THIS AGREEMENT made the 4tfl day of December, 1998, by and between
SHUGHART CUSTOM HOMES, INC., hereinafter referred to as Contractor, and
RICHARD D. SHUGHART, hereinafter referred to as Owner, whereby the former
undertakes and agrees to erect and construct a single family dwelling on:
ALL THAT CERTAIN tract of land situate in Dickinson Township,
Cumberland County, Pennsylvania, bounded and described as follows:
BEGINNING at a point on the southern right-of-way line of Seneca Circle
and the northwest corner of Lot No. 97 on the hereinafter described plan; thence along
said Lot No. 97 on the hereinafter described plan, South 13 degrees 18 minutes 43
seconds East 268.76 feet to a point; thence along line of lands now or formerly of Robert
J, Lewis and Jeanette C. Lewis, South 63 degrees 59 minutes 21 seconds West 143,79
feet to a point; thence along lands now or formerly of Michael L, Bixler and Michele Bixler,
North 38 degrees 15 minutes 10 seconds West 271,91 feet to a point; thence along Lot
No. 95 on the hereinafter described plan, North 61 degrees 27 minutes 10 seconds East
152,90 feet to a point; thence along the right-of-way line of Seneca Circle along a line
curving to the left having a radius of 50.00 feet and an arc length of 131,10 feet to a point;
thence continuing along the right-of-way line of Seneca Circle along a line curving to the
right having a radius of 20,00 feet and an arc length of 17.45 feet to a point, the place of
BEGINNING.
CONTAINING 51,251 square feet and being Lot No. 96 on Final
Subdivision Plan for Phase Number Two of Callapatscink, which is recorded in the Office
of the Recorder of Deeds for Cumberland County in Plan Book 74, Page 141.
UNDER AND SUBJECT to building and use restrictions recorded in the
Office of the Recorder of Deeds in and for Cumberland County, in Miscellaneous Book
486, Page 1074.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for and in consideration of the sum of One and 00/100 ($1.00) Dollar to them
in hand paid by Owner, the receipt whereof is hereby acknowledged, and the further
consideration mentioned in the agreement aforesaid, for themselves and their
subcontractors, and all parties acting through or under them, covenant and agree that no
mechanic's liens or claims thereto for or on account of any work done or materials
furnished by them or any of them under said contract or otherwise, for, towards, in, or
about the erection and construction of the said buildings on the lot above described, and
the said Contractor, for themselves. their subcontractors and others under them hereby
expressly waive and relinquish the right to have, file and maintain any mechanic's liens or
claims against the said buildings or any of them, and agree that this instrument, waiving
the right of lien, shall be an independent covenant.
