POWERTRAIN RECYCLING, INC., Defendant CWIL DWISION CIVIL ACTION - COMPLAINT IN BREACH OF CONTRACT AND NOW, comes American Insurance Administrators, Inc. ("Plaintiff'), by and through its attorneys, James, Smith, Dietterick & Connelly LLP, and files this Complaint in Breach of Contract as follows: 1. The Plaintiff, American Insurance Administrators, Inc., is a corporation authorized to conduct business in the Commonwealth of Pennsylvania and having its principal place of business located at 4550 Lena Drive, Mechanicsburg, Cumberland County, Pennsylvania 17055. 2. Defendant, Powertrain Recycling, Inc., is a corporation authorized to conduct business in the Commonwealth of Pennsylvania and having its principal place of business located at 2322 North 7th Street, Harrisburg, Dauphin County, Pennsylvania 17110. 3. Between July 21, 2000 and May 21, 2002, Defendant contracted with Plaintiff for certain insurance policies and Defendant agreed to pay Plaintiff for same as invoiced. 4. Between July 21, 2000 and May 21, 2002 Plaintiff supplied Defendant with certain insurance policies and Defendant accepted same and on or about December 16, 2002, Defendant was invoiced by Plaintiff for unpaid policies in the amount of Sixteen Thousand Five Hundred Forty Eight Dollars and Eighty Five Cents ($16,548.85). A true and correct copy of said invoice is marked as Exhibit "A", attached hereto and made a part hereof. 5. Plaintiff has demanded payment of the unpaid balance of the aforesaid invoice in the amount of Fourteen Thousand Forty Eight Dollars and Eighty Five Cents ($14,048.85), but, to date, Defendant has failed or refused to pay said unpaid balance. 6. Any and all conditions precedent to payment to Plaintiff have been satisfied. 7. Notwithstanding Plaintiffs demands for payment, Defendant's obligation to pay for the insurance policies provided by Plaintiff remains unsatisfied. 8. Due to Defendant's breach, Seventeen Thousand Five Hundred Sixty One Dollars and Six Cents ($17, 561.06) is due and owing by Defendant to Plaintiff as of July 21, 2000, itemized as follows: Unpaid Invoices from 7/21/00 Attorneys' fees as of 10/8/02 (25% of total due) TOTAL $14,048.85 $ 3,512.21 $17,561.06 with interest on the unpaid amount ($14,048.85 ) from July 1, 2001, at the legal rate o f interest, plus additional attorneys' fees and costs of suit. WHEREFORE, Plaintiff demands judgment in its favor and against Defendant for the total amount due of Seventeen Thousand Five Hundred Sixty One Dollars and Six Cents ($17,561.06), with interest on the unpaid balance ($14,048.85) from July 1, 2001, at the legal rate of interest, plus additional attorneys' fees and costs of suit.
