COMPLAINT
NOW come the Plaintiffs, Sharon E, Delaney and Richard Delaney, her
husband, through their allorney, Philip S, Cosentino, and for cause of action
against the Defendants set forth the following:

Plaintiff, Sharon E. Delaney, is an adult individual living and residing at
4511 Jack Road, Chambersburg, Franklin County, Pennsylvania 17201,

Plaintiff, Richard Delaney, is an adult individual living and residing at 4511
Jack Road, Chambersburg, Franklin County, Pennsylvania 17201.

Defendant, Richard Woodruff, is an adult individual living and residing at
109 Tall Oak Drive, New Cumberland, Pennsylvania 17070, trading and doing
business as McDonald's Restaurant located at 6200 Carlisle Pike,
Mechanicsburg, Cumberland County, Pennsylvania,

Defendant, McDonald's Corporation, d/b/a Delaware McDonald's
Corporation, is a business corporation organized and existing under the laws of
the State of Delaware, and doing business within the Commonwealth of
Pennsylvania with offices located at 6200 Carlisle Pike, Mechanicsburg,

Plaintiff hereby incorporates paragraphs 1, 3, and 4 as though fully set forth
at length herein,

On December 8, 1996, at approximately 11 :00 a,m" Plaintiff, a business
invitee of Defendants, was walking in the parking lot of the McDonald's
Restaurant, owned and operated by the aforementioned Defendants at 6200
Carlisle Pike, Mechanicsburg, Cumberland County, Pennsylvania,

On said date, time, and place, Plaintiff slipped on ice located in the parking
lot immediately adjacent to the curb surrounding the outside walkway of the
restaurant building.

As a result of the fall, Plaintiff sustained the following injuries:
1. Contusions to the scalp and left wrist;
2, Abrasion to the left elbow; and
3, Left shoulder rotator cuff tear.

Plaintiff's fall was caused by the negligence of the Defendants consisting of
the following:

A. Defendants' failure to warn Plaintiff, a patron of their
business, of the presence of ice in the parking area;

B, Defendants' failure to inspect the parking area for
hazardous conditions and either warn of the condition or eliminate
the condition;
C, Defendants' failure to treat the area of the parking lot where
Plaintiflfell with anti-skid or de-icing materials, knowing or having
reason to know that the area was icy; and
0, Defendants' failure to use due care under the
circumstances,

By reason of her injuries, Plaintill has received medical attention and care
rendered by the following medical providers on the dates indicated and has
incurred liability for payment of bills for that medical attention and care in the sums
indicated which are reasonable and customary in the community where Plaintiff

dismissal, by judgment order or otherwise, all McDonald's Corporation materials, including any and
