thc subjcct of this action.
3. Thc Dcfcndant. thc Unitcd Statcs of Amcrica. is named a party Dcfcndant to this action
pursuant to thc Act of June 25, 1948. C.646.62 Statutc 972, as amcnded. (28 U.S.c. 2410). by reason ofthc
fact that the United States of Amcrica tilcd a judgmcnt with thc Prothonotary's Office of Cumbcrland
County at No. 98-1077. on February 25, 1998. in thc amount of $73.252.75. Said judgmcnts, licns and/or
fcdcral tax licns of said judgmcnts arc infcrior in timc to thc licn of the mortgaged f'oreclosed upon hercin.
4. On the 22nd day of April. 1997. in consideration of a loan of Three I lundred Sevcnty-Five
Thousand and No/l 00 ($375,000.00) Dollars made hy GreenPoint Mortgage Corporation. a NY corporation.
to Defcndant(s), the said Dcfendant(s) executed and delivered to Greenl'oint Mortgage Corporation. a NY

8. In accordance with the appropriate Pennsylvania Acts of Assembly and the Pcnnsylvania
Rules of Civil Procedure. the mOl'tgagor(s) has been adviscd in writing of the mortgagees intcntion to
fareclose. The appropriate time period hus elapsed since the Notice of Intention to Forcclosc has been
ser\'ed upon the mortgugor(s).

of a judgment in favor of the Plaintiff.
4. That the Defendant, United States of America, is not indebted to the Plaintiff.
5. That the aforesaid premises shall be sold at a judicial sale, notice of which shall
be served on the Defendant, United States of America.

hereby objects to the Plaintiffs Complaint and avers in support as follows:
I. Preliminaty Obiection in the Nature of a Demurrer
I. Jan A. Osterlund is set forth in the Caplionto the Complaint as required under
Pa.R.C.P. No. 1018; however. the Complaint itself fails to identify Jan A. Osterlund as a
Defendant.
2. There are no allegations in the Complaint pertaining to Jan A. Osterlund.
3. Under Pa.R.C.P. No. 1028(a)(4). a pal1y may preliminarily object to the legal
insufficiency of a pleading.
4. Because the Complaint fails 10 identity Jan A. Osterlund as a defendant. the Complaint
is defective under Pa.R.CI' No. I028(a)(4)

6. Jan A. Osterlund is set forth in the Caption to the Complaint as required under
l'a.R.C.P. No. 1018; however. the Complaint itselffai\s to identify Jan A. Osterlund as a
Defendant.
7.l'a.R.C.P. 1147 states in part that. "The plaintiff shall set forth in the complaint:

Kathy Smee Hirsch for Greenpoint Mortgage Corporation for the sum of $ 1.00. It being
the highest bid and best price quoted for the same Greenpoint Mortgage Corporation of
P.O. Box 8708. Columbus Ohio being the buyer in this execution paid to SheriffR.
