A complaint was filed against Petitioner (Defendant) on June 16, 1998 in the court of District Justice Robert Manlove regarding money allegedly owed to Plaintiff. 2. Prior to the date of the hearing, Petitioner requested a continuance of the case due to illness of Petitioner and was told that the continuance was granted. 3. Petitioner did not receive notice of a date for a new hearing, 4. That Judgement was entered against petitioner in the court of District Justice Robert Manlove on August 27, 1998. Pctitioncr was prcventcd from Icarning of the entry of the Judgment and filing a timely appeal by reason oCthe negligent conduct oflhc mail delivery pcrson assigned to his residence, 6, Petitioner moved his residence 10 5922 Linglestown Road (Rcar) on June 27, 1998, 7, Whcn Pctitioner moved the address oflhe residence was changed from 5922 Linglestown Road to 5922 Linglestown Road (Rcar) and a mailbox was placed on the grounds oCthe premises 8, Aller thc changc in address, mail was not rcgularly delivcred to the mailbox due to misundcrstanding on the part of the delivery person as to the exaet address that the mailbox rcprcscnted, As a result somc mail was hcld in the Post Officc without knowledgc of Petitioner. 8, Petitioncr met with the Postmaster who concurrcd on the addrcss and thc placement of thc mailbox and from then on the mail was correctly delivered, 9. On or about October 2, 1998, Pctitioncr inquired as to status of thc case and was informed that the Default Judgment had been entered, 10. On or about October 6, 1998, Petitioner received a copy of the Default Judgment notice, ] ]. Further investigation by Petitioner revealed that the original notice of the Default Judgment was in fact in the Post Office unknown to Petitioner, 12. Petitioner, believing he had no recourse since he missed the date for a timely appeal, did not act until learning that there was a procedure to appeal nunc pro tunc.. Plaintiff and Petitioner (Defendant) entered into an agreement whereby Petitioner would pay commission to PlaintilTifthe PlaintilTsecures a buyer or a tenant for property located at 5922 Linglestown Road, Harrisburg, PA ]7112. 13, On or about December 16, 1996, Petitioner entered into an agreement for the sale of said commercial real estate with third party tenant (hereinafter referred to as "tenant") which was prepared by Plaintift' as agent for the Petitioner. Copy attached as Exhibit 1. 14, On or about December 16, 1996, Petitioner entered into a Pre-Settlement Lease Agrecment with tcnant which provided for the property to bc rented under the tenns of said Agrecment, A copy is attached as Exhibit 2. 15. A security deposit in the sum ofTen Thousand Dollars ($]0,000,00) was to be held in escrow for the Petitioner. Security deposit would be property of Petitioner if the sale was not consummated. 16. A copy is attached as Exhibit 3. 19. Tenant provided a personal check to Petitioner in the sum of One Thousand Five Hundred Dollars ($1500.00) which was not honored by the bank because it was drawn on a closed account. A copy is attached as Exhibit 4. 20.Tenant caused damages to the property and expenses to Petitioner during the occupation of the property including damage to the hardwood floors, walls and windows in the sum of$2,500.00. 21. Due to the Plaintiff's not allov,ing the reeission of the Agreement between Petitioner and tenant, Petitioner suffered economic damages in the amount of Thirteen Thousand Dollars ($13,000.00) which represents a sum greater than the Default Judgment against Petitioner. 22, Petitioner avers that the amount of the Judgment is miscalculated and should be less. Despite numerous demands 1'01' payment, Dclcndant failed and refused to pay the commissions owed to Plaintiff. As such, Plaintirr liled the aforementioned complaints and dcmandedjudgment in the amount oflhc unpaid commissions (at a ratc of6%) plus interest to the date of filing. On August 27, 1998, default judgments werc entered in ravor of PlaintilTin thc amounts demanded plus costs or suit. Defcndant did not llIe an appeal within the thirty (30) day appeal period. On or about December \ Cl, 1998, Plainti iT entered both j udgl11ents in the Court or Common Plcas of Dauphin County, Pennsylvania. 2. Denied. Upon infonllation and believe, Plaintiff denies Defendant's al'erment that a continuance was granted 1'01' either/both hcarings. Plaintifl's counscl contacted District Justicc Manlove's oflice and spoke with Bobbi R. Sullil'an regarding this matter. It is the strict policy or District Justice Manlol'c that no continuances arc granted unless requcsted in writing. Thcre is no record of a writtcn request for a continuancc by Dekndant. Moreol'er, there is no indication in thc oflice notes 1'01' either casc that ;\ continuance was requested or granted. 3. Admitted. By way of further responsc, Ddendant did not receiv,", notice of a ncw hcaring date beeausc no continuance was granted and no "new" hearing date was schcdukd. 4. Admitted. By way ol'furlher response, as explaincd in detail in paragraph I above, Plaintiff filed two (2) complaints and two (2) default judgments were entered on August 27,1998. 5. om 12. Denied. Nowhere in the listing agreement or in any other agreement between the parties is Defendant obligated to Ieasc the property. The decision to lease the property and/or rcscind the Ieasc agreement (assuming there were legal grounds to do so) was cnlirely that of Delcndant. Finally, if Defemlant had rescinded said lease agreement, he could have disputed and litigated the question as to whether he owed Plaintiff a commission bascd on the gross rental for the term of the lease. 17.
