STIPULATION AGAINST LIENS
THIS AGREEMENT made the 23rd of December, 1998, by and
between BRIM BUILDERS, INC.,
AND
WILLIAM D. KEEFER and JUDY A GLACKEN, hereinafter referred to as
Owner, whereby the former undertook and agreed to erect and
construct a single family dwelling on that certain lot of ground
situate in
503 SARAH COURT, MECHANICSBURG, PA.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for and in consideration of the sum of ($1.00) Dollar
to BRIM BUILDERS, INC. in hand paid by Owner, the receipt whereof
is hereby acknowledged, and the further consideration mentioned
in the agreement aforesaid, for themselves and their
subcontractors, and all parties acting through or under them,
covenant and agree that no mechanic's liens or claims shall be
filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for themselves, their
subcontractors and others under them hereby expressly waive and
relinquish the right to have, file, and maintain any mechanic's
liens or claims against the said buildings or any of them, and
agree that this instrument, waiving the right of lien, shall be
an independent covenant.

ALL, THAT CERTAIN piece, parcel or lot of land, together with
improvements, situated in Hampden Township, Cumberland County,
Pennsylvania, and bounded and described as follows:
BEGINNING at a point on the Eastern right-of-way line of Sarah
Court (50.00 feet wide), said point being located at the
Southwest corner of Lot No. 125; then along the Southern boundary
line of Lot No. 125 North 83 degrees 31 minutes 30 seconds East,
for a distance of 105.67 feet, to a point in line of Phase I;
then along said Phase I South 04 degrees 13 minutes 07 seconds
East, and through a 15.00 foot drainage easement, for a distance
of 100.00 feet, to a point; then South 26 degrees 05 minutes 57
seconds, and through said 15.00 foot wide drainage easement, for
a distance of 30.23 feet, to a point in line of Phase II; then
along Phase II South 75 degrees 46 minutes 53 seconds West, for a
distance of 122.36 feet, to a point at the Southeastern corner of
Lot No. 123; then along the Eastern boundary line of Lot No. 123
North 14 degrees 13 minutes 07 seconds West, for a distance of
50.83 feet, to a point on the Southern right-of-way line of Sarah
Court (50.00 feet wide); then along said right-af-way line on the
arc of a circle curving to the left, having a radius of 60.00
feet, and an arc length of 119.97 feet, to a point and the place
of BEGINNING.
THIS PIECE, PARCEL or lot of land contains approximately 14,899.24
square feet of land, has an address of 503 Sarah Court,
Mechanicsburg, Pennsylvania 17055, and is known and numbered as
Lot No. 124 on the Final Subdivision Plan for Good Hope Farms
South - Phase III, which is recorded in Cumberland County in Plan
Book 77, Page 82.
UNDER AND SUBJECT TO:
(a) Any and all easements, licenses, leases, exceptions,
reservations, covenants, agreements, conveyances and restrictions
which affect the premises and are visible by inspection of the
premises.
(b) Any and all easements, licenses, leases, exceptions,
reservations, covenants, agreements, conveyances and restrictions
contained in any and all prior documents, agreements,
instruments, deeds, grants and conveyances affecting the premises.
(c) The Declaration of Covenants and Restrictions, recorded
in Cumberland County in Miscellaneous Book , Page as
may be applicable to the above described property.
BEING A PART of the same premises which The ~lcNaughton Company, a
Pennsylvania Corporation, by their deed to be recorded
simultaneously herewith, in the office of the Recorder of Deeds
of Cumberland County, granted and conveyed unto William D. Keefer
and Judy A. Glacken.
