Plaintiff requests Defendant, within Thirty (30) Days
after service of these Requests to make the following admissions
for the purpose of this action only and subject to all pertinent
objections to admissibility which may be interposed at trial:
1. That each of the following statements is true:
(1) plaintiff obtained possession of the subject vehicle
during the term of the factory warranty.
(2) The vehicle was registered in the Commonwealth of
Pennsylvania.
(3) Defendant issued several warranties on the subject
vehicle.
(4) Plaintiff is a "Consumer" as defined by 15 V.S.C. ~
2301(3).
(5) Defendant is a "Warrantor" as defined by 15 U.S.C. I
2301 (5) .
(6) The Motor Vehicle Dealers identified in Plaintiff's
Complaint are authorized service and repair facilities
of Defendant.
(7) Plaintiff has returned the vehicle for repair attempts
to components identified under Count I of the Complaint
during the term of the warranty issued by Defendant.
(8) Defendant ia in possession of the express written
warranty pertaining to the subject vehicle.
(9) Defendant maintains a copy of the warranty repair
records and/or a computerized repair history for the
subject vehicle by Vehicle Identification Number.
(10) Plaintiff's vehicle has been subject to repair more
than three (3) times for the same non-conformity.
(11) The non-conformities referenced in Plaintiff's
Complaint remain uncorrected.
(12) The non-conformities existing with the vehicle violate
the express written warranties issued by Defendant.
(13) Defendant does not maintain an informal dispute
resolution process which has been audited by the
Federal Trade Commission within the last 12 months.
(14) Plaintiff has not abused the subject vehicle.
(15) plaintiff has not neglected the subject vehicle.
(16) Plaintiff has not modif ied the subject vehicle.
(17) plaint iff has not altered the subject vehicle.

corporation; that it is qualified to do business and does
business in Pennsylvania; and that it can be served as identlfied
herein.

plaintiff purchased a new 1995 Volkswagen Golf bearing VIN
3VWTD81HXSM055685, ("the vehlcle") in or about June, 1995.
It is
also admitted that answering defendant provided certain express,
limited, written warranties concerning the vehicle which became
effective at the time of the sale of the vehicle.
It is
specifically denied that the vehicle was manufactured by
answering defendant. After reasonable investigation, answering
defendant is without knowledge or information sufficient to form
a belief as to the truth of the remaining allegations of this
paragraph and, therefore, they are denied.

year/24,000 mile express, limited, written, warranty for the
vehicle.
It is also admitted that answering defendant provided
other express, 1 imi ted, wri tten warrant ies for the vehicle. The
terms of the Volkswagen limited, express, written warranties
speak for themselves and are contained in VWoA's warranty book.

NEW MATTER
59. The allegations described in plaintiff'S co~plaint were
caused by the actIons of plaintiff which acts amount: to
negligence, assumption of the risk, superseding cause and misuse
of the product.
60. The Comparative Negligence Act of the Commonwealth of
Pennsylvania partially applies to this cause to reduce and/or
eliminate plaintiff'S cause of aecion.
61. Plaintiff's sole riqhts, i.1' "ny, are <Joverned by the

ter"ms, provisions, remedies and limitations set forth in the
limited, express, written warranties delivered to plaintiff at
the time of the purchase ot the subject vehicle.
62. Answering defendant did not sell the subject vehicle to
plaintiff and cannot be held liable for revocation of acceptance.
63. The damages allegedly sustained by plaintiff are the
result of negligent actions or omissions of other individuals or
entities and are due in no part to a breach of any warranty or to
the conduct of answering defendant.
64. Upon information and belief, plaintiff subjected the
vehicle at issue to abuse, misuse and/or may have been negligent
relative to the use, maintenance and service of the vehicle at
issue, thus causing the vehicle behavior alleged in the
Complaint.
65. Plaintiff's complaints concerning certain operational
characteristics of the subject vehicle, if proven to be true, do
not substantially impair the use, value or safety of the vehicle.
66. Plaintiff's complaint fails to slate a cause of action
upon which relief can be granted against answering defendant.

68. Upon information and belief, plaintiff has not complied
with the specific terms of the Pennsylvania Automobile Lemon Law
prior to filing this action and, thus, is not authorized under
the terms of the statute to bring this action.
69. All demands for consequent ial and out -of -pocket
expenses are precluded by the terms of VWoA's express, limited,
written warranties.
70. Upon information and belief, plaintiff's claims are
precluded by the equitable doctrines of laches, waiver and/or
estoppel.
71. Upon information and belief, the vehicle was modified
by third parties which acts as a superseding cause as to any
claim against answering defendant.
72. Upon information and belief, the statute of limitations
bars all of plaintiff's claims herein.
WHEREFORE, answering defendant demands Judgment in its favor
wich attorney'" fees, costs and other awards which the Court may
deem just.

an authorized service and repair facility of the manufacturer on
numerous occasions. After a reasonable number of attempts, the
manufacturer was unable to repair the non-conformities.
18. The first warranty repair attempt is believed to have
occurred on or before July 3, 1995, when the vehicle's odometer
showed 1,463 miles. On that date, a repair attempt was made to
remedy a defective ignition key. Also on that date, repairs were
made to the defective front grill emblem that had fallen off, and
also the passenger door rocker molding. A true and correct copy
of the repair history is attached hereto, made a part hereof and
marked Exhibit "B."
19. The second warranty repair attempt is believed to have
occurred on or before October 30, 1995, when the vehicle's
odometer showed 9,176 miles according to the repair invoice. On
that date, a repair attempt was made to remedy the defective fuel
pump. A true and correct copy of the repair invoice is attached
hereto, made a part hereof and marked Exhibit "C."
20. The third warranty repair attempt is believed to have
occurred on or before December 11, 1995, when the vehicle's
odometer showed 11,194 miles according to the repair invoice. On
that date, repair attempts were made to remedy the defective
speedometer light. Also on that date, repair attempts were made
to remedy a defective left front door lock, and a noise while in
reverse. A true and correct copy of the repair invoice is
attached hereto, made a part hereof and marked Exhi hi t "D."

21. The fourth warranty repair attempt is believed to have
occurred on or before January 29, 1996, when the vehicle's
odometer showed 14,179 miles according to the repair invoice. On
that date, repair attempts were again made to remedy electrical
problems. These problems included dim headlights, flickering
dash lights, and a malfunctioning radio display. Also on that
date, repair attempts were made to the transmission which would
pop out of reverse and third gear. Also on that date, repair
attempts were made to remedy the rearview mirror, the driver's
seatbelt, and the rear ashtray.
A true and correct copy of the
repair invoice is attached hereto, made a part hereof and marked
Exhibit "E."
22. The fifth warranty repair attempt is believed to have
occurred on or before February 26, 1996, when the vehicle's
odometer showed 15,642 miles according to the repair invoice. On
that date, repair attempts were again made to remedy defective
dash lights. Also on that date, repair attempts were made to
remedy a noise in the clutch, and an illuminated brake light.

23. The sixth warranty repair attempt is believed to have
occurred on or before March 18. 1996, when the vehicle'S odometer
showed 16,718 miles according to the repair invoice. On that
date, repair attempts were again made to remedy a fluttering
speedometer and tachometer, and a disappearing radio display.

Also on that date, repair attempts were again made to remedy a
clutch problem and an illuminated brake light. Also on that
date, repair attempts were made to remedy defective brakes, and
defective power windows. A true and correct copy of the repair
invoice is attached hereto, made a part hereof and marked Exhibit
"G..1l
24. The seventh warranty repair attempt is believed to have
occurred on or about July 22, 1996, when the vehicle's odometer
showed 22,566 miles. On that date, repair attempts were made to
adjust the driver's door which dropped, a cracked passenger seat
arm, a broken seatbelt clip, a broken relay and a noisy sunroof.
Also on that date, repair attempts were again made to remedy a
defective radio. Also on that date, repair attempts were made to
remedy a noise in the rear passenger side, and an illuminated
check engine light. A true and correct copy of the repair
invoice is attached hereto, made a part hereof and marked Exhibit
"H."
25. The eighth warranty repair attempt is believed to have
occurred on or about August 5, 1996, when the vehicle's odometer
showed 23,826 miles. On that date, a repair attempt was again
made to remedy the defective radio. Also on that date, a repair
attempt was made to remedy the left front door lock. A true and
correct copy of the repair invoice is attached hereto, made a
part hereof and marked Exhibit "I."
26. The ninth warranty repair attempt is believed to have

occurred on or about December 5, 1996, when the vehicle's
odometer showed 33,973 miles. On this date, a repair attempt was
made to again remedy the defective speedometer and tachometer.
On this date, the instrument cluster was replaced, as was the
speedometer sensor. Also on this date, an air pump hose and a
heater switch were replaced. Also on this date, repair attempts
were made to remedy a left front window problem, a stereo problem
and a clutch problem. A true and correct copy of the repair
invoice is attached hereto, made a part hereof and marked Exhibit
IlJ.1l
27. The tenth warranty repair attempt is believed to have
occurred on or about May 12, 1997, when the vehicle's odometer
showed 45,753 miles. On this date, a repair attempt was made to
remedy a defective left front fog light. A true and correct copy
of the repair invoice is attached hereto, made a part hereof and
marked Exhibit "K."
28. The eleventh warranty repair attempt is believed to
have occurred on or about December 12, 1997, when the vehicle's
odometer showed 54,730 miles. On this date, a repair attempt was
made to remedy a loose exhaust. Also on that date, the left
front fog light was out again. A true and correct copy of the
repair invoice is attached hereto, made a part hereof and marked
Exhibit "L."
29. The twelfth warranty repair attempt is believed to have
occurred on or about January 8, 1998, when the vehicle's odometer

showed 55,777 miles. On this date, a repair attempt was again
made to remedy a problem whereby the car was not idli.ng and
eventually would shut off. A true and correct copy of the repair
invoice is attached hereto, made a part hereof and marked Exhibit
11M. II
30. The thirteenth warranty repair attempt is believed to
have occurred on or about July 27, 1998, when the vehicle's
odometer showed 60,927 miles. On this da.te, a repair attempt was
again made to remedy a electrical problem whereby the electric
windows and mirrors did not work and a blown fuse was replaced.
Also on that date, a repair attempt was made to remedy a
"chirping" noise eminating from the front of the car and the
front engine mount was tightened. A true and correct copy of the
repair invoice is attached hereto, made a part hereof and marked
Exhibit "N."
31. The fourteenth repair attempt is believed to ~ave
occurred on or about August 24, 1998, when the vehicle's odometer
showed 61,726 miles. On that date, a repair attempt was again
made to remedy a window and door handle which would not work.
They also performed some body work. A true and correct copy of
the repair invoice is attached hereto, made a part hereof and
marked Exhibit "0."
32. A fifteenth repair attempt is believed to have occurred
on or about September 4, 1998. The vehicle was delivered to
Autohaus Harrisburg, Inc. with complaints that the right rear

seatbelt was jammed and also that the left front window was again
inoperable. A true and correct copy of the repair invoice is
attached hereto, made a part hereof and marked Exhibi t "P."
33. The sixteenth repair attempt is believed to have
occurred on or about September 10, 1998, when the vehicle's
odometer showed 62,495 miles. On that date, a repair attempt was
made to the rear seat belt. A true and correct copy of the
repair invoice is attached hereto, made a part hereof and marked
Exhibit "Q."
34. The seventeenth repair attempt is believed to have
occurred on or about October 15, 1998, when the vehicle's
odometer showed 64,988 miles. On that date, a repair attempt was
made to repair a heater control light which was inoperable. Also
on that date, repair attempts were made to remedy a problem with
the driver's side and passenger windows which were inoperable.
On that date, a repair attempt was also made to remedy a
transmission problem wherein the car would pop out of reverse.
Finally, on that date, a repair attempt was made to reinstall the
seatbelt assembly, which was installed a month earlier, because
it had been put in backwards. A true and correct copy of the
repair invoice is attached hereto, made a part hereof and marked
Exhibit "1<.."
35. In addition, Plaintiff avers the vehicle has been
subject to additional repair attempts for defects and/or non-
conformities and/or conditions for which the dealer did not
