ORDER OF COURT
AND NOW, this 22nd day of December, 1998, upon
consideration of the Commonwealth's petition for a preliminary
injunction, and following a proceeding at which the Defendant,
Joseph Louis Camino, indicated that he was eating again and
intended to continue to take nourishment and that he would not
object to an order of court providing that in the event that he
ceased to take nourishment the Commonwealth would be permitted
to involuntarily administer medical treatment, including but not
limited to nutrition and hydration, to him, and the Commonwealth
having indicated that it would be satisfied with that order, it
is ordered, adjudged and decreed that in the event that the
Defendant, Joseph Louis Camino, fails to continue to take
nourishment and that medical personnel at the Camp Hill Sta.te
Correctional Institution deem it necessary, the Defendant may be
involuntarily administered medical treatment, including but
not limited to nutrition and hydration, as may be medically
necessary to preserve his health and life in the opinion of the
physician without further order of court.

AND NOW, this 16th day of December, 1998, comes the Plaintiff, Commonwealth of
Pennsylvania, Department of Corrcctions, State Correctional Institution at CAMP HILL and
avers the following in support of this Complaint:
I, This action is brought in the Court's original jurisdiction.
2, Plaintiff is thc Commonwealth of Pcnnsylvania. Dcpartment of Corrections, State
Correctional Institution at Camp Hill,
3, Plaintiff is an executive agency of the Commonwealth of Pennsylvania
responsible for administrating the statc correctional systcm including the Statc Corrcctional
Institution at Camp Hill.
4, Dcfcndant Joscph Louis Camino is an inmate prcsently incarccratcd at the State
Correctional Institution at Camp Hill,
5. Since Dcccmber 5. 1998. save for one meal on Decembcr 9. Mr. Camino has
refused and continues to refuse food,

Since December 5. 1995. Mr. Camino has missed thirty-four (34) meals, Between
September 21. 1995 and December 16. 19<JS his wdght declined Irom 113 to 101 pounds,
7. The above-mentioned behavior and weight loss places this inmate at a great risk
for his health; specifically. infections and heart and kidney prohlems in the next 24 to 48 hours.
8, It is the opinion of Dr. Young that Mr. Camino is an imminent danger of the loss
of life or other irreparable harm unless mediealtreatmenl. including nutrition and hydration. is
administered immediately, (See Affidavit of Dr, Young attached hereto as Exhibit A and made a
part hereol). Mr. Camino may die or suffer other immediate and severe irreparable harm if
medical treatment, including nutrition and hydration. is not administered to him as soon as
possible.
9. It is impossible to predict the exact point at which Mr. Camino's condition may
result in immediate, severe and irreparable harm; therefore. immediate intervention is necessary,
10. Permitting Mr. Camino to engage in a suicidal act by refusing nutrition and
hydration will cause a significant disruption to the orderly administration of the State
Correctional Institution at Camp Hill. The effects of his death would demoralize the staff and
instill the belief in the inmate population that the prison administration caused and permitted Mr.
Camino's death, This will lead to animosity toward the staff and undermine confidence in prison
authority,
WHEREFORE. based on the foregoing. the Commonwealth of Pennsylvania,
Depal1111ent of Corrections. State Correctional Institution at Camp Hill. request this Court to
enter an Order:

THE COURT: This is the time and place for a
2 hearing on a request for a preliminary injunction. The
3 request has been filed by the Commonwealth of pennsylvania,
4 Department of Corrections, State Correctional Institution at
5 Camp Hill. We will let the record indicate that the
6 plaintiff is present through various representatives and is
7 represented today by Steven Brian Loux, Esquire. The
8 Defendant is also present in court and is representing
9 himself. Mr. Loux?

MR. L,OUX: Good afternoon, Your Honor. I'm
11 here from the Department of Corrections. We're here before
12 you seeking an injunction of an extraordinary nature, to
13 obtain an order' from this court enabling the Department of
14 Corrections and the staff at Camp Hill, the state prison, to
15 involuntarily examine and, if necessary, perform invasive
16 diagnostic tests in the nutrition and hydration of the
17 Defendant in this case, Joseph Louis camino.
18 This is not an issue to take lightly, Your
19 Honor. This case is a dangerous situation that requires
20 extraordinary measures. Vle will have testimony today from
21 two people, Mr. William Ward, the manager of the Special
22 Management Unit, that is, the SMU, where Mr. Camino is
23 housed as an inmate, He will testify as to the impact that
24 a hunger strike has upon security within the prison and the
25 management of the SMU. We will explain to you that the SMU

holds the most aggressive prisoners within the corrections
institution; and that, because of the very nature of that
unit, the type of behavior in which Mr. Camino is engaging
is of paramount danger to the maintenance of discipline and
security within the prison and within that unit.
We will have the testimony of the physician,
Dr. William Young, who has tended Mr. Camino during his
hunger strike. Dr. Young will explain the very harmful
health implications to which Mr. Camino is subjecting
himself by engaging in hunger strikes and the very real and
present risk that he could suffer serious physical injury
and/or death should he engage in a future hunger strike.
It's because of these unique circumstances
that we feel compelled to appear before you today seeking
this order. We want to prevent the dire consequences that
Mr. Camino's behavior could have on him or other prisoners
within the facility. Thank you.
THE COURT; Mr. Camino, is there anything you
would like to say before we start the hearing?
THE DEFENDANT; Yes, there is. Ever since
I've been classified in this SMU program, Your Honor, I have
not had nothing but problems with correctional officers.
Two weeks after my arrival at SeI-Camp Hill, I was assaulted
by correctional officers in a small vestibule, Ever since
that point, I've been having problems with my food.

1 they had coming to me, right, I had to have food or
2 substances put down my stomach just so I can eat my food.
3 They was throwing my food on the floor. They spit in it,
4 tampered with it, balled my food up in their hands and
5 handed it to you. I have grievances in, but I never got any
6 initial reviews on them. As far as I'm concerned, this
7
program that they have me in, I don't belong there.
I
8 should be released to the general population or somewhere
9 else. I don't deserve all of the punishment that they put
10 onto me for things that I didn't do.

THE COURT: Do I understand that you are
12 eating again?

THE DEFENDANT: Yes.

THE COURT: At least at this point you don't
15 intend to stop eating?

THE DEFENDANT: No, I don't, not unless I
17 have problems with my food again.

THE COURT: Would you have any objection to
19 having an order which says that in the event that you would
20 stop eating again that then the food could be administered,
21 but that prior to that time it wouldn't be forced on you?

THE DEFENDANT: If that should come, I'm sure
23 I'd be here again.

THE COURT: If you have no objection to an
25 order of that sort, I would assume that would be agreeable
