children feel good about
and loving towards both parents and that both parents playa major
role in helping to achieve this goal.
8. Plaintiff and Defendant shall communicate directly
concerning the children or the visitation schedule and will not
communicate through third parties unless there is an emergency
necessitating such communication.

AND NOW, come the above-named parties and their attorneys
hereby stipulate and agree to the following provisions for custody
of their minor children, pending further proceedings in this matter
and any subsequent order of court:

The parties will share legal custody of their minor
children, Garrett Bolinger and Alyvia Bolinger, born May 27, 1993.
2. The Plaintiff/Mother shall have primary physical custody
of the children and the Defendant/Father shall have the following
periods of temporary or partial custody:

NOW THIS AGREEMENT WITNESSETH THAT:
WHEREAS, the partics are thc natural parcnts of two minor childrcn, namcly, Garrctt
Douglas Bolinger (hcrcinaftcr rcfcrred to as "Garrctt") and Alyvia Nycole Bolingcr (hereinafter
referred to as "Alyvia"), both of whom wcrc born on May 27, 1993 (hcreinafter collectively
referred to as the "Children"); and
WHEREAS, the parties entcred into a Custody Stipulation and Agreemcnt on April 5,
1999, whieh was subsequently entered as a Court Order by the Honorable Edgar B. Bayley.
WHEREAS, the parties' respectivc situations havc materially changcd; and
WHEREAS, the parties now wish to modify the tcrms ofthat Agrcement and Order.
NOW, THEREFORE, thc partics hcrchy agrcc as lilllolVs:
\. The partics shall havc joinl ICJ:al custody of thc Childrcn. Joint Icgal custody
mcans thc right of both parcnts to control and to sharc in making dccisions of importancc in thc
Iivcs' of thcir Childrcn. including cduculional. mcdical, ami rcli!\iolls dccisions. Both parcnts
shall bc cntitlcd to cqual accCSS to thc Childrcn's school, mcdical. dcntaI, :\nd othcr important
records. If the Childrcn arc sick and arc unable to attcnd school or othcr planncd activitics, thc
parent then having custody will notify thc othcr parcnt as soon as practicably possiblc.
As soon as practical aileI' thc rcccipt by a party, copics ofthc Childrcn's school schcdulcs,
spccial events notifications, rcport cards, and similar items shall bc providcd to thc othcr purty.
Each shall notify the other party of any mcdical, dental, optical and othcr appointments of thc
Children with health care providcrs, sufficiently in advancc thcrcof so that the othcr party can
attend, ifhe or she so chooses.
Notwithstanding that both parents shall share lcgal custody, non-major decisions involving
thc Children's day-lo-day living shall bc made by the parent thcn having custody, consistcnt with
the other provisions of this Stipulation.
2. Physical custody of the Children, as thattcrnl is defined in the Custody Act, shall
be primarily with Mother, howcver, subject to Fathcr's periods of partial custody as follows:
a. During thc school year, Fathcr will havc custody of the Children on
Monday and Wednesday evenings from 5:00 p.m. whcn Mother will drop the Children off
at Father's house, through 8:00 p.m. whcn Father will return the Children to Mother's
housc. Fathcr will bc rcsponsiblc for providing dinncr for Ihc Childrcn on Mondays and
W cdncsdays; and
b. During thc SUl11l11Cr, Fathcr will havc custody of thc Childrcn on
Wcdncsday cvcnings from 5:00 p.m. whcn Mothcr will drop thc Childrcn off at Fathcr's
housc, through 10:00 p.m. whcn Fathcr will rcturn thc Childrcn to Mothcr's housc. In thc
event onc or both of the childrcn are unablc to sta)' up nntillO:Ofl p.m, and wish to
return homc to thcir Mothcr, Father agrccs the child/childrcn may do so. Fathcr will
be responsiblc for providing dinncr for thc Childrcn on Wcdncsdays; and
c. During thc school ycar, Fathcr will 11iIvc custody of thc Children cvcry
other weekend from Friday at 4:00 p.m. whcn Mothcr brings thc Childrcn to Fathcr's
house, through Sunday at 8:00 p.m. whcn Fathcr will rcturn thc Childrcn to Mothcr's
house; and
d. During the summcr, Father will have custody of thc Children every othcr
weekend from Friday at 4:00 p.m. when Mother brings the Childrcn to Father's housc,
through Monday at 10:00 p.m. whcn Fathcr will rcturn thc Children to Mother's housc;
and
e. During the school ycar, on his scheduied wcekcnd-timc, Father will also bc
entitled to an occasional weekend, provided hc has given Mothcr at Icast seven (7) days
written notice thereof, in which he has thc Children from Friday at 4:00 p.m. through
Monday at 10:00 p.m. This provision is cnlercd into with thc spccific understanding that
in no event is Fathcr to havc morc than two (2) of thcse "occasional weekends" in any
givcn calcndar ycar, Moreovcr, Mothcr shall not unrcasonably withhold pcnnissioll for
thc Childrcn to bc with Fathcr during thcse "occasional wcckcnds"; and
f. It is spceilically understood bctwccn thc partics that duc to a prior
comll1itmcnt ofthc Childrcn, thc partics will not cOlllmcncc thc Wcdncsday visitation until
May 7, 2003; and
3. Both Mothcr and Fathcr shall havc two (2) wccks (14 days) of unintcrruptcd
vacation till1c with thc Childrcn. Both Mothcr and Fathcr arc cntitlcd to takc thcsc days as
eonsccutive days if hc or shc wishcs to do so. Fathcr is cntitlcd to usc a portion of thc Children's
cxtcndcd vacation timc from school for Christmas and/or Thanksgiving to usc his vacation time
(with thc specific undcrstanding that thc holiday schcdulc, below, will takc preccdencc ovcr
Father's vacation time). Fathcr will nccd to provide at least tcn (10) days' advancc written notice
of when he plans to usc said vacation time. Neithcr party will unrcasonably withhold pcrmission
for the Children to be with temporary custodian during his or her chosen vacation time.
In the evcnt that eithcr party is planning to take thc Childrcn out of this Court's
jurisdiction, they ll1ust provide rcasonable notice and contact information for the locations at
which the Children wiII be staying. Should cithcr party have plans schcdulcd for vacution and the
required seven (7) days noticc has not been given, the party who first givcs notice to the othcr
shall take precedencc, and the other party shall not schcdule vacatioll during that time.
The periods of partial custody for vacations shall be in addition to, and shall take
prccedence over, but shall not alter the schedule or scqucnce of rcgular pcriods of partial custody
for thc parcnt as sct forth prcviously in this Stipulation. Ilulida)'s and olhcr spcciill days slmlltakc

4, Thc holiday schedule shall takc prcccdcncc ovcr thc rcgular visitulion schcdulc
and thc vacation schcdulc and shall bc as follows:
a. During eh ristmas, commcncing III 2003 and in odd-numbcrcd ycars
thcrcaftcr. Mothcr shall havc thc right of partial custody from Dcccmbcr ::4,h at noon, or at
thc conclusion of school. through Dcccmbcr 25'h at noon (hcrcinaftcr rcfcrrcd to as
"Scgmcnt A") and Fathcr shall havc thc right of partial custody from Dcccmbcr 25'h at
noon through Dccembcr 261h at noon (hcrcinaftcr rcfcrrcd to as "Scgment B").
During Christmas, commencing in 2004 and in evcn-numbcrcd ycars
thcreafter. Fathcr shall havc thc right of partial custody for Scgmcnt A, and Mothcr shall
have thc right to partial custody for Scgment B.
For Christmas custody cxchangcs, thc party recciving thc Children will
pick up the Children from the othcr parties' homc; and
b. During Thanksgiving, commencing in 2003 and in odd-numbered years
thereafter. Father shall havc the right of partial cllstody from the Wedncsday prior to
Thanksgiving at noon, or atthc conclusion of school, through Thanksgiving Day at 3:00
p.m. (hereinafter referrcd to as "Segment A") and Mother shall have the right of partial
custody from Thanksgiving Day at 3:00 p.m. through Black Friday at 3:00 p.m.
(hereinafter referrcd to as "Scgment B").
During Thanksgiving, commencing in 2004 ano in cvcn-numhcrcd ycars
thcrcaftcr, Mothcr shall havc thc right to purtial custody for Scgmcnl A, and Fathcr shall
havc thc right to partial custody for Scgmcnt B.
For Thanksgiving custody cxchangcs, the party rcceiving Ihc Childrcn will
pick up thc Childrcn from thc othcr partics' homc; and
c. For Father's Day and Mother's Day, Mothcr shall always havc thc right
to partial custody on Mothcr's Day. Fathcr shall always havc thc right of partial custody
on Fathcr's Day. Thc rights of partial custody shull be cxcrciscd from 8:00 p.m., thc
Saturday bcforc the holiday, through 9:00 p.m. thc duyorthc holiday. Thc party rccciving
the Childrcn will pick up thc Childrcn from thc other parties' home; and

thc parcnt who is to rcccive custody atthc timc ofthc cxclmngc to providc for transportation frol11
the rcsidence of thc other parent. At all timcs, thc Children shall be sccured in appropriatc
passcnger restraints. No pcrson transporting thc Childrcn shall consume alcoholic bevcrages prior
to transporting thc Childrcn. No pcrson transporting thc Children shall bc under thc inllucnce of
any alcoholic bevcragcs whilc transporting the Children.
6. In thc cvent that cithcr party is morc than thirty (30) minulcs late for a custody
exchange, in the absencc of a tclephonc call or othcr communication from thc parent transporting
the Children, the othcr party may assume that the parent who is late has chosen not to exercise
that period of custody, the period will be forfcited, and the other party will be free to make other
plans with thc Childrcn.
7. To thc extent possiblc, cach party shall provide the other with at least forty-eight
(48) hours advancc notice of school, sporting, or othcr cxtracurricular activities. Both parties
shall agree to honor and participate in thc activitics that thc ChiIdrcn wish to engage in. During
thc times that each of thc parents have custody of the Children, they will make certain that the
Children attend any extracurricular activities. Thc parties arc dircctcd to be supportive of the
uctivitics and will trunsport thc Children to and from such i1ctivitics i1nd thc prcp"mtions und
practicc for thc activitics thul arc schcduIcd, in such timc so thilt thc Childrcn arc ablc to
participatc in thosc cvcnts.
Ncithcr parcnt, howcvcr, shilll commit thc Childrcn to i1ny ilclivily unlcss thc Childrcn
definitely desirc to "ucnd thm i1ctivity. Particip"tion in i1ctivitics which tilkc placc during thc
school ycar is contingcntupon thc Childrcn maintaining passing gradcs in school.
Ncither parent shall commit thc Childrcn to activitics that fall on thc othcr parcnt's pcriod
of custody, without thc conscnt of thc othcr parcnt, which conscnt shall not bc unrcusonably
withheld. If thc Childrcn i1rc involvcd in an activity which occurs during both parcnts' pcriods of
custody, both parcnts shall coopcratc in providing transportation of thc ChiIdrcn to thc activity.
However, the custodial parcnt shall not bc rcquircd to take thc childrcn to that activity if thc
custodial parent and Childrcn arc out of town during thilt activity, for a previousIy-schcduIed
vacation.
In the event that thc custodial parcnt is unablc to delivcr thc Childrcn to the particular
activity, the parcnt who has custody of the Childrcn at that time shall notify the non-custodial
parent, who shall be entitled to pick up and deliver thc Children to the designated activity. The
custodial parent shall make ccrtain that the Childrcn arc rcady for pick-up in timc sufficient to
enablc the Childrcn to timely attend thc activity.
Should the custodial parcnt elcct not to take the ChiIdrcn to a dcfined activity pcriod for
two (2) times, thcn thc non-custodial parcnt shall have thc right to assume that he or she wiII be
rcsponsiblc for transporting thc Childrcn to that i1ctivity until ilppropriatc transportation IS
providcd.
8, Both partics arc cxpcctcd to usc common scnsc in schcduling telephonc calls to
talk to thc Childrcn. Both partics and/or thcir spouscs arc hcrcby dircctcd to rcfrain lrom
preventing the parcnt who may bc calling from talking to the Ci.ildrcn, or prevcnting thc Children
from calling thc othcr parcnt, providcd tl1Ht th~ phonc calls arc not cxccssively frcqucnt nor too
long in duration that thcy disrupt thc Childrcn's schcdule, or intcrfcrc with the custodial purent's
pcriod of custody.
9. Each ofthc partics and any third party in thc prcscncc ofthc Childrcn shall takc all
mcasurcs deemed advisable to foster iI fccling of affcction bctwccn thc Children and thc other
party. Neither party shall do nor shall eithcr parcnt pcrnlit any third pcrson to do or say anything
which may estrangc the Children from thc othcr parent, their spousc or rclatives, or injurc the
Children's opinion of the other party or which may hamper the frcc and natural development of
the Children's love, affection and rcspect for the othcr parcnt.
The parties shall not use the Children to convey vcrbal messages to the other parent about
the custody situation or changes in thc custody schedule.
10. In the event that a significant malleI' arises with rcspect to the medical care,
education, or financial care of the Childrcn such as a change in occupation, health insurance,
educational expenses, or residence of a party, those malleI'S shall be discussed with the other party
bcfore any change is made by eithcr parcnt.
11. Each party shall confcr with thc othcr on alllllilllcrs of importancc rclaling to thc
Childrcn's hcalth, maintcnancc, and c,lucation with a view towards obt:lining and following a
harmonious policy inthc Childrcn's cduciuion and soci:ll :Idjustmcnts. Each p:lrty agrccs to kccp
thc othcr infomlcd of his or hcr rcsidcncc and tclcphonc nnmhcr to facilitatc communication
conccrning thc wclfarc of thc Childrcn and thc custody situation. Each party shall supply thc
n:lmc, addrcss :Ind phonc numbcrs of any pcrsons in whosc carc thc childrcn will bc in for a
pcriod in cxccss of scvcnty-two (72) hours, and for cach pcrson or cntity which may providc
daycarc for thc Childrcn, cxcluding currcnt daycarc providcrs, rclativcs, or public school
institutions.
12. Emcrgcncy decisions rcgarding thc Childrcn shall bc madc by thc parcnt then
having custody. Howcvcr, in thc event of :Iny cmcrgcncy or scrious illness of eithcr Child at any
time, any party thcn having custody of lhc Child shall immediately communicate with thc othcr
party by telephonc or any olher means practical, infonl1ing thc othcr party of thc nature of the
illness or emergency, so the othcr parcnl cun bccomc involvcd in thc dccision-making proccss as
soon as practical.
The teml "scrious illness" as lIsed hcrcin shall mcan any disability which confines thc
Child to bed for a pcriod in excess of scvcnty-two (72) hours and which places the Child under
the direction of a liccnscd physician.
13. The welfare and convenicnce of thc Childrcn shall be the prime consideration of
the parties in any application of thc provisions of this Stipulation. Both parents are directed to
Iistcn carcfully and considcr thc wishcs of thc Chiidrcn in addrcssing thc custodial schcdulc, :my
changcs to thc schcdulc. and any othcr parcnting issucs.
14. No party shall smokc in any pnrt of a conlincd mca with Ihc Childrcn prcscnt and
ncithcr party shall pcnnit anothcr pcrsonto smokc in allY part of a conlincd arc wilh thc Childrcn
prcscnt. No party shall consumc illcgill substanccs whcn in thc prescncc ofthc Childrcn.
15. Thc partics arc frcc to modify thc tcnus of this Stipulation, but in ordcr to do so,
thc partics must bc in complctc agrccmcnt to any ncw tcmlS.
16, Thc partics agrcc to coopcratc with onc anothcr in an cffort to fostcr a loving,
mcaningful rclationship wilh cach parcnt.
17. In thc cvcnt that Fathcr has to miss his schedulcd custody pcriod, duc to no fault of
his own, Mothcr hcrcby agrces to bc I1cxiblc with the schcdulc and allow Fathcr to makc up that
timc during onc of his non-custodial pcriods. In thc evcnt Fathcr misscs and entirc wcekcnd,
his make up timc will not affect thc rotation of thc schcdulc, mcaning that he would not
necessarily have thc following wc,'kcnd, but pcrhaps could makc up the time during
wceknights or in the summer.
18. Any major, long-tcml modilications of this Stipulation nced to be in writing,
agreed to by both parties, and exccutcd with thc same fornmlitics as this Stipulation. Minor,

I. The prior Order of Court dated August 18. 2003 shall remain in fulllorcc
and effect with the follo\\ing modifications and additions:
2. Paragraph 2a is modified such that on ;vIondays. Father will pick up the
children from Mother's house at 5:30 p.m. and Mother ",ill pick up the children from
Father's house at 8:30 p.m. In the event Father will be late in picking up the children at
5:30 p.m., Father's \\ife mar pick up the children. The extended alternating weekend
schedule for the summer shall remain in cffect, nonetheless.
3. The parents shall strictly comply \\ith Paragraph 7. It is reiterated that the
parents will assure that the children participate in their scheduled extracurricular
activities.
4. Counsel for the panics shall exchange memoranda to concretely establish
a holiday schedule.
5. The parents shall strictly comply with Paragraph 9. Neither party shall say
or do or perll1it a third pan;: to say or do anything that may estrange the children from the
other party, or injure the opinion of the children as to the other parry, 01' may hamper the
free and natural development of the children's love or affection for the other party.
6. When and if the children's counselor recommends it, the parents shall
cooperate with a separate counselor at Riegler, Sheinvold and Associates to jointly
address the children's problems. The parties agree to split the cost of the co-pay for the
counseling.
7. This Order is entered pursuant to an agreement of the parties at a Custody
Conciliation Conference. The parties may modify the p,ovisions of this Order by mutual
