On or about September 3, 1996, the parties entered into an agreement, (see Exhibit "A") in which the defendant assumed the monthly payments of the mortgage 111 exchange for an ownership interest in the property, 20, The parties agree to have the mortgagee continue mailing its monthly request for payment to the Plaintiff's residence 21, The Plaint ill' agreed to provide the Defendant bills for the mortgage upon receipt at which time the Defendant agreed to mail payments directly to the mortgagee, 22, The parties followed this practice until August 1998 as evidenced by the Defendant's payments to the mortgagee, hereto attached as Exhibit "B", 23, The Defendant paid the property taxes and insurance in similar fashion, 24, On or about August 1998, the Plaintifl" unilaterally and without notice stopped providing the Defendant bills for the mortgage, taxes, and insurance, 25, On or about August 1998, the Defendant requested the above-mentioned bills to continue payment and was denied, 26, Upon the Defendant's above-mentioned request. the I'laintill' also denied the existence of any prior agreement between the parties for purchase of the property, 27 On or about.
