AND NOW COMES, Plaintiff by her attorney James H. Stewart, Jr., Esquire, who
makes claim upon the cause of action wherevf the following is a statement to wit:
1. Plaintiff Mary C. Fitzgerald, also known as Cam, practices engineering as Fitzgerald
Engineering and resides at 127 Second Street in the village of Bowmansdale, Upper Allen
Township, Cumberland County, Pennsylvania. Plaintiff's mailing address is P.O. Box 12,
Bowmansdale, PA 17008.
2. Defendant Stanley II. Womack practices architecture under the name Stanley H.
Womack Associates at ] 60 South Progress A venue, Suite 2C in Lower Paxton Township,
Dauphin County, Pennsylvania with a mailing address of Harrisburg. PA ] 7109-4636,
3. Plaintiff submitted 10 Defendant contract proposals for the performance of the HV AC
design, plumbing design and other work for two (2) projects at the Selinsgrove Center tor
renovation of bath areas known as DGS projects 553-30 and 553-31 under the COntracts
copies of which are attached hereto as Exhibit A, which said contracts Defendant accepted.
4. Plaintiff performed all of the work on her pan to be performed under said COlllracts and
has submitted monthly statements during the course of the work on these projects.
De!endalll has made no paymelll since paymel1l on invoice # 18 dated March 3, 1997
which he paid without costs of the suit on August 7, 1997 after appealing the suit for
paymelll brought against him. Meanwhile, he has ignored monthly statements. the last of
which was issued on Octoher I, 1998 lilr project # 553-30 in the anlOUI1l of $ I ,157.66 and
an invoil'l: of the same dale lilr project # 553-31 in the amoul1l of $2.697.38, Copies of
said invoices are anached hereto marked as bhibit B-1 :Uld B-2 n:spl'ctively and made
apart hereof a by rell:renee hereto,
5, Defendant has breached the contracts by not properly processing and paying Plaintiff's
invoices mOlllhly as required by the contracts.
6, Plaillliff has made frequelll demands upon Defendant for payment and Defendant has
failed and refused and cOlllinues to fail and refuse to make payment of the same.
Wherefore Plaintiff demands judgment in it's favor and against Delcndant in the
amoulll of $3,919.54 IOgclhcr wilh lhc COSlS of pursuing this claim in magislcrial dislricl
number 09-3-05 before Gayle A. Elder District Justice in the amount of $64.50 and costs of
suit inlhis proceeding,
