THIS AGREEKEm' made the Iq;-\M- day of July, 2000, by and
bet.ween W. UE ROLAND, BUILDER, of 337 West Meadow Drive,
Mechaniosburg, Pennsylvania, hereinafter referred to as
contractor, AND W. LEE ROLAND and ROSALIE H. ROLAND, husband and
wifer of 337 west MeadoW Drive, Mechanicsburg, Pennsylvania,
he~einafter referred to as owner, whereby the former undertook
and agreed to erect and construct a residential dwelling on that
certain lot of ground situate on Boxwood Lane and Windrush Lane,
inU~per Allen Township, Cumberland county, Pennsylvania, being
Lot No. 19, Final Development Plan for Witney Ridge Planned
Residential Development Phase I, said plan being recorded in Plan
Book 80, Pages 63-64. Being part of the same premises which Gene
W. Hollinger and Dorothy J. Hollinger, husband and wife, by Deed
dated August 17, 1999 and recorded in the CUmberland County
Recorder of Deeds Office in Deed Book 206, Page 23, granted and
conveyed unto witney ){idqe Investors, LP. Also being the same
premises which witney Ridge Investors, LP by Peed dated July /q,
2000 and reccrded July
, 2000 in the Cumberland Reoorder of
Deeds Office in Deed BOOK

, granted and conveyed
unto W. Lee Roland and Rosalie H. Roland, husband and wife.
NOW ~HEREFORE, THIS AGREEMEN~ WI~NEBSETHI That the said
Contractor, for and in aonsideration of the sum of one ($1.00)
Dollar to him in hand paid by owner, the receipt whereof is
hereby acknowledqed, and the further oonsideration mentioned in
the agreement aforesaid, for themselves and their subcontractors,

and all parties aoting through or under them, oovenant and agree
that no mechanic's liens or claims shall be filed or maintained
by them or any of them against the said buildings and the lot of
ground appurtenant thereto for or on aocount of any work done or
materials furnished by them or any of them under said oontract or
otherwise, for, towards, in, or about the erection and
construction of the said buildings on the lot above described,
and the said contraotor, for themselves, their subcontraotors and
others under them hereby expressly waive and relinquish the right
to have, file, and maintain any mechanic's liens or claims
against the said buildings or any of them and agree that this
instr.ument, waiving the right of lien, shall be an independent
Oovenant.
