WHEREAS, Clair L. Prosser, Jr" and Lynn F. Prosser, his wife, of 43 Limekiln Road,
Carlisle, Cumberland County, Pennsylvania 17013, have executed a contract with Roger
Shover Construction, of 106 Willis Road, l\I p",,,i lip. , Cumberland County, Pennsylvania 17241,
for the erection of a residential dwelling upol) a tract of land situate in West Pennsboro
Township, Cumberland County, Pennsylvania, more particularly described in the deed of Albert
C, Kuhn and Edith 8, Kuhn, his wife, to Clair L. Prosser, Jr" and Lynn F, Prosser, his wife,
dated June 19, 199B, and recorded in the Office of the Recorder of Deeds for Cumberland
County, Pennsylvania in Deed Book 'lBO, Page 81, and being Lot 16, Greystone Acres (Plan
Book 72, Page 70), located on pennway Drive, Carlisle, Pennsylvania (Tax Parcel No, 46 - 09
- 0523 - 016),

NOW, October/97~99B, at the time of and immediately before the execution of the
principal contract, and before any authority has been given by the said Owners to the said
Contractor to commence work on said building, or to purchase materials for the same in
consideration of the making of the said contract with the said Contractor and the further
consideration of the sum of One and no/100 ($1,00) Dollar to Contractor paid by said Owners,
it is agreed that no lien shall be filed against the building by the contractor, or any
subcontractor, nor by any of the material men or workmen or any other person for any labor or
materials purchased or extra labor or materials purchased for the erection of said building, the
right to file such liens being expressly waived,
WITNESS our hands and seals the day and year aforesaid.
