on or about January 19, 1999. Plaintiff filed an Amended Answer

likely reason that Plaintiff has filed discovery is that she has
been unable to provide any evidence to support a cause of action
in court. It is believed by Defendant that the Plaintiff is
purely on a fishing expedition with her overly broad and
burdensome questions, outside the scope of any discovery
requests. Defendant avers that only until after the defects in
the original complaint are cured, and the Plaintiff plainly
states a cause of action that Defendant can answer, do the

AND NOW, comes the derendant, Douglas R. Sisti, by and
through his attorneys, Stone LaFaver & Shekletski, and files the
following preliminary objections pursuant to Pa. R. C. P. 51028 et
seq., avers as follows:
FAILURE OF A PLEADING TO CONFORM TO LAW OR RULE OF COURT
AND INSUFFICIENT SPECIFICITY IN A PLEADING
PURSUANT TO PA. R.C.P. 1028
1. Plaintiff has failed to plead specifically any law in which
her cause of action mayor may not be based; therefore, there is legal
insufficiency of a pleading.
2. Plaintiff has failed to plead with any specificity in
paragraph 22 of plaintiff's complaint, what, if any, damages she has
suffered by defendant's alleged conduct or non-disclosure; therefore,

to allege any information that might suggest just what damages she has
suffered. The complaint is both legally and factual insufficient and
fails to corform to any action based in law or equity.

3. Plaintiff has failed to allege sufficient facts to support a
cause of action. Plaintiff has failed to state or allege any privity
between the parties that would now support some division of property,
even if there were any property jointly purchased. More specifically,
in paragraph 13 of plaintiff's complaint, plaintiff does not plead
with any specificity the nature of the "indirect" contribution that
she mayor may not have made toward any purchases. Further, there is
no description of whether this "indirect." contribution was monetary,
and, if so, how much, or otherwise; therefore, there is legal
insufficiency of a pleading.
4. plaintiff has failed to allege sufficient facts to support
the allegations of defendant's knowledge or awareness of any oral
agreement that the parties mayor may not have had with regard to any
arrangement of the defendant's business, specifically, in paragraph 20
of plaintiff's complaint.

support a causc of action. Morc specifically, in paragraph 5 of
plaintiff's cOlnplaint, plaintiff has failed to provide any
documentation, any evidence, any proof, that there was ever any
agreement between the parties.
4. Plaintiff has failed to state with any degree of
specificity in paragraph 17 what, if any, assets the Defendant is
alleged to have taken that may have been jointly owned by the
parties. Specifically, Plaintiff has failed to allege which
stocks, what time share, and what personalty were funded by
contributions, and finally, facts showing proof of any
contributions on the part of the Plaintiff.
