COMPLAINT
1. Plaintiff, the Pennsylvania Turnpike Commission ("Commission"), is an
instrumentality of the Commonwealth of Pennsylvania that operates the Pennsylvania Turnpike
("Turnpike") with its principal office near Highspire, Pennsylvania, and whose mailing address is
P.O. Box 67676, Harrisburg, Pennsylvania 171 06-7676.
2. Defendant USA Truck, mc., is a corporation whose last known address is 3108
mdustrial Park Road, VanBuren, Arizona 72956.
3. Defendant Joseph Perdue is an individual whose last known address is 5416
Bearcreek Road, Pekin, mdiana 47165.
4. Around July 26, 1998, at approximately 12:36 a.m. on the Turnpike around
Milepost 342.9 in Upper Moreland Township, Montgomery County, Defendant Joseph Perdue
was operating a vehicle on behalf of Defendant, USA Truck, mc., in the westbound lanes. The
vehicle was a 1996 Freightliner tractor trailer (VIN IFUYDSEB8WPI5653).

5. Around July 26,1998, at approximately 12:36 a.m. the Turnpike road surface
around Milepost 342.9 was dry.
6. A collision occurred when Defendant Joseph Perdue apparently fell asleep and
allowed the vehicle described in Paragraph 4 to strike and go through the guiderail.
7. At the time of the accident, Defendant Joseph Perdue was either an agent, servant,
or employee of Defendant USA Truck, Inc.
8. The collision between the Defendants' vehicle and property owned by the Plaintiff
was caused by the negligence, carelessness, and recklessness as follows:
a. operating its vehicle at an excessive rate of speed under the circumstances;
b. failing to have its vehicle under proper and adequate control;
c. failing to act as a reasonable person would have acted under the
circumstances;
d. operating its vehicle in a manner endangering persons and property; and
e. failing to properly train drivers regarding the operation of a vehicle.
9. As a result of the accident, Commission personnel and an outside contractor
responded to clear the accident site and to repair the Turnpike.
10. As a result of Defendants' the accident, the Commission sustained property
damage totaling $14,966.94 for labor, equipment, and materials supplied by Commission
personnel and an outside contractor for cleanup and repair. A copy ofthe damage invoice sent to
Defendants is attached as Exhibit "A" and incorporated by reference.
11. Despite demands by the Commission, Defendants have refused to make restitution
in this amount.

WHEREFORE, Plaintiff Pennsylvania Turnpike Commission prays that this Honorable
Court enter judgment in its favor against Defendants USA Truck, Inc., and James Perdue, jointly
and severally in the amount of$14,966.94 plus interest and costs.
