PLAINTIFFS' PRETRIAL MEMORANDUM AND NOW, the Plaintiffs, Charles Villareale and Cindy Villareale by and through their attorneys, Ira H. Weinstock, P.C. , respectfully submits this Pretrial Memorandum. I. STATEMENT AS TO LIABILITY Plaintiffs maintain that on September 11, 1998, Plaintiff, Charles Villareale was in the parking lot of the Metroplex Grocery Warehouse in Harriman, New York. Mr. Villareale is a commercial truck driver and he was waiting to unload his freight. At the same time and place, Defendant, Angela Westfall, who was employed by and was an agent of KLLM Transport Services, Inc., was driving a commercial tractor trailer and attempting to maneuver the tractor trailer in the parking lot. While Ms. Westfall was maneuvering her tractor trailer, her headlights were interfering with other tractor trailer operators who were attempting to dock their trailers. Mr. Villareale approached Ms. Westfall's vehicle and asked her to turn her lights off or shut off her vehicle so that other drivers could dock their trailers without interference from her headlights. Ms. Westfall became agitated and in a negligent and reckless manner sharply turned her vehicle, accelerated and drove away. '" .l--- ~r~' II. STATEMENT AS TO DAMAGES As a result of Ms. Westfall's negligent conduct, Mr. Villareale lost seven days of work for a total of $784.20. Mr. Villareale also incurred medical bills in the amount of $552.00. Mr. Villareale also suffered significant physical pain and suffering as well as emotional distress due to the egregious conduct of Ms. Westfall and we value his losses at $5,000.00. Finally, as a result of his injuries, Mrs. Villareale suffered a loss of consortium which we value at $1,000.00. III. STATEMENT AS TO PRINCIPAL ISSUES OF LIABILITY AND DAMAGES Defendant, Angela Westfall, maintains that she was not negligent in pulling away from Mr. Villareale and that any injury sustained by Mr. Villareale was caused his contributory negligence. IV. SUMMARY OF LEGAL ISSUES Plaintiffs do not anticipate any legal issues concerning the admissibility of testimony, exhibits or any other matter. V. IDENTITY OF WITNESSES (a) Charles Villareale; (b) Cindy Villareale; (c) Dr. Flora Torres, via deposition - Mr. Villareale's treating physician; (d) Angela Westfall, on cross examination; and (e) Joseph Seifrit, General Manager of Timely Transportation - Mr. Seifrit will testify regarding the work that was available to Mr. Villareale during the period of his recovery. 2 - ',- " ",",.i ,:"" VI. STATUS OF SETTLEMENT NEGOTIATIONS Plaintiff has submitted a demand of $7,500.00 to resolve the case. Defendant has made no offer to settle the case. At all times material hereto, Defendant Angela Westfall, was the Agent, Servant and/or Employee of Defendant KLLM Transport Services, Inc. and was acting within the course of her employment and within the scope of her authority. 6. At all times material hereto, Defendant KLLM Transport Services, Inc., acted by and through its agents, servants and Employees who were acting within the course oftheiI employment and within the scope of their authority. 7. At all times material hereto, Defendant KLLM Transport Services, Inc. was the registered owner ofthe tractor-trailer driven by Defendant Angela Westfall. 8. On or about September 11,1998 at approximately 1:42 a.m., Plaintiff Charles Villareale was located in the parking lot of the Metroplex Grocery Warehouse in Harriman, New York. 9. At the aforementioned time and place, Defendant Angela Westfall, was operating a tractor-trailer in the Metroplex Grocery Warehouse lot in the vicinity of the loading dock. 10. Defendant Westfall was maneuvering her tractor-trailer in a way which was causing her headlights to interfere with other tractor-trailer operators who were attempting to dock their trailers. 11. Plaintiff Charles Villareale approached Defendant Westfall and asked her to turn off her headlights or to shut offher vehicle so that other drivers could dock their trailers without the interference of the headlights. 12. As Defendant Westfall was pulling away from Plaintiff Charles Villareale, the running boards of the tractor being operated by Defendant Westfall struck the Plaintiff Charles Villareale in the right leg. 14. As a result of the collision, which was caused by the negligence of the Defendant, Plaintiff sustained various bodily injuries and damages including but not limited to lacerations and bruising of the right leg. 15. As the direct a proximate result ofthe carelessness and negligence of the Defendant, Plaintiff Charles Villareale has been required to receive and undergo medical attention and to incur various medical expenses for the injuries he has suffered and may be obliged to require in the future medicines, medical care, hospitalization and treatment and may in the future be compelled to expend sums of money and incur monetary obligations for such care and treatment. 16. As a direct and proximate result of the carelessness and negligence of the Defendant, Plaintiff has undergone a period of disability and has suffered and will continue to suffer aches, pains, mental anguish as well as limitation and restriction of his usual activities, pursuits and pleasures. COUNT I - PLAINTIFF CHARLES VILLAREALE V. DEFENDANT ANGELA WESTFALL 17. The Plaintiff hereby incorporates by reference paragraphs 1 through 16 of this Complaint as though set forth at length herein. 18. Defendant Angela Westfall was guilty of negligence, carelessness and/or recklessness in the following particular respects: ( a) Failure to keep alert and maintain a proper watch for the presence 3 . .--, ' ,< L "."', '~ ,~ """, ,,' '",,'- If; of pedestrians; (b) Failure to travel at a safe speed; (c) Failure to apply her brakes in sufficient time to avoid striking the Plaintiff; (d) Failure to yield the right of way to Plaintiff; (e) Failure to drive her vehicle with due regard for the conditions which were then occurring and of which she was or should have been aware of; and (f) Failure to keep proper and adequate control over her vehicle. WHEREFORE, Plaintiff, Charles Villareale, demands judgment in his favor against Defendants jointly and severally, for a sum in excess of the jurisdictional amount requiring Arbitration under the Rules of Cumberland County, together with delay damages pursuant to Pennsylvania Rules of Civil Procedure 238, Attorneys fees, lawful interest, costs and such other relief the Court deems just and appropriate. Defendant KLLM Transport Services, Inc., was guilty of negligence, carelessness and/or recklessness in the following particular respects: (a) Defendant negligently entrusted the motor vehicle in question to Angela Westfall, who is known or should have been known to Defendant as having a propensity for negligent operation of a 4 , ,'= ,;f~j.i motor vehicle; (b) Defendant negligently entrusted the motor vehicle in question to Defendant Angela Westfall, who was known or should have been known to Defendant as having been inexperienced, under- experienced or untrained in the operation of the motor vehicle under the circumstances relevant herein; (c) Defendant failed to maintain adequately the vehicle in question; and (d) Defendant failed to use due care in testing, training or monitoring Defendant Angela Westfal!. The vehicle operated by Defendant Westfall was equipped with daylight running headlights, which she could not turn off if the engine was operating. 11. Denied as stated. Plaintiff Charles Villareale approached Defendant Westfall and began screaming and yelling at her with respect to her headlights, and she informed him that they were daylight running headlights she could not turn off. Plaintiff Charles Villareale continued to become more agitated and screamed and yelled at Defendant Westfall to either move her vehicle or turn it off, at which point in time she attempted to move it. 12. Denied. Defendant Westfall did not negligently or recklessly move her vehicle; however, she did attempt to move it as previously stated. 13. Denied. After reasonable investigation, Defendant Westfall is without knowledge as to the truth or veracity of this averment, and strict proof thereof is demanded. 14. Denied. The accident was not caused by the negligence of Defendant Westfall, but rather by the contributory negligence of Plaintiff Charles Villareale. As to the extent of any injury, which he claims to have received, after reasonable investigation, Defendant Westfall is unable to determine the extent thereof, and strict proof is demanded. 15. His entire physical exam was within normal limits except for his right leg, which showed I + edema, and a small abrasion, which he stated, was due to a hit and run injury. He was able to ambulate without difficulty. A x-rayon 9/12/98 showed a normal right tibia and fibula. Chest x-ray impression was negative chest with dextroscoliosis of the dorsal spine. An electrocardiogram on 9/12/98 summary Was normal sinus rhythm, within normal limits. Blood tests on the same day showed cholesterol 229. These [mdings were discussed with the patient on 9/21/1998. The case was listed for arbitration and an arbitration hearing was held on June 13, 2001. 4. At the conclusion of the arbitration hearing, a verdict was rendered in favor of the Plaintiffs and against the Defendants in the sum of $1,500.00 plus costs and interest at the legal rate from 06/26/2000. 5. A Notice of Appeal was filed by the Defendants on June 25, 2001. 6. STATEMENT OF THE CASE On September 11, 1998, Plaintiff Charles Villareale was in the parking lot of the Metroplex Grocery Warehouse in Harriman, New York. Mr. Villareale is a commercial truck driver and he was waiting to unload his freight. At the same time and place, Defendant Angela Westfall, who was employed by and was an agent ofKLLM Transport Services, Inc., was driving a commercial tractor-trailer and attempting to maneuver the tractor-trailer in the parking lot. While Ms. Westfall was maneuvering her tractor-trailer, her headlights were interfering with other tractor-trailer operators who were attempting to dock their trailers. Mr. Villareale approached Ms. Westfall's vehicle and asked her to turn her headlights off or shut off her vehicle so that other drivers could dock their tractor-trailers without interference from Ms. Westfall's headlights. Ms. Westfall became agitated and in a negligent and reckless manner sharply turned her vehicle, accelerated and drove away. While Ms. Westfall was pulling away, the running board of her tractor-trailer struck the right leg of Mr. Villareale causing lacerations, contusions and bruising of his right leg. II. QUESTION PRESENTED Under New York law, does Defendant Angela Westfall become negligent per se when Defendant struck Plaintiff with Defendant's tractor-trailer and Defendant did not give Plaintiff, who was standing close by, any warning that Defendant was going to move her tractor-trailer? III. ARGUMENT A. DEFENDANT ANGELA WESTFALL WAS NEGLIGENT PER SE IN THE OPERATION OF HER TRACTOR-TRAILER AND, THEREFORE, PLAINTIFF IS ENTITLED TO DAMAGES. Section 1146 of the New York Vehicle and Traffic Law provides: "... every driver of a vehicle shall exercise due care to avoid colliding with any . . . pedestrian. . . upon any roadway and shall give warning by sounding the horn when necessary." - Section 1146 invokes a statutory duty upon drivers to exercise due care to avoid colliding with any pedestrian on any roadway. Kane v. US., 189 F.Supp.2d 40 (S.D.N.Y. 2002). Under New York law, due care is that care which is exercised by reasonably prudent <bivers. Id. 2 ., ~H--, .. "_ '", . Here, Defendant Angela Westfall did not act as a reasonably prudent driver in the operation of her tractor-trailer. A motorist has a duty to keep a reasonably vigilant lookout for pedestrians, to sound their horn when a reasonably prudent person would do so to warn a pedestrian of danger and to operate their vehicle with reasonable care to avoid colliding with a pedestrian on the roadway. Merrill v. State, 442 N.Y.S.2d 352, 110 Misc.2d 260 (N.Y. Ct. Cl. 1981), affirmed 453 N.Y.S.2d 383,89 A.D.2d 802, affirmed 453 N.Y.S.2d 384, 89 A.D.2d 802. Here, Defendant breached her duty to act as a reasonably prudent driver when Defendant did not attempt to avoid striking Plaintiff with her tractor-trailer. Further, Defendant breached her duty to act as a reasonably pmdent driver when Defendant did not give Plaintiff any warning that she was about to move her tractor-trailer. Under New York law, a violation of a statute that imposes a specific duty constitutes negligence per se. Elliott v. City of New York, 95 N.Y.2d 730, 724 N.Y.S.2d 397,747 N.E.2d 760,153 Ed. Law Rep. 751 (N.Y. 2001). In that Defendant has violated Section 1146 of the New York Vehicle and Traffic Law, Defendant is negligent per se. Even though it is clear that Defendant has violated the above-mentioned statute, Plaintiff is required to establish a causal connection between the violation and injury before liability can attach. Sheehan v. New York, 40 N.Y.2d 496, 387 N.Y.S.2d 92, 354 N.E.2d 832 (N.Y. 1976). Neglect of a duty imposed by statute does not establish negligence, presumptively or otherwise, unless it is shown that obedience to the provision would have obviated the injury. Phass v. MacClenathen, 85 N.Y.S.2d 653, 274 A.D. 535 (N.Y.A.D. 3 Dept. 1948). 3 , ~., . ,', .,,,-," .~, ' < ""'L This may not require the same degree of proximate causal connection that is usually required in the field of negligence. Daggett v. Keshener, 134 N.Y.S.2d 524, 284 A.D. 733 (N.YAD. I Dept. 1954). It is within the permissible scope oflegislation to impose liability for wrongful acts which have a practical or reasonable causal connection with injuries sustained, although the sequence of events would not satisfY the rule of proximate cause in the law of negligence. ld. Thus, when the plaintiff is one of the class intended to be protected by an ordinance, a lesser standard of proof of proximate cause is necessary. Lein v. Czaplinski, 484 N.Y.S.2d 154,106 A.D.2d 723 (N.Y.A.D. 1984). Here, Plaintiff is within the class of persons intended to be protected by Section 1146 of the New York Vehicle and Traffic Law in that this statute was invoked to protect pedestrians and Plaintiff was a pedestrian when Defendant struck Plaintiff with her tractor-trailer. Defendant was the proximate cause of Plaintiffs injuries in that Defendant did not attempt to avoid striking Plaintiff nor did Defendant warn Plaintiff that she was about to move her tractor-trailer. If Defendant had complied with the above-mentioned statute, Plaintiffs injury would have been avoided. As the direct and proximate result of the negligence per se of Defendant, Plaintiff sustained a laceration and bruising to his right leg, medical expenses, and lost wages. In addition, Plaintiff Cindy Villareale was deprived ofthe care, companionship, consortiwn and society of her husband Charles Villareale. R DEFENDANT KLLM TRANSPORT IS VICARIOUSLY LIABLE FOR THE NEGLIGENCE PER SE OF. DEFENDANT ANGELA WESTFALL IN THAT ANGELA WESTFALL WAS ACTING WITHIN THE 4 '", '"'" SCOPE OF HER EMPLOYMENT AT THE TIME OF THE INSTANT INCIDENT. As a general rule, employers are held vicariously liable for their employees' torts only to the extent that the underlying acts are within the scope of the employment. Defendant was acting within the scope of her employment when the instant incident occurred. Defendant was operating a KLLM tractor-trailer while waiting to dock the tractor-trailer to unload freight. This act is one commonly done by a KLLM Transport employee and an act that Defendant KLLM Transport could reasonably anticipate. As such, Defendant was acting within the scope of her employment and Defendant KLLM Transport is vicariously responsible for the acts of Defendant Angela Westfall. IV. It is noted that the parties have raised the possibility of stipulating that the law of Pennsylvania would apply to this cause of action. Briefs and proposed jury instructions are due by close of business on July 1, 2002. Parties estimate this case will take one half day to try. There are no scheduling conflicts. However, the defendant will be traveling to Pennsylvania from Michigan, and would like a date certain for the commencement of trial. This appears to be a likely candidate to start the trial week in one of the courtrooms. Settlement discussions are ongoing.
