1. This Court has jurisdiction over tbe parties of this matter as a result of tbe Notice of
Appeal from District Justice Judgment, Common Pleas No. 98-7196 Civil Term,
dated December 22, 1998.
II. .PARTIES
2. Tbe Plaintiff is Donna Hay (bereinafter referred to as "Plaintifr'), 3436 Bedford
Drive, Camp Hill, PA 17011.
3. The Defendant is Free Flow (hereinafter referred to as "Defendant"), 486
Lewisberry Road, New Cumherland, P A 17070. The Defendant is a plumbing
business owned and operated by Dan Meyer.
III. FACTS
4. On or about November 17, 1996, Plaintiff lelephoned Free Flow and requested
,"",ice. of the Defendant due to a clogged sewer line that resulted in a sewer back
up in the basement .hower,
S. On Novemher 17, 1996, Ste,'e, a representative from Free Flow responded to 3436
Bedford Dri,'e, Camp Hill in response 10 the telephone call made by Plaintiff.
6, Steve was unable 10 open tbe entire sewer line, but was able 10 open 4' ofth. ....er
line from the house with the routing equipment.

Wilson, Inc. responded to 3436 lIedford IIrlve, Comp Hill, PA to repair olle!:ed
hroken sewer pipe.
12. On Novemher 25,1996, ..eovatlon wos performed hy Rick HolTmon Pavinll and
E.eavating which involved removing two bushes ond e.po.ing the areo of the
alleged broken sewer pipe.
13, On November 25,1996, once the sewer pipe was e.posed, George W. Wilson, Inc.
cheeked and advised that there was no sewer pipe break.
14. On November 25,1996, PlaintilT contacted tbe Defendant 10 return 10 3436 lIeMord
Drive, Camp Hill, I' A to eontinu. routing the line that was not broken,
15. On November 25, 1996, Conrad, a repr..entath'e from Free Flow responded to open
the clogged sewer pipe, Conrad opened the clogged .ewer pipe through the house
vent. There was a house IraI' on this properly.
16. After the sewer pipe was cleared, Rick HolTmon Paving and Excavating filled In Ihe
dirt oround Ihe e.eavation site.

On February 27,1997, Beacon Hm Nursery provided PlaintilTwith a written quole
of prices to replace the bushes and lawn that were d..troyed during the excavation.

On October 29, 1998, PlaintilT contacted Defendant by mail requesting
reimbursement of unnecessary expenses and requesting a written response by
November 9, 1998.

On November 13, 1998, a Civil Complaint was filed with District Justice Thomas A.
Placey, 104 S. Sporting Hill Road, Mechaniesburg, PA 17055, Docket No. CV-
0000588-98.
