CROSSLEY AND CANDACE CROSSLEY, husband and wife, hereinafter referred to as Owners, whereby the contractor undertook and agreed to erected and construct a dwelling on the certain lot of ground situate in Silver Township, Cumberland County, Commonwealth of Pennsylvania, and more fully described in Exhibit "A" which is attached hereto and made a part hereof and known as Lot #36 Phase III, Peninsula Subdivision, Pennsylvania. NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for an in consideration of the sum of ($1.00) Dollar to Contractor in hand paid by Owner, the receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for itself, himself or themselves and its, his or their subcontractors, and all parties acting through or under them, covenant and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said buildings and the lot of ground appurtenant thereto for or on account of any work done or materials furnished by them or any of them under said contract or otherwise, for, towards, in, or about th~ erection and construction of the said buildings on the lot above described, and the said Contractor, for itself, himself or themselves, its, his or their subcontractors and others under them, hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant. NOEL, Notary Public I Camp Hili BOTO, Cumbe~and County tMy 9Emmission Expires Dec. 8, 2003 . ~. - ,. ,- - . v ,* Exhibit A ALL THAT CERTAIN tract or parcel ofIand situate in Silver Spring Township, Cumberland County, Pennsylvania, bounded and described as Lot 36 in accordance with the Major Final Subdivision Plan for The Peninsula (Phase llI), prepared by Hartman and Associates, P.C. and recorded in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania in Plan Book 70, at Page 63, more particularly bounded and described as follows: BEGINNING at a point on the Western right of way line of Bridgeport Drive, said point being located at the common corner of Lot #36 and Lot #35; thence along Lot #35 South 88 degrees 58 minutes 42 seconds West, a distance of 134.44 feet to a point, said point being a common corner of Lot #36 and Lot #37; thence along Lot #37 North 02 degrees 19 minutes 18 seconds West, a distance of 215.00 feet to a point on the Southern right of way line of Clairburn Drive; thence along said right of way line North 88 degrees 58 minutes 42 seconds East, a distance of 110.00 feet to a point; thence by a curve, curving to the right connecting said right of way line to the western right of way line of Bridgport Drive having a radius of 25.00 feet and an arc length of 38.70 feet; thence along the Western right of way line of Bridgeport Drive south 02 degrees 19 minutes 18 seconds East, a distance of 190.56 feet to a point, said point being the place of BEGINNING. SAID lot contains 28,769.77 square feet or 0.6605 acre and subject to a sanitary sewer easement as shown on the Plan of Lots of "The Peninsula, Phase III". BEING the same premises which Sample Bridge, Inc., by Deed dated June 27, 2000, which Deed is recorded in the Office of the Recorder of Deeds in and for Cumberland County in Deed Book 224, Page 234, granted and conveyed to Monroe E. Crossley and Candace Crossley, husband and wife, Borrowers herein.
