Dear Attorney Eme~f:
Thal"Jc you for you::- letter of October 6, 1998. As noted, r
will be handling this matte::- in the future through you and
contacting you directly. At this time! am rather surprised at the
length of delay and sar:dbagging that has Occur::-ed in allowing my
client to cor:tinue cce::-aticr: or at least cav the bills and maintain
C&L Auto Sales. I will ::-emir:d you that as'Mr. Gulick's estate may
be entitled to a pe::-cer:tage of C&L Auto Sales, they are entitled to
be awarded pa::;:; of theaBsets as well as part of the debt.
When r first met with Atto::-ney Fenstermache::-, ! was assured
that any busir:ess ::-ecords relating to C&L Auto Sales in the
possession of your clients and/or the business p::-emises would be
turned over as soer: as Possible. r have since found out through
the insu::-ance company that your client, Mrs. Gulick has called the
insurer for the business recardir:c ar:v insurance coverace that was
held on the cOrporatior: 0::- for the business. Therefore, it is my
conclusion that there are indeed business records which are being
held by you::- clients as the insurer tells me Mrs. Gulick was able
to ::-eference the policy nUmbe::-, date, etc.
AdcUt,ionally, ! sent a letter addressing the ability to remove
the cars which are clearly titled to C&L Auto Sales. To this r
have, again, ::-eceived no ::-esponse.
Finallv, ! have snoken to several individuals and have been
informed by'at least three separate people that indeed the title to
the Che'rf Blazer which I previously requested was transferred at
Harry's Auto Sales in New Kingston. Harry perfoJ:med the title work

, A. Deadman's Rule Lan)' Gulick died inteslate Wld PlaintilTis not within the
prescribed parameters orintestate descent. The DcadmWl's Act, 77 Pa CSA, Section
5930 (see In Re: The Estate of Gadiparthi, 158 Pa Cmlth 537, 632 A2d 942 (1993))
which proscribes, as incompetent, the testimony of any party asserting Wl inlerest adverse
to the right or interest of the decedent relative to Wly matter occurring prior to decedent's
demise.
B. Abandonment of Fixtures to Leased Premises PlaintilT asserts in her
Complaint her right 10 the return of a hot tub that was affixed to the leased premises or
reimbursement. PlaintilThowever also asserts thai the lease had tenninated and that she
doesn't owe the balWlce of the rent. Fixtures, under the UCC, 13 I'a. CSA, Seclion 9313

11. On or about September 2, 1998, Larry Gulick Jr., son
of Defendants died,
12. At the time of Larry Gulick, Jr.'s death, C & L had
certain business assets located on its premises as are
hereinafter described:
A. 1980's model Chevy Blazer;
B. 1980's model blue Pontiac Sunbird;
C. 1989 burgundy Chevy Corsica;
D. Business records and office furniture;
E. The ti.tle work and down payr:1ent already made" on a
vehicle previously purchased by Donna Miller; and
F. All tools, materials and equipment associated with the
business.
13. Prior to Larry Gulick, Jr.' s death, Defendants claim to
have served notice of eviction t.o C&L; the date is unknown as
Defendants have failed to produce such notice after specific
request.
14. On or about September 4, 1998 Plaintiff Jumper
attempted to enter the business property for the purpose of
i.nventorying and removing C&L assets and was forcibly denied
access by Defendants.

Dear Attorney Emery:
Thank you for your letter of October 6, 1998. As noted, I
will be handling this matter in the future through you and
contacting you directly. At this time I am rather surprised at the
length of delay and sandbagging that has occurred in allowing my
client to continue operation or at least pay the bills and maintain
C&L Auto Sales. I will remind you that as Mr. Gulick's estate may
be entitled to a percentage of C&L Auto Sales, they are entitled to
b<~ awarded part of the assets as well as part of the debt.
When I first met with Attornev Fenstermacher, I was assured
that any business records relating to C&L Auto Sales in the
possession of your clients and/or the business premises would be
turned over as soon as possible. I have since found out through
the insurance company that your client, Mrs. Gulick has called the
insurer for the business regarding any insurance coverage that was
held on the corporation or for the business. Therefore, it: is my
conclusion that there are indeed business records which are being
held by your clients as the insurer tells me Mrs. Gulick was able
to reference the policy number, date, etc.
Additionally, I sent a letter addressing the ability to remove
the cars which are clearly titled to C&L Auto Sales. To this I
have, again, received no response.
Finally, I have spoken to seyeral individuals and have been
informed by at least three separ?te people that indeed the title to
the Chevy Blazer which I previously requested was transferred at
Harry's Auto Sales in New Kingston. Harry performed the title work

Dear Attorney Fenstermacher:
Pursuant to our prev'ious discussions and my previous letter of
September 30, 1998, I am forwarding you more information regarding
C&L Auto Sales.
More specifically, enclosed herewith you will find copies of
the title to the, 1992 Pontiac and 1988 Chevrolet which are
currently sitting on the lot at,C&L's old place of business. These
titles reflect the fact that the title has been cleared and both
vehicles are titled to C&L Auto Sales. Therefore, I am req'.lesting
that a time and date be set at which time these vehicles may be
removed from your client's property. If a date and time can be set
which is agreeable to all parties and the individuals who will be
towing/moving the vehicles, it will cause little, if any,
disruption to the property. I am forwarding a copy of these
automobile titles as well as a copy of this letter to Detective
Goodhart and would ask that if either' of you have objection to
removing these vehicles that you please contact me so that we may
discuss a reasonable resolution.
It is my understanding that the title work to the Blazer which
was originally located on the property of C&L Auto Sales may be in
the possession of your clients. Ms. Jumper seems to remember
completing the paperwork with :VIr. Gulick, Sr. who stated that he
may have a buyer for it and' retaineri the title work to that
vehicle. In any event, if your clients know the whereabouts of the
title work to the vehicle, I would request that it be provided at
your earliest convenience.

Larry & Toni Gulich whose son. Larry, recently passed away,
Larry and Cindy owned and operated the business known as C & L Auto Sales and had
a lease for the property onTrindle here in Carlisle, There are at least four vehicles still on the
property which are owned by C & L Auto Sales and. in addition, my client's own individually
owned vehicle. that being a Ford Probe, is also on the property, Obviously. there isalso much
in the way of paperwork which is in the office on the property. I am writing because Cindy
attempted to go to the property to arrange or complete, as the case may be, the sale of a car and
at the time she went to the property she was confronted by members of Larry's family who denied
her al:cess to the properlY called her various names and even wentso far as to push her,
Simply stated. my client would like access to the property at a time which is convenient
and reasonable for Larry's parents in order to go to the property remove the vehicles on the
property and all paperwork which belongs ro C & L Auto Sales, I believe that Larry's father may
also have t\vo vehicle titles in his possession which are in the name of C & L Auto Sales and of
course, we would like \hose reltlmed. Finally, Cindy & Larry did live in the home which adjoins
the premises for about a year and Cindy still has a few things there that she would like to remove,
We would like to think that \his could al! be done on a reasonable basis as all my client
would like to do is remove property which rightfully belongs to her and/or \he business that she
