AND NOW. comes the Plaintiff Nathaniel J. Patterson, by and through his
attorneys, Caldwell & Kearns, and has filcd the following Complaint for Conression
of Judgmcnt 1'01' Money pursuant to Pa.R.C.P. 2952 and states in support thereof as
follows, to wit:
I. Plaintiff Nathaniel .J. Patterson is an adult individual who presently
residcs at 3 Brandy Circle, Camp Hill, Cumberland County, Pennsylvania, 170 II.
2. Defendant TCITY E. Freeman is an adult individual whose last known
address is 41 North Walnut Street, Mechanicsburg, Cumberland County,
Pennsylvania, 17055.
3. In conjunction with a busincss loan and not in conjunction with any
consumer credit transaction, for good and valuable considcration, Defendant Tcrry
E. Frceman did execute and delivcr to Plaintiff Nathaniel J. Patterson a certain
Judgment Promissory Notc with Disclosure Statement, on or about March I, 1995 in
the principal amount of $8.475.00. ^ true and correct copy of said Judgment
Promissory Note with Disclosure Statement is attached hereto, marked Exhibit "A"
and madc a part hereof by reference thereto.
4, The said Defendant Terry E. Freeman has 1:1iled and/or refused to pay
said sum. or any portion thereof

Note in this or in any other jurisdiction,
7. The obligation hereinbefore identilied, as previously stated, was
obtained by Defendant for exclusively business purpose.
8. The Defendant is not a member of the armed forces of the United States
or its allies.
9. Demand is made for reasonable attorneys fees 01'$847.50 as provided
in the Judgment Promissory Note.
WHEREFORE, Plaintiff Nathaniel J. Patterson, demands judgment against
Defendant Terry E. Freeman, in the amount 01'$11 ,737.87 plus interest accruing after
December I, 1998, plus costs of suit.

the sum of Eight Thousand Four Hundred Seventy-Five ($8,475.00) DOLLARS, without
of.fset, for value received. both prior to the entry of judgment on this instrument and
following entry of judgment on this instrument and continuing until such time as all
sums due hereunder have been paid in full.
AND FURTHER, the undersigned do hereby authorize and empower any attorney of any

The undersigned, TERRY FREEMAN, having read this document in its entirety, and
fully understanding it, hereby states, admits, acknowledges, and certifies the
following:
1. I have, this day, signed a Judgment Promissory Note in which I promise to pay
to NATHAN PATTERSON the sum of EIGHT THOUSAND FOUR HUNDRED SEVENTY-FIVE ($8,475.00)
DOLLARS.
2. The said jUdgment note qi ves the persons who hold or own the note the right to
file and enter jUdgment against me without any prior notice to me and without any right
of formal pleading, notice, or hearjnq for me before the entry of said judgment.
3. Such a judgment entered against me will automatically create a lien on all
real estate owned by me at that time, whether I own it now or acquire it later.
4. Such a judgment entered against me will entitle the person who owns or holds
such a judglllent to issue,' execution against my property which can result in the Sheriff
physically attaching or taking possession of said property and selling it at a
Sheriff's Sale.
5. That I will be compelled and required to hire an attorney to file formal
documents to open or strike such a judgment if I have a valid defense to the action
taken against me, and without those documents being filed, I will not have a right to a
hearing or trial on such jUdgment matter.
6. That I have an income, either myself or together with any other persons who
signed the note with me, whicb is at least $10,000.00 per year.

Defendant, TERRY E. FREEl\IAN, by bis undersigned counsel, pursuant to
Pa. R.C.P. 2959 respectfully petitions this Court to open the confessed judgment
and in support thereof states the following:
1. Plaintiff, NATHANIEL .J. PATTERSON. filed a Complaint for Confession
of ,Judgment pursuant to Pa. RC.P. 2952 with tll(> Prothonotary on
December 21, 1998 to cuter judgment by confession against defendant
based upon a March 1, 1995 note executed in favor of plaintiff by the
defendant. True and correct copies of the Complaint, Confession and notl'
are attached as l~xhibits "X', "B" and "C" respectivel~'.

5, Plaintiff demanded that defendant sign t.he note to secure plaintiff's
personal loans to the said corporation which exceeded defendant's
contributions,
G. Plaintiff threatened to abandon Liw corporate enterprise unless defendant
would, on that day, sign the note.
7. Defendant understood that as plaintiff's loans were repaid by the
corporation, defendant's personal note would be satisfied. Plaintiff's loans
to the corporation in the amount of the note have been satisfied by the
corporation, yet plaintiff. in confessing judgment, made no reduction or
credit for amounts he had already received.
8, No consideration for the note was provided by plaintiff to defendant.
WHEREFORE, defendant. Terry Freeman, respectfully requests that the
Court enter a rule upon plaintiff, Nathaniel Patterson, to show cause why the
judgment by confession of December 21,1098 should not be opened.

of Judgment for Money pursuant to Pa,R.C.P. 2952 and states in support thereof as

l. Plaintiff Nathaniel J. Patterson is an adult individual who presently
resides.at 3 Brandy Circle, Camp Hill, Cumberland County, Pennsylvania, 17011,
2. Dcfendant Terry E, Freeman is an adult individual whose last known

consumer credit transaction, for good and valuable consideration, Defendant Terry
E. Freeman did execute and deliver to Plaintiff Nathaniel J, Patterson a certain
Judgment Promissory Note with Disclosure Statement, on or about March I, 1995 in
the principal amount of $8,475.00, A true and correct copy of said Judgment

6. Judgment has not hereinbefore been entered on the Judgment Promissory
Note in this or in any other jurisdiction,
7. The obligation hereinbefore identified, as previously stated, was
obtained by Defendant for exclusively business purpose.
8. The Defendant is not a member orthe armed forces of the United States
or its allies,
9. Demand is made for reasonable attomeys fees of $847,50 as provided
in the Judgment Promissory Note,

1. I have, this day, signed a Judgment Promissory Note in which I promise to pay
to IIATHAN PATTERSON the sum of EIGHT THOUSAND FOUR HUNDRED SEVENTY-FIVE ($8,475.00)

2. The said judgment note gives the persons who hold or own the note the right to
file and enter judgment against me without any prior notice to me and without any right

personal loans to the said corporation which exceeded defendant's
contributions.
6, Plaintiff threatened to abandon the corporate enterprise unless defendant

7. Defendant understood t.hat as plaintiff's loans were repaid by the
corporat.ion, defendant's personal note would be satisfied, Plaintiff's loans
to the corporation in the amount of the note have been satisfied by the
corporation, yet plaintiff, in confessing judgment, made no reduction 01'
credit for amounts he had already received.
8. No consideration for the note was provided by plaintiff to defendant.

Defendant, TERRY E, FREEMAN, by his undersigned counsel, pursuant to
Pa. R.C,P. 295fJ respectfully petitions this Court to open the confessed judgment
and in support thereof states the following:
1. Plaintiff, NATHANIEL J. PATTERSON, filed a Complaint for Confession
of Judgment pursuant to Pa. R.C.P. 2952 with the Prothonotary on
Dece;llber 21, 19fJ8 to enter judgment by confession against defendant
based upon a !\larch 1, 1~)95 note executed in favor of plaintiff by the
defendant. True and correct copies of the Complaint, Confession and note
are attached as Exhibits "/\.", "13" and "C" respectively.
2. The underlying judgment promissory note contains no rate of interest to
Ill' charged nor does it se( f~l1"t h the date from which interest would be
comput.ed. Plaintiff's Confes"ion and Complaint sought interest from the
date of the note and applied the rate of six (6%) percent none of which was
agreed to be defendant and in contravention of 13 Pa. C.S./\.. 93112(a).
:3. Despite plaintiff's allegation, no demancl for payment of the note was ever
made prior to the filing of tIll' Complaint for Confession and the
Confession.

Defendant, TERRY E. FREEMAN, by his undersigned cOllnsl'l, pUl'suant to
Pa, R.C,P. 2959 respectfully petitions this Court to open the confessed judgment
and in support thereof states the following:
L Plaintiff, NATHANIEL J. PATTERSON, filed a Complaint for Confession
of Judgment pursuant to Pa, R.C,P. 2952 with the Prothonotary on
December 21, I~J98 to enter judgment by confession against defenclant
based upon a IVlarch 1, 1995 note executed in favor of plaintiff by the
clefendant. True and correct copies of the Complaint, Confession and note
are attached as Exhibits "A", "B" and "C" respectively.
2, The under!~.ing judgment promissory note contains no rate of interest to
be charged nor does it set f(ll,th the date from which interest would be
computed. Plaintiff's Confl'ssion and Complaint sought interest from the
date of the note and applied the rate of six (G'X,) percent none of which was
agreed to be defendant and in contravention of 1:3 Pa. C.S.1\. ~:3112(a).
:3. Despite plaintiff's allegation, no demand for payment of the note was ever
made prior to the filing of the Complaint for Confession and the
Confession.

AND NOW, comes the Plaintiff Nathaniel J. Patterson, by and through his
attorneys, Caldwell & Kearns, and has filed the following Complaint for Confession
of Judgment for Money pursuant to Pa.R,C,P, 2952 and states in support thereof as
follows, to wit:
I. Plaintiff Nathaniel J. Patterson is an adult individual who presently
resides.at 3 Brandy Circle, Camp Hill, Cumberland County, Pennsylvania, l701l.
2. Defendant Terry E. Freeman is an adult individual whose last known
address tS 41 North Walnut Street, Mechanicsburg, Cumberland County,
Pennsylvania, 17055.
3. In conjunction with a business loan and not in conjunction with any
consumer credit transaction, for good and valuable consideration, Defendant Terry
E, Freeman did execute and deliver to Plaintiff Nathaniel J. Patterson a certain
Judgment Promissory Note with Disclosure Statement, on or about March I, 1995 in
the principal amount of SS,475,OO. A true and cOtTect copy of said Judgment
Promissory Note with Disclosure Statement is attached hereto, marked Exhibit "A"

fully understanding it, hereby states, admits, aCknowledges, and certifies the
folloving:
1. I have, this day, signed a Judgment Promissory Note in which I promise to pay
to NATHAN PATTERSON the sum of EIGHT THOUSAND FOUR HUI~RED SEVENTY-FIVE ($8,475.00)
DOLLARS.
2. The said judgment note gives the persons who hold or own the note the right to
file and enter judgment against me without any prior notice to me and without any right
of formal pleading, notice. or hearing for me before the entry of said judgment.
3. Such a judgment entered against me will automatically create a lien on all
real estate owned by me at that time, whether I own it now or acquire it later.
4. Such a judgment entered against me will entitle the person who owns or holds '
such a jUdgment to issue.'execution against my property which can result in the Sheriff
physically attaching or taking possession of said property and selling it at a
Sheriff's Sale.
5. That I will be compelled and required to hire an attorney to file formal
documents to open or strike such a jUdgment if I have a valid defense to the action
taken against me, and without those documents being filed, I will not have a right to a
hearing or trial on such judgment matter.
6. That I have an income, either myself or together with any other persons who
