CIVIL ACTION - COMPLAINT IN MORTGAGE FORECLOSURE IMC Mortgage Company, by its attorneys, Grenen & Birsic, P,C., files this Complaint in Mortgage Foreclosure as follows: 1, The plaintiff is IMC Mortgage Company, Successor by merger to Industry Mortgage Company L,P., which has its principal place of business at 5901 East Fowler Avenue, Tampa, Florida 33617- 2362. 2. The Defendant is Bryan L, Smith, whose last known address is 463 Old State Rd., Gardners, PA 17324. 3. On or about March 14, 1998, Defendant executed an Adjustable Rate Note, (Hereinafter "Note"), in favor of Alternative Lending Mortgage Corp" (Hereinafter "Alternative"), in the original principal amount of $35,000,00, A true and correct copy of said Note is marked Exhibit "A", attached hereto and made a part hereof, 4. The Plaintiff is IMC Mortgage Company, Successor by merger to Industry Mortgage Company L.P., which has its principal place of business at 5901 East Fowler Avenue, Tampa, Florida 33617- 2362. 2. The Defendant is Bryan L. Smith, whose last known address is 463 Old State Rd., Gardners, PA 17324. 3. On or about March 14, 1998, Defendant executed an Adjustable Rate Note, (Hereinafter "Note"), in favor of Alternative Lending Mortgage Corp.. (Hereinafter "Alternative"), in the original principal amount of $35,000.00. A true and correct copy of said Note is marked Exhibit "An, attached hereto and made a part hereof. 4. On or about March 14, 1998, as security for payment of the aforesaid Note, Defendant made, executed and delivered to Alternative a Mortgage in the original principal amount of $35,000.00 on the premises hereinafter described, said Mortgage being recorded in the Office of the Recorder of Deeds of Cumberland County on April 1, 1998 in Mortgage Book Volume 1442, Page 777. A true and correct copy of said Mortgage containing a description of the premises subject to naid r-1ortgage is markf~d Exhibit "B", attached hereto and made a part het'eo[. 5. All interest and title was assigned to Plaintiff pursuant to the terms of a certain Assignment of Mortgage. 6. Defendant is the record and real owner of the aforesaid mortgaged premises. 7. Defendant is in default under the terms of the aforesaid Mortgage and Note for, inter alia, failure to pay the monthly installments of principal and interest on said Note when due. Defendant is due for the April 21, 1998 payment. 8.
