TI-IIS AGREEMENT, made this 19th day of August, 1999, by and between Kathryn W. Semuta,
hereinafter referred to as "Wife", and Nicholas J. Semu13, hereinafter referred to as "Husband",
WITNESSETH:
WHEREAS, Husband and \viJi: were lawfully married on November 2, ]996 in Camp Hill,
Cumberland County, Pennsylvania and separated on November 5, !998; and
WHEREAS, certain differences have arisen between the parties as a result of which they have
separated and now live separate and apart from one another, and are desirous of settling fully and finally
their respective financial and property nghts and obligations as between each other, including. without
limitation by specification: the settling of all matters between them relating to the past. present and
future support and/or maintenance of Wife by Husband or of Husband by Wife; and in general the
settling of any and all claims and possible claims by one against the other or against their respective
estates for equitable distribution of all mania! property: and a resolution of all mutual responsibilities
and rights growing out ol'the m::uTi~g~ rd~tionship; :md
WHEREAS, the parties hereto. alier being properly advised by their respective counsel. Wife by
her attorney, Lisa Marie Coyne, Esquire. and Husband have come to the following agreement. Husband
has had an opportunity to consult with Jnd attorney coneerning this divorce.
NOW, THEREFORE, in conSideration of the ahove recilals and the following covenants and
promises mutually made and mutually 10 be kept. the partics heretofore, intending to be legally bound

1. SEPAl/A TlON: It shall b~ lawful for each party at all times hereafter to live separate
and apart from the other at such place or places as he or sh~ may from time to time choose or deem fit.
2, INTER FERENCE: Each party shall be free from interference. authority and contact by
the other. as fully as if he or she were single and unmarried. except as may be necessary to carry out the
provisions of this Agreement. Neither party shall molest the other nor attempt to endeavor to molest the
other, nor compel the other to cohabit with the other, nor in any way harass or malign the other, nor in
any way interfere with the peaceful existence, separate and apart from the othcr in all respects as if he or
she were single and unmarried,
3. WIFE'S DEBTS: Wire represents and warrants to Husband that since their separation
on or about November 5. 1998 she has not, and in the future she will not, contract or incur by debt or
liability for which Husband or his ~slate might be responsible and shall indemnify. defend and save
Husband harmless from any and all claims or demands made against him by reason of debts or
obligations incurred by her.
4. HUSBAND'S DEln:~': Husband represents and warrants to Wife that since their
separation on or about November 5, 1998 he has not, and in the future he will not. contract or incur any
debt or liability for which Wife or her estatc might be responsiblc and shall indemnify, defend and save
Wife hamlless from any and all claims or dcmands made against her by reason of debts or obligations
incurred

7. !iQU17~fBLE DISTlllIWTION OF MARITAL PROPERTY: The parties have
attempted to distributc their marital property in a manner which conforms to thc criteria set forth in 23
1'a. C,S.A. Section 3501 ct, scq" and Itlking into account the following considerations: the length of the
marriage; the age, health. stalion. amount and sources of income, vocational skills, employability. estate,
liabilities and needs of each of the p"nics; the contribution of each party to the education, training or
increased earning powcr of the othcr pany; the opportunity of each party for future acquisitions of capital
assets and income; the sources of income of both parties, including but not limited to medical,
retirement, insurance or other bendits: the contribution or dissipation of each party in the acquisition,
preservation, depreciation or appree"lt"m of the marital property. including the contribution of each
spouse as a homemaker. the value of the property set "part to each party; the standard of living of the
parties established during Ihe marria~e: and the cconol11ic circumstances of each party at the time the
division of property is to become efkell\'e,
The division of exist1l1~ marilal property is not intended by the parties to constitute in
any way a sale or exchange of a>SL'h, and the divi,,,,n is being effecled wilhout the introduction of
outside funds or other propcny not ("nstituting mant"j property. The division of property under this

and separate owner of all such tangible personal property presently in his or her possession, and this
Agreement shall have the effect of an assignment or bill of sale from each party to the other for such
property as may be in the individual pos;ession of each of the parties hereto.

control of either party if. in the case of tangibk personal property, the item is physically in the
possession or control of the party at Ihe time of the signing of this Agreement and, in the case of
intangible personal property, if any physical or writlen evidence of ownership, such as passbook,
checkbook. policy or certificate of insurance or other similar writing is in the possession or control of the
party.
Husband and Wife shall each be deemed to be in the possession and control of his or her own
individual pension or other emphlyee benelit plans, or individual retirement accounts, retirement
benefits, of any nature and Social Security benefits to whieh either party may have a vested or contingent
right or interest at the time of the signing of this Agreement. and neither will make any claim against the
other for any interest in such benefils.
From and after Ihe date of the ,igning of this ,\greement except as provided herein. both parties
shall have complete freedom of dispOSition as to his/her separate property and any property which is in
their possession or control pursuant t" this Agreement and may mortgage, sell, grant, convey. or
otherwise encumber or dIspose of such prope'IO'. whether real or personal, whether such property was
acquired before, during or after marriage. and neither Husband nor Wife need join in, consent to, or
acknowledge ~ny deed. mortgage. or other inslromenl of the other pertaining to such disposition of
property.

8. MOTOR VEHICLES: Husband shall retain the 1994 Volkswagen letla, Wife shall
retain the 1993 Honda Accord,
9. HEALTH INSURANCh': Parties shall provide their own health insurance, Further,
neither party shall be responsible for any health costs or medical expenses incurred by the other and each
shall indemnifY and hold hannless the olher from any claim put forth in that regard.
10. PENSIONS: The Husband and Wife a!,'Tee to waive any claim which they may have to
the other spouse's pension or retirement benefits. if any so exist.
11. ALIMONY: The parties expressly agree that the provisions of this Agreement providing
for equitable distribution of marital property are fair. adequate and satisfactory to them and are accepted
by them in lieu of and in full and linal settlement and satisfaction of any claims or demands that either
may now or hereafter have against the olher for maintenance or alimony. Husband and Wife further,
voluntarily and lmowingly, waive and relinquish any right to seek from the other any payment for
alimony.
12. ALIMONY PENDEN7F UTE. COUNSEL FEES. AND EXPENSES: Husband
and Wife further, voluntarily and knowingly, waive and relinquish any right to seek from the other any
payment for alimony pendente lite, counsel fees. and expenses, Each party shall be responsible for his or
her own attorney fees.
13. INCOME TAX RETURNS: TIle pal1ies have heretofore filed joint federal and state tax
returns, Both parties agree that in th~ ev~nt any deficiency in federal. state or local income tax is
proposed. or any assessment of any such I"X is made against either of them. each will indemnify and hold
hannless Ihe other Ii-om and against '1I"" I<1S5 or Iiabihty lllr any such tax deficiency or assessment and

any interest, penalty and expense incurred in connection therewith. Sueh tax, interest, penalty or expense
shall be paid solely and entirely by the individual who is finally determined to be the cause of the
misrepresentations or failurcs to disclose the nature and cxtent of his or her separate income on the
aforesaid joint returns.
14. WAIVERS OF CLAIMS AGAINST ESTATES: Exeept as herein otherwise
provided, eaeh party may dispose of his or her property in any way, and each party hereby waives and
relinquishes any and all rights he or she may now have or hereafter acquire, unc1er the present or future
laws of any jurisdiction, to share in Ihe property or the estate of the other as a result of the marital
relationship. including withoul Iimilatiol1. dower, curtsey, statutory allowance, widow's allowance, right
and take in intestacy, right to lake against the will of the other, and right to aet as administrator or
executor of the other's estate. Each \\'111. at the request of the other, execute, acknowledge and deliver
any and all instmments which may be necessary or advisable to carry into effect his mutual waiver and
relinquishment of all sueh interests, rights and claims.
15. MUTUAL CONSENT DIVORCE: The parties agree and acknowledge that their
maniage is irretrievably broken. that they do not desire marital counseling, and that they both consent to
the entry of a decree in divorce pursuant to 23 Pa. C.S.A. Section 3301(c). Accordingly, both parties
agree to forthwilh execule such consents. aftidavits, waivers of notice, or other documents and to direct
their respeclive attorneys to forthwith f1le such conscnlS. affidavits, or other documents as may be
necessary to promptly proceed to ol1lail1 a final decree in divorce pursuant to said 23 Pa. C.S,A. Section
3301(c). Upon request. to tbe extent permitted by law and the applicable Rules of Civil Procedure, the

named defendant in such divorce action ,hall execute any waivers of notice or other waivers necessary to
expedite such divorce.
It is the intention of the parties that the Agrecmcnt shall survive any action for divorce
which may be instituted or prosecuted hy eithcr party and no order, judgment or decree of divorce,
temporary, final or permanent, shall affect or modify the financial terms of this Agreement. 111is
Agreement shall be incorporated in, but shall not merge into, any such judgment or decree of final
divorce, but shall be incorporated for Ihe purposes of enforcement only,
16. BREACH AND ENFORCEMENT: If eilher party breaches any provision of this
Agreement, the other party shall have the right, at his or her election, to sue for damages for such breach,
or seek such other remedies or relief ", may be available to him or her, and the party breaching this
Agreement shall be responsible for payment of attorney fees and court costs incurred by the other in
enforcing his or her rights under this ^~rcement.
17. ADDITIONAL INSTRI.'.IIENTS: Each of the parties shall from rime to time, at the
rcqucst of the other, execute. aekno\Vled~e and deliver tn Ihe other party any and all further instruments
that may be reasonably required to give full force and effect to Ihe provisions of this Agreement.
18. TAX ADVICE: Both p"nies herelO hereby acknowledge and agree that they have had
the opportunity to retain their 0\\11 accnul1tanls, certi1ied public accounts, tax advisor. or tax attorney
with reference to the tax implications nf this Agreement. Further. neither party has been given any tax
advice whatsoever by their respective :l1l<1llleys, Further hoth parties hereby acknowledge that they have
been advised. by their respec:i\'e anOnh'\'S. tn seck their nwn independcnt tax advice by retaining an
accountant, certified publ1c ~CCQuntll11. 1;1\ attorney. or t;lX ~d\'isl1r with reference to the tax implications

involved in this Agreement. Further. Ihe parties acknowledge and agree that their signatures to this
Agreement serve as their acknowledgment that they have read this particular paragraph and have had the
opportunity to seek independent tax advice.
19. VOLUNTARY EXECUTION: 111e provisions of this Agreement and their legal effect
have been fully explained to the parties by their respective counsel. if any, and each party acknowledges
that the Agreement is fair and equitable, Ihat it is being entered into voluntarily, with full knowledge of
the assets of both parties, and that it is not the result of any duress or undue intluence. The parties
acknowledge that thcy have been furnished with all infommtion relating to the financial affairs of the
other which has been requested by each or them or by their respective counsel.
20. ENTIRE AGREEMENT: 111is Agreement contains the entire understanding of the
parties and there are no representations. \\.eITantles, covenants or undertakings other than those expressly
set forth herein. Husband and Wife acknowledge and agree that the provisions of this Agreement with
respect to the distribution and division of mantal and separate property arc fair, equitable and
satisfactory to them based on the lenglh of their marriage and other relevant factors which have been
taken into consideration by the parties, Bnlh parties hereby accept the provisions of this Agreement
with respect to the division of properly III lieu of and in full and final settlement and satisfaction of all
claims and demands that they may no\\' h:\ve or hereafter have against the other for equitable distribution
of their property by any court of eompelenl jurisdiction pursuant to 23 Pa. C.S.A. Section 3501 el, seq. or
any other laws, Husband and Wife e;\,'h voluntarily end knowingly waive and relinquish any right to
seek a court ordered delermination and dlstribulion of marital property. but nothing herein contained

shall constitute a waiver by eilher parlY of any rights to seek the relief of any court for the purpose of
enforcing the provisions of this Agreement.
21. DISCl.OSURE: Husband and Wife each represent and warrant to the other that he or
she has made a full and complete disclosure to the other of all assets of any nature whatsoever in which
such party has an interest, the sources and amount of the income of such party or every type whatsoever
and of all other facts relaling to the subject matter of this Agreement.
22. MODIFICATION AND WAIVER: A modification or waiver of any of the provisions
of this Agreement shall bc cffective only ifmadc in writing and executed with thc same fonnality as this
Agreement. The failure of either parlY 10 insist upon strict performance of any of the provisions of this
Agreement shall not bc construed as a \\aiver of any subsequent default of the same or similar nature.
23. PRIOR AGREEMl:'.YT: Il is undcrstuod and agrecd that any and all property
settlement agreements which mayor ha,.c bcen .:xecuted priur to the date and time of this Agreement are
null and void and of no effect.
24. DESCR I PTlVF. llF..IDINGS: The descriptive headings used herein are for
convenience only. TI1CY shall have no effcct whatsocvcr in determining the rights or obligations of the
parties.
25. INDEPENDF.NT SEl'. IRATE COVl:'NfNTS: It is specifically understood and agreed

and continue in full force, effect and operation.

inure to the benefit of the parties hereto and their respective heirs. executors, administrators, successors,
and assigns.

and files this Complaint In Custody and Divorce and avers the following in support thereof:
I. The Plaintiff, Kathryn W. Semula, is an adult individual residing at 1050 Memory Lane,
Meehaniesburg, Cumberland County, Pennsylvania.
2, The Defendant, Nicholas J. Semuta. is an adult individual residing at 103 Hiddenwood
Drive, Harrisburg, Dauphin County. Pennsylvania.
3, The Plaintiff and Dcfcndant havc bccn bona fidc rcsidcnts in the Commonwealth for al
least six months previous to the fIling of this Complaint.
4. The Plaintiff and Defendant were married on November 2, 1996, Camp Hill,

9. Wile believes based on Husband's statements conceming lack of employment and travel
plans that Husband will liquidate and dissipate the substantial marital assets held as stock, equities, and
mutual funds.
10. Respondent Husband has informcd wifc that he has already liquidated certain holdings
of marital asscls, namely common stock of DuPont, Elias, and Union Carbide and that he has used those
procceds for his own use.
II. Section 3323(1) of the Divorce Code provides that, "in all marital causes, the Court shall
have full equity jurisdiction and may issue injunctions or other ordcrs which arc necessary to protect the
interest of the parties or to effectuate the purposes of tbis Act. and may grant such other relief or remedy
as equity and justice require against other party...."

PETITION TO MODIFY ORDER OF CUSTODY
AND NOW, Defendant/Petitioner, LISA K. MALDONADO, by and
through her counsel, Goldberg, Katzman &Shipman, P.c. and Paul J. Esposito, Esquire,
files this Petition to Modify Order of Custody, and in support thereof, avers as follows:
I. Jose A. Maldonado, Jr., Plaintiff/Respondent, currently resides at
Quarters ZIO, Edson Drive, MechanicsburgNaval Depot, Mechanicsburg, Cumberland
County, Pennsylvania.
2. Lisa K. Maldonado, Defendant/Petitioner, resides at 263-A North
Arlington Avenue, Harrisburg, Dauphin County, Pennsylvania.
3. The parties are the parents of three minor children, BRITNEY
MALDONADO, bom September 24, 1990; SARAH MALDONADO, bom May 13,
1993; and ALOI-llLANI MALDONADO, bom )uly 8, 1996.
4. On January IS, 1999, the Honorable Edward E. Guido entered an
order of court regarding custody of the children. A copy of said order is attached hereto,
made a part hereof and marked Exhibit "A".
.5. Defendant/Petit iOller has not been permitted physical custody of the
children since the Labor Day weekend, 1999, as a result of an incident which involved
an injury to the parties' daughter, Sarah, while in her custody. Since that time,
Plaintiff/Respondent has not allowed unsupervised partial custody and has not been
cooperative in making arrangements for supervised visitation.
6. Defendant/Petitioner has conferred with Dr. Stanley Schneider on
two occasions in an effort to address the situation and she has an application pending
for participation in the Escape Center Program, however, she believes that as long as the
Orderremains it its present foml, she \\iI1 not be pemlitted to have meaningful time with
her daughters.
WHEREFORE, Defendant/Petitioner respectfully requests that this
Honorable Court modify the order of January 15, 1999, to arrange a fonnal schedule of
temporary physical cllstody for Defendant/Petitioner.
