PEFENDANTS' PRETRIAL MEMORANDUM
1, FACT~: The Plaintiffs purchased the Defendants / house
at 11 Conway Drive. Upper Allen Township, Mechanicsburg, on
June 5, 1998. After moving in, the Plaintiffs found a wet spot
on the carpet in the lower level family room and upon
investigation. after removing the panelling, found evidence of
moisture. On the disclosure statement / the Defendants had
represented that they were not aware of "any water leakage or
accumulation within the basement." At depositions, they admitted
to having a small amount of water during the Agnes flood in 1972.

3. ISSUES:
A. Whether there was a material misrepresentation by
the Defendants.
B. Whether the Plaintiffs state a claim for treble
damages under the pennsyl vani a Unfair Trade Practices and
Consumer Pl:etect ion lIet.
4. EVIDENCE: No problems are an~icipated.

paneling in the family room was rotted, deteriorated and had
water marks or stains.
8. The conditions of the family room of the house and
Premises as set forth and described in paragraph 7, above, were
latent defects and conditions not easily observable by
Plaintiffs from the time prior to executing the Agreement when
they first viewed the Premises up to and after settlement on
'June 5, 1998.
9. From April 24, 1998, when Plaintiff first viewed the
Premises to after settlement on June 5, 1998, Defendants stored
furniture, furnishings and other property in the family room
concealing the water stained or marked carpet, rusted baseboard
heating elements, electric outlets and rotted and stained wood
paneling.
COUNT I
Fraud
10. The averments of Paragraphs 1 through 9, inclusive, of
this Complaint are incorporated in this Paragraph as if fully
set forth herein in their entirety.
11. By and through the Disclosure statement, Defendants
represented that the information,set forth thereon was accurate
and complete to the best of Defendants' knowledge.

not have entered into the Agreement or, in the alternative,
would have done so only if such measures were taken to ensure
water would not enter into the family room and the paneling,
carpet, electrical outlets and electric baseboard heating were
replaced.
31. As a direct, proximate and factual result of the
fraudulent concealment by Defendants of the existence of water
in the family room, the infiltration of water into the family
room and the tendency of water to enter i.nto the family room,
Plaintiffs sustained the damages and losses more fully set forth
in Paragraph 23, above, the averments of which Paragraph are
incorporated by reference herein.
WHEREFORE, Plaintiffs demand judgment of Defendants,
jointly and/or severally, in the amount in excess of $15,978.33,
together with interest, attorney's fees and costs of this
action.
COUNT III
Violation of the pennsylvania Unfair Trade Practices
and Consumer Protection Act
32. The averments of Paragraphs 1 through 31, inclusive,
of this Complaint are incorporated in this Paragraph as if fully
set forth herein in their entirety.

complaint, Defendants engaged in fraudulent conduct which
created a likelihood of confusion and misunderstanding with
respect to their dealings with Plaintiffs.
WHEREFORE, Plaintiffs demand judgment against Defendants,
jointly and/or severally, in an amount in excess of $15,978.33/
together with interest and costs of this action, attorneys' fees
and tr,eble damages in accordance with the Pennsylvania Unfair
Trade Practices and Consumer Protection Act.
In the alternative to the monetary damages claimed in this
action, Plaintiffs request rescission of the parties' Agreement
and return of all moneys paid Defendants in purchase of the
premises, all costs associated with procuring the loan utilized
to purchase the Premises, financing charges, loan costs, title
costs, mortgage interest paid, certification fees together with
all other costs and expenses occasioned by or associated with
their purchase of the Premises together with judgment against
Defendants, jointly and/or severally, in all such amounts.

2. Seller shall. promptly upon receipt of said report, but in no evcntlater than 30 days prior to the settlement date specilied
i~ Paragraph 4(1) of the Agreement for the Sale and Purchase of Real Estate, provide a copy of lhe report to the Buyer
and the selling agent. If the report identifies active infestation and/or previous infestation thaI has not been corrected,
Seller shall, ill Seller's expense, have the structure(s) treated for such infestation.

3. If the said report reveals active or previous infestation, whether treated or not, BUYer~lall have ten (10) days from
Buyer's receipt of said report to provide to Seller and the selling agent, at ( ) Seller's Buyer's expense, a writ-
ten report by a professional conlraClor, home inspection service, or structural engineer, hat is limited to the structural
damage, if any. to the property caused by wood destroying organisms and a written estimate of cost to repair such damage.
4, Seller shall, within five (5) days of receipt of the slructural inspection report and estimate, advise whether the damage
will be repaired, at Seller's expense, prior to settlement. If Selin elects 10 npalr prior to settlement tbe partIes sball

property v.ith the damage revealed by the inspection report or being repaid all monies paid by the Buyer on account
