6. Despite numerouo d~m~ndn, Delendant has lailed and
refused, and continuos to fail and roluoo, to ropay oaid loan to
Plaintiff.
7. On or about September I, 1998, Plaintiff loaned to
Defendant certain newly purchased items of personal property.
8. The items of personal property which were loaned
by Plaintiff to Defendant are set forth below, together with
their respective values:
Hewlett Packard Laser Printer
GBC Binding Machine
Binding Supplies
Hewlett Packard Scanner
File Cabinet
Mapping Software
Clip Art Software
Office supplies
Laminated Map, plus pens
9. Despite numerous demands, Defendant has failed and
refused, and continues to fail and refuse, to return said items
of personal property, or pay Plaintiff the value thereof.
10. Plaintiff seeks payment from Defendant of the
value of said items of personal property.
WHEREFORE, Plaintiff requests judgment in his favor and
against the Defendant in the amount of $5,880.42, representing
the $4,000.00 loan, and the $1,880.42 value of the loaned
personal property, together with interest on the $4,000.00 loan

12, Counterclaim Plaintiff Katie Jo Lohr is an adult individual residing at 14 Maybelle
Court, Mcchanicsbarg, Pennsylvania 17055.
13, Countcrclaim Dcfendant Robert R, Gagnc is an adult individual residing at 14 Peach
Drivc, Lititz, Pennsylvania 17543,
14, Some time in August or September of 1998 a business relationship between the
Plaintiff and Defendant deteriorated to the extent that it became apparent to both parties that the
business relationship needed severed or tcrminated,
15, Since that time the Counterclaim Dcfendant engaged in a pattern of unsolicited
contact of the Counterclaim Plaintirfby way of telephone calls, personal contact and the leaving or
messages in a manncr which Mr, Gagne knew or should have known would cause emotional hann
or which was intended to cause emotional ham1 to Ms,Lohr, Ms, Lohr has manifested the following
physical symptoms as a result of the unwanted and unsolicited contact and/or stalking from the

19, As a resull, Katie Lohr has been and may be subject to humiliation and
embarrassment, therefore, may sustain loss of opportunity and a penn anent diminution of caming
power and capacity,
20, Katie Lohr continues to bc plagued by constant and persistent headaches, stomach
pains, emotional and mental distress in day to day living with her family,

IN THE NATURE OF A COUNTERCLAIM
AND NOW comes the plaintiff, Robert R. Gagne, by and through
his attorneys, Friedman & King, P.C., and brings this Reply to
Defendant's New Matter and New Matter in the Nature of a Counter
Claim, averring as follows:
REPLY TO NEW MATTER
1. paragraph 11 is denied as a conclusion of law.
WHEREFORE, Plaintiff, Robert R. Gagne, demands judgment in
his favor and against Defendant, Katie Jo Lohr, on Defendant's
New Matter.
REPLY TO NEW MATTER IN THE NATURE OF A COUNTERCLAIM
2. The averments contained in paragraph 12 are admitted.
3. The averments contained in paragraph 13 are admitted.
4. The averments contained in paragraph 14 are admitted.
Moreover, it is averred tha't the business relationship between
the Plaintiff and Defendant had deteriorated by August, 1998.
5. The averments contained in paragraph 15 are denied. By
way of further answer, it is averred that all contacts between
Counterclaim Defendant and Counterclaim Plaintiff were consensual
for business purposes. Moreover, it is averred that the
Counterclaim plaintiff, Mrs. Lohr, reported her allegations of
the Counterclaim Defendant's, Mr. Gagne's, alleged unwanted and
unsolicited contact and stalking to the Hampden Township police,
who found Mrs. Lohr's allegations non-credible and who in fact
may have investigated Mrs. Lohr for filing false charges.
16. Denied and proof thereof demanded at trial.
17. Denied and proof thereof demanded at trial.
18. Denied and proof thereof demanded at trial.
19. Denied and proof thereof demanded at trial.
