COMPLAINT
1. Plaintiff Calvin Hughes is an adult individual
residing in Harrisburg, Dauphin County, Pennsylvania,
2, Defendant Robert W. Stott Ie is an adult individual
residing at 45 South Eighth Street, Lemoyne, Cumberland County,
Pennsylvania.
3, The facts and occurrences hereinafter related took
place on May 10, 1998, on Market Street, Lemoyne, Cumberland
County, Pennsylvania,
4. At that time and place, Mr, Hughes was operating a
1994 Pontiac Sunbird traveling East on Market Street, approaching
the intersection of Market Street and Eighth Street,
5, At the same time, Defendant Stottle was operating a
1978 Chevrolet traveling west on Market Street, approaching the
intersection of Market Street and Eighth Street,
6, As Mr, Hughes' vehicle entered the aforesaid
intersection, Defendant Stottle turned his vehicle left, directly
in front of Mr, Hughes' vehicle.
7. When Defendant Stottle turned left directly in front
of Mr. Hughes' vehicle, he caused a motor vehicle accident.

COUNT II - PUNITIVE DAMAGES

14. Before the subject motor vehicle accident, Defendant
Stott Ie was consuming alcoholic beverages.
15. Defendant Stott Ie knew or should have known that he
was extremely intoxicated and unable to safely operate a motor
vehicle before the subject motor vehicle accident.
16. Defendant Stottle knew or should have known that his
conduct of operating a motor vehicle while intoxicated constituted
outrageous conduct and a reckless indifference to the rights of
others on the highway.
17. Defendant Stottle knew or should have known that
operating a motor vehicle while intoxicated created a high degree
of risk of injury to other persons on Market Street and in fact, he
did cause a motor vehicle accident resulting in personal injury,

18. paragraphs 1 through 17 of the Complaint are
incorporated herein by reference,
19, Plaintiff Calvin Hughes sustained painful and severe
injuries which include, but are not limited to, head trauma, facial
scarring, post-traumatic stress disorder, cervical and thoracic
spine injuries, and constant headaches,

20. By reason of the aforesaid injuries sustained by Mr,
Hughes, he was forced to incur liability for medical and medical
treatment, hospital treatment. and similar miscellaneous expenses
in an effort to restore himself to health, and claim is made
therefor.
21. Because of the nature of his injuries, Mr. Hughes
has been advised and, therefore, avers that he may be forced to
incur similar expenses in the future, and claim is made therefor.
22. As a result of the aforementioned injuries, Mr.
Hughes has undergone and in the future may undergo physical and
mental suffering, inconvenience in carrying out his daily
activities, loss of life's pleasures and enjoyment, and claim is
made therefor,
23. As a result of the aforesaid injuries, Mr, Hughes
has been and in the future may be subject to humiliation and
embarrassment, and claim is made therefor,
24. Mr. Hughes continues to be plagued by persistent
pain and limitation and, therefore, avers that his injuries may be
of a permanent nature, causing residual problems for the remainder
of his lifetime, and claim is made therefor.
25, As a result of the aforesaid accident, Mr. Hughes
has sustained scars which will result in a permanent disfigurement,
and claim is made therefor.
WHEREFORE, Plaintiff Calvin Hughes demands judgment against
Defendant Robert Stottle in an amount in excess of Twenty-five
Thousand ($25,000.00) Dollars in compensatory and punitive damages

exclusive of interest and costs and in eXCeHfJ of any jurisdictional
amount requiring compulsory arbitration,

PLAINTIFF'S PETITION FOR RULE TO SHOW CAUSE WHY THE
DEFENDANT SHOULD NOT ANSWER PLAINTIFF'S INTERROGATORIES AND
PAY COUNSEL FEES AND COSTS ASSOCIATED WITH FILING SAID PETITION
AND NOW COMES the Plaintiff, Calvin Hughes, and hereby
petitions Your Honorable Court for a Rule to Show Cause why the
Defendant should not answer Plaintiff's Interrogatories (Sets I and
II) and pay counsel fees and costs associated with filing said
Petition, and in support thereof, Plaintiff avers the following:
1, As a result of the injuries Plaintiff Calvin Hughes
sustained in a motor vehicle accident that occurred on May 10,
1998, involving Defendant Stottle, the Plaintiff filed a Complaint
on December 4, 1998,
2. On or about January 6, 1999, Attorney Richard Wix
entered an appearance on behalf of the Defendant,
3. On or about January 7, 1999, Plaintiff's counsel
served Defendant's counsel with Interrogatories (Sets I and II),
