Defendant issued to plaintiffs several written warranties,

odometer showed 22,871 miles. On that date, repair attempts were
made to repair the vehicle's defective flash module. Also on

made to repair the vehicle's defective gas pedal. Also on that
date, a repair attempt was made to remedy a defective
gasket/cylinder head that was leaking oil from the engine. Also
on this date, repair attempts were made to remedy a defective
switch that controls the turn signal/beam select/hazard signal.

11. In addition, the vehicle has been subject to other
repair attempts, including a repair attempt to remedy another

CIVIL ACTION-LAW
ANSWER TO NEW MATTER
AND NOW comes Plaintiffs, Lyleanne Dallago and Mark H.
Hertzler, by and through their attorneys, Killian & Gephart, and
set forth the following Answer to New Matter in the above-
captioned case:
33. Denied. To the contrary, Plaintiffs' Complaint sets
forth three theories of law, including the breach of the
Magnuson-Moss Federal Trade Commission Warranty Improvement Act,
breach of the Uniform Commercial Code, and the Pennsylvania
Unfair Trade Practices and Consumer Protection Law. Plaintiffs
assert that they have sustained their burden of production to
state a claim for which relief may be granted.
34. This paragraph contains a conclusion of law to which no
response is required. By way of further answer, to the extent
that this paragraph contains allegations of facts, the same are
specifically denied.
35. Denied. It is denied that Plaintiffs ever neglected,
misused, abused, modified or altered the subject vehicle.
36. Denied. To the contrary, Plaintiffs have sought the
asaiatance of Chrysler corporation and itn authol'ized d,,:I1"l' on
at least four (4) oceanions. plainti(fo aloo attempt"d informal
diapute fJ"ttlement through Chryslpr' n National Center (01' Dinpute
Resolution prior to the filing of their complaint.
Unfortunately, none of the attempts of Plaintiffs have been
successful,
37. This paragraph contains a conclusion of law to which no
response is required. By way of further answer, to the extent
that this paragraph contains allegations of facts, the same are
specifically denied.
38. Denied. As stated in the Complaint, the non-
conformities in the instant action relate to defective flash
module, defective gas pedal, defective brakes, defective
transmission, defective gas/cylinder head and defective turn
signal/beam select/hazard signal control switch that
substantially impair the use, value and safety of the subject
vehicle.
39. This paragraph contains a conclusion of law to which no
response is required. By way of further answer, to the extent
that this paragraph contains allegations of facts, the same are
specifically denied.
40. Denied. It is well settled under pennsylvania and
Federal law that attorneys' fees are recoverable by a prevailing
plaintiff in a Magnuson-Moss action.
41. This paragraph contains a conclusion of law to which no
response is required. By way of further answer, Plaintiffs will
request that this Honorable Court exerciue its discretion and
award treble damagen to Plaintiffs if Plaintiffs prevail due to
the fact that the Dcfendant. continues to i9norp serious and
ongoing problems and a potentially fatal defect inherent in the
subject vehicle,
42, This paragraph contains a conclusion of law to which no
response is required. By way of further answer, to the extent
that this paragraph contains allegations of facts, the same are
specifically denied.
43, Denied. By way of further answer, Plaintiffs purchased
the vehicle for recreational and personal use.
44. This paragraph contains a conclusion of law to which no
response is required. By way of further answer, it is averred
that Plaintiffs' claims are not time-barred because they fell
well within the applicable statute of limitations. Actions under
the Magnuson-Moss Act may be brought within four years of the
discovery of a defect. Actions arising under the Unfair Trade
Practices Law may be brought within six years of when the cause
of action accrues. Gabriel v. O'Hara, 534 A.2d at 493. As for
breach of express warranty, the applicable statute of
limitations, 13 Pa.C.B.A. ~2725, provides that a breach of
warranty action must be commenced within four years from the date
it accrues. A claim for breach of implied warranty accrues on
the date the seller delivers the vehicle. Nationwide Insurance
Comoanv v. General Motors Corooration, 533 Pa. 423, 625 A.2d
1172, 1178 (Pa. 1993).
