Mechanicsburg. Pennsylvania and being more 1IIIIy deseribcd un Schedule A. attached hereto and
made a part hereof.
WHEREAS. the Owner has cntered into a long tcrm ground lease with Developer for lh~
prcmises more fully described on Schedule A which lease is el'idenced by a Memorandum of Lcase
rccorded or to be recorded on the Cumberland County Land Records.
WHEREAS. the Contractor has covenanted. promised and agreed that no mechanics' claims
or liens should be entered and filed againstthc said parcel of land. the buildings or any part thereof.
or thc curtilage or curtilages appurtenant thcreto.
NOW T/fIS AGREEMENT W/7iVESSETll: That Contractor for and in consideration of the
awarding to him by Developer of said contmct as aforesaid. as well as the further consideration of
One Dollars ($1.00) to it paid at or before the ensealing and ddivery of these presents, the receipt
whereof is hereby acknowledged. does hereby covcmmt, promise and agree that no mechanics' lien
or claim or other lien or claim of any kind whatsoever shall be liIed againstlhe said parcel of land,
the building or buildings or the eurtilagc or curtilages appurtcnant thereto, by Contractor or by any
sub-contractors, materialmcn, and laborers lor IVork done or matcrials fumished under said contract
for and about the construction of said building or buildings or any part thereof, or on ereditthereof:
and the said Contractor, for itself and its sub-contractors and others under it or them hereby expressly
waive and relinquish the right to have, file and maintain any meclHmics' liens or claims against said
land. the building or curtilage; and that all sub-contractors, matcrialmen, and laborers on said work
shall look to and hold Contractor personally liablc lor all sub-contracts, nmtcrials furnished and work
and labor donc. so that there shall not be any legal or lawllll claim of any kind whatever against
Developer (or any of thcm) lor any work don~ or labor or mat~rials Illrnishcd undcr said contract lor
and about he er~ction, construction and compl~tion of said building as aforesaid, or und~r any
contracts lor cxtra work, or for work supplcl1l~ntal thereto, or otherwise.
AND, in order to giv~ the Owner full power and authorily to protect themselves and the lot
