DECLARATION OF TAKING
AND NOW, the MIDDLESEX TOWNSHIP MUNICIPAL AUTHORITY, a
municipal authority created and existing under the laws of the Commonwealth of
Pennsylvania, hereby files this Declaration of Taking and declares as follows:
I. The Condemnor is MIDDLESEX TOWNSHIP MUNICIPAL AUTHORITY
having its principal office at 350 North Middlesex Road, Carlisle (Middlesex Township),
Cumberland County, Pennsylvania, 17013.
2. This Declaration of Taking is filed pursuant to the authority ofthe Municipality
Authorities Act of 1945, Act of May 2,1945, P.L. 382, No. 164, as amended and
supplemented (53 P.S. Ii 301, et seq.).
3. This Declaration of Taking is made and authorized by virtue of a Resolution duly
adopted by the Board of the Middlesex Township Municipal Authority at a public meeting
held on July 20, 2000 at the office of the Middlesex Township Municipal Authority identified

in Paragraph I, above. The record of said public meeting, being the minutes thereof, and the
original Resolution may be examined at the Middlesex Township Municipal Authority's

office at the Municipal Building aforesaid, a copy of said Resolution being attached hereto
marked "Exhibit 1" and incorporated herein by reference thereto.
4. The purpose of this condemnation and Declaration of Taking filed incidental
thereto is to acquire and secure fee simple interest in lands for establishing, installing,
construction, operating, repairing, maintaining, renewing and replacing a water supply and
distribution system by said Condemnor.
5. Attached hereto marked "Exhibit 2" and incorporated herein is docwnentation
which contains the description and designation of the land situate in Middlesex Township,
Cwnberland County, Pennsylvania, necessary to be obtained for the purposes aforesaid. A
copy of said docwnentation mentioned in said Exhibit will be filed as of the date of the filing
hereof in the Office of the Recorder of Deeds in and for Cwnberland County, Pennsylvania at
the Cwnberland County Courthouse in Carlisle, Pennsylvania in accordance with Section 404
of the Eminent Domain Code, Act of June 22, 1964 (Special Session), P.L. 84, Article IV, as
amended.
6. The nature and extent of the fee simple title acquired hereby is for the purpose of
establishing, installing, constructing, operating, maintaining, renewing and replacing a water
supply and distribution system as more fully set forth in Section 2 of said Resolution ("Exhibit
1") which said Section is specifically incorporated herein by reference thereto.
7. The names and addresses of the Condemnees herein are:

8. The above named Condemnees are the owners in fee simple of the lands being
taken, appropriated and condemned.
9. Plans describing and showing the condemned land may be inspected at the office
of the Middlesex Township Municipal Authority at the Municipal Building located at 350
North Middlesex Road, Carlisle (Middlesex Township), Cumberland County, Pennsylvania
17013.
10. Middlesex Township Municipal Authority, as Condemnor, files
contemporaneously herewith its Bond, without surety, pursuant to Section 403(a) of the
Eminent Domain Code aforesaid, which Bond secures just compensation to the Condemnees.

A RESOLUTION OF THE BOARD OF THE MIDDLESEX
TOWNSHIP MUNICIPAL AUTHORITY OF CUMBERLAND
COUNTY, PENNSYLVANIA AUTHORIZING THE SELECTION,
CONDEMNATION AND APPROPRIATION OF CERTAIN LAND
SITUATE IN THE TOWNSHIP OF MIDDLESEX FOR THE
CONSTRUCTION, INSTALLATION, USE AND OPERATION OF A
WATER SUPPLY AND DISTRIBUTION SYSTEM TO BE PART OF
THE EXISTING WATER DISTRIBUTION SYSTEM OF THE
MIDDLESEX TOWNSHIP MUNICIPAL AUTHORITY, AND
AUTHORIZING THE FILING OF A DECLARATION OR
DECLARATIONS OF TAKING AND ALL NECESSARY ACTION
FOR THE ACQUISITION THEREOF.
WHEREAS, the Middlesex Township Municipal Authority (hereinafter called the
"Authority") is a municipal authority created and existing under the laws of the
Commonwealth of Pennsylvania, situated in Middlesex Township, Cumberland County,
Pennsylvania; and
WHEREAS, Middlesex Township is in a state oftransition from a predominantly rural
community to a community of various uses and functions; and
WHEREAS, the Authority desires to expand its water distribution system and create a
supply system in the southern portion of Middlesex Township by extracting underground
water sources by well; and
WHEREAS, the Authority believes that the public safety and welfare will be enhanced
and best protected by creating a water supply system in Middlesex Township; and

WHEREAS, it is necessary that the Authority acquire and secure the necessary and
appropriate lands for purposes of creating a water supply system, establishing well sites and
for constructing, installing and operating a water supply and distribution system; and
WHEREAS, the Authority has identified certain land in Middlesex Township which
will contain and accommodate the proposed water supply system, well sites and distribution
system, which land is more fully identified and described in a certain legal description,
a true and correct copy of which is attached hereto and incorporated by reference herein as
"Exhibit A"; and
WHEREAS, the land being subject to this proceeding is owned by Robert R. Line, Jr.
and 1. Edward Clouse (herein collectively called "Line and Clouse") who reside at 2070
Ritner Highway, Carlisle, Pennsylvania 17013 and 2075 Ritner Highway, Carlisle,
Pennsylvania 17013, respectively;
WHEREAS, the Authority has been unsuccessful in negotiating the acquisition of the
necessary land from Line and Clouse; and
WHEREAS, pursuant to the Municipality Authorities Act of 1945, Act of May 2,
1945, P.L. 382, No. 164, as amended and supplemented (53 P.S. S 301, et seq.), the Authority
is authorized and empowered to acquire and secure such title, fee or other interest in land
through eminent domain proceedings;
NOW THEREFORE, on motion duly made, seconded and duly passed, the Authority
through its Board, be and it is hereby
RESOLVED:
SECTION I: The foregoing title, preamble and paragraphs are incorporated herein by

reference thereto.
SECTION 2: This Township hereby selects, condemns and appropriates those
premises described and set forth in "Exhibit A", said lands being owned by Line and Clouse.
The nature and extent of the title and interest to be acquired under this Section
2 is fee simple title in and to the premises described and designated in the attached legal
description ("Exhibit A"), for the purposes of presently and perpetually thereafter,
establishing, installing, constructing, operating, repairing, maintaining, renewing and
replacing a water supply and distribution system, and to otherwise use and maintain said land
within and as part of the water supply and distribution system of the Authority.
SECTION 3: The Authority, its Board and its proper officers are hereby authorized to
file such Declarations of Taking and such other papers, documents and/or proceedings,
including the entry of such bond as may be necessary or desirable, and to do and perform all
other acts necessary and requisite to carry out the purposes of this Resolution, and said
officers and the Authority's employees or agents are authorized and empowered to enter upon
the lands to be taken, condemned and appropriated in order to make studies, surveys, tests and
appraisals,
SECTION 4: The institution of such proceedings, including the entry of such bond as
may be necessary or desirable, and any damages which may be awarded to the owners of the
premises or lands shall be paid from such funds which may become available and from time
to time appropriated by the Authority for such purposes.

KNOW ALL MEN BY THESE PRESENTS, that MIDDLESEX TOWNSHIP
MUNICIPAL AUTHORITY, a municipal authority created and existing under the laws of the
Commonwealth of Pennsylvania, hereinafter called "Obligor", is held and fIrmly bound unto
the COMMONWEALTH OF PENNSYLVANIA, hereinafter called "Obligee", for the use
and benefIt of the owners ofthe property or property interests condemned as hereinafter
noted, and other proper parties in interest, for such amount of damages as the said owners of
the said property or property interests and other parties in interest shall be entitled to receive
after the same shall have been agreed upon or assessed in the manner prescribed by law, by
reason of the condemnation by the MIDDLESEX TOWNSHIP MUNICIPAL AUTHORITY
of a certain fee simple interest in lands and property located in Middlesex Township,
Cumberland County, Pennsylvania, more fully shown and described in "Exhibit A" attached
hereto and attached to the Declaration of Taking of which this Bond is a part and which
Exhibit is made a part hereof by reference thereto.

WHEREAS, the Middlesex Township Municipal Authority has condemned the
aforementioned property interests and cannot agree with the owners thereof upon the just
compensation to be paid for the damages sustained by the owners of the property interests as a
result of the condemnation;
NOW, THE CONDITION of this Bond is such that if the MIDDLESEX TOWNSHIP
MUNICIPAL AUTHORITY, the Obligor herein, shall payor cause to be paid such amount of
damages as the said owners of the property interests so condemned and the other parties
interest shall be entitled to receive by reason of such condemnation, after the same shall have
been agreed upon or assessed in the manner provided by law, then this obligation shall be
void; otherwise, it shall be and remain in full force and effect.

TO DECLARATION OF TAKING
AND NOW, comes the Condemnees, Robert R. Line, Jr. and J. Edward
Clouse, by and through their attorneys, Mette, Evans & Woodside, P.C., and aver the
following Preliminary Objections to the Declaration of Taking of Condemnor,
Middlesex Township Municipal Authority:
1. Condemnor, Middlesex Township Municipal Authority
(hereinafter "Condemnor"), on July 26, 2000, filed a Declaration of Taking of certain
property located in Middlesex Township, Cumberland County, known as Tract 22 of
the Final Subdivision Plan of Two Tracts for Robert R. Line, Jr., et aI., being part of
County Parcel No. 21-08-573-02 (hereinafter "Property"), and owned by
Condemnees, Robert R. Line, Jr. and J. Edward Clouse (hereinafter "Condemnees"),
and served the Declaration of Taking on July 29,2000.
2. These Preliminary Objections are timely and question both the
sufficiency of the procedure followed by the Condemnor and the amount of land
taken in the Declaration of Taking.

3. Although the Condemnor has the power to acquire land, the
Condemnor does not have the power to acquire an interest that is greater than is
necessary to carry out its purpose. Truitt v. Borough of Ambridge Water Authoritv,
389 Pa. 429, 133 A.2d 797 (Pa. 1957).
4. The Condemnor claims that it needs the Condemnees' land which
contains approximately thirty-six point forty-six (36.46) acres to establish, install,
construct, operate, repair, maintain, renew and replace a water supply and
distribution system. The Condemnor has not demonstrated nor shown that it needs
the entire Property to perform this task. Upon information and belief, the
contemplated Comprehensive Plan for Middlesex Township shows the property being
used as a park in the future. Furthermore, Township officials are quoted in a recent
newspaper article (Attached as Exhibit "A") as stating that the Township plans to
use this property primarily for park use.
5. The Condemnees' property is also in the Agricultural Area
Security Program and no land within this Agricultural Security Area can be
condemned for any reason unless there is prior approval from the Agricultural Lands
Condemnation Approval Board, the governing bodies of the local government units
encompassing the agricultural and security area, the county governing body, and the
Agricultural Security Area Advisory Committee. See 3 P.S. ~913(b). (Attached as
Exhibit "B").

6. Furthennore, it is believed that Condemnor failed to serve notice
prior to its filing of this Declaration of Taking upon the above-referenced bodies and
under Pennsylvania law, "No such Condemnation shall be effective until sixty (60)
days following the receipt of such notice." See 3 P.S. ~913(c). (Attached as Exhibit
"B").
7. The Property is part of the Agricultural Area Security Program of
Middlesex Township, which was recorded in the Cumberland County Recorder of
Deeds in Deed Book 394, Page 249 and Deed Book 394, Page 280, which is attached
collectively as Exhibit "C."
8. Furthermore, the Property is currently being leased to a farmer
who is growing Alfalfa, a perennial crop with at least a three-year life. Allowing the
Condemnor to inspect and enter the Property to test for well sites where it has not
followed correct condemnation procedures would improperly destroy the Alfalfa crop
and render the property unuseable for its current use.
9. Upon infonnation and belief, Middlesex Township currently
purchases adequate supplies of potable public water from South Middleton Township
and the remainder of its residents have wells. That supply of water is more than
sufficient to met the needs of Middlesex and therefore, no rationale has been
demonstrated by the Condemnor in the taking of this Property. Condemnor has
failed to establish a public record of its rationale for this condemnation action.

10. The Declaration of Taking therefore should be considered invalid
for attempting to condemn land in the Agricultural Area Security Program without
following the correct procedures; because Condemnor is attempting to condemn more
property than is appropriate and reasonable for the purposes of the Condemnor; and
because Condemnor intends to use the bulk of the property for a park, a use for
which the Authority has not declared its purpose.
WHEREFORE, Condemnees pray that the Court will dismiss this action
and declare the Declaration of Taking invalid because the Condemnor failed to follow
the correct procedure as required under the Agricultural Area Security Law and
because the taking by the Authority is unreasonable and unnecessary under the
circumstances since it is proposing to take more land than it is believed necessary.
