WAIVER OF RIGHT TO FILE MECHANICS' LIeNS
WHEREAS, ALAN L. JUMPER and SANDRA D, JUMPER, Owner, of 572
Hillcrest Drive, Carlisle, Pa 170]3, entered into ~ contr~ct
with H. EDWIN BERKHEIMER, Contractor, of Boiling Springs,
Pennsylvania, to provide materials and perform labor necessary
for the construction of a residential dwelling upon a tract of
land situate in South Middleton Township, Cumberland County,
Pennsylvania, more particularly bounded and described as follows:
SEE ATTACHED EXHIBIT "A"
NOW, THEREFORE, it is hereby stipulated and agreed by and
between the said parties, as part of the said contract and for
the consideration therein set forth, that neither the undersigned
Contractor, any subcontractor or material man, nor any other
person furnishing labor or materials to the said Contractor under
his contract, shall file a lien, commonly called a mechanics'
lien, for work done or materials furnished to the said building,
improvements or any part thereof.
THIS STIPULATION is made and intended to be filed with the
Cumberland County prothonotary within ten (10) days after date,
in accordance with the requirements of Act of Assembly of
Pennsylvania, in such case provided.
IN WITNESS WHEREOF, the said parties hereto, intending to be
legally bound hereby, have hereunto set their hands and seals
this 7th day of December, 199

LEGAL DESCRIPTION
ALL that certain tract of land situate in South Middleton
Township, Cumberland County, Pennsylvania, more particularly
bounded and described pursuant to Subdivision Plan for
Cobblcstonc Estatcs, Shcct No.2, rccorded in Cumberland County
Plan Book 70, Page 130A, as follows:
BEGINNING at a point on the southern right of way line of
Cobblestone Drive (50 feet wide right-of-way) at the northeastern
corner of Lot No. 18 as shown on the above described Subdivision
Plan; thence by the southern right of way line of Cobblestone
Drive by a curve to the left having a radius of 225,00 feet an
arc distance of 76.42 feet to a point on said right of way line
at the southwestern corner of Lot No. 16 as shown on the above
described subdivision plan; thence by said Lot No. 16, South 550
32' 34" East, 282.80 feet to a point in line of land now or
formerly of Olga J. Lyons; thence by said land now or formerly of
Olga J. Lyons and land now or formerly of Stuart M, Johnston and
wife, South 50 00' 48" East, 97.69 feet to a point in line of
land now or formerly of Residential Homes Company; thence by said
land now or formerly of Residential Homes Company, South 890 00'
12" West, 145.12 feet to a point in line of said land at the
southeastern corner of Lot No. 18 as shown on the above described
subdivision plan; thence by said Lot No. 18, North 360 05' 02"
West, 254.05 feet to a point on the southern right of way line of
Cobblestone Drive, the point and place of BEGINNING,
CONTAINING 0.8952 acres or 38,993.85 square feet and being
designated Lot No. 17 as shown on above described subdivision
plan.
BEING the same premises which Petersburg Road Associates, a
Pennsylvania general partnership, by its deed dated July 26,
1996, and recorded in the Office of the Recorder of Deeds in
and for Cumberland County, Pennsylvania in Deed Book 143,
Page 350, granted and conveyed to Alan L. Jumper and Sandra D.
Jumper.
