NOW THIS AGREEMENT WITNESSETH: That Contractor for and in consideration of the
awarding to him by Owner of said contract as aforesaid, as well as the further consideration of One ($1.00)
Dollar to him paid at or before the ensealing and delivery of these presents, the receipt whereof is hereby
acknowledged, does hereby covenant, promise and agree that no mechanics' lien or claim or other lien or
claim of any kind whatsoever shall be filed against the said building or buildings or the curtilage or curtilages
appurtenant thereto, by Contractor or by any sub-contractor, materialmen or laborers for work done or
materials furnishe<J, under said contract for and about said building or buildings or any part thereof, or on
credit thereof, and that all sub-contractors, materialmen, and laborers on said work shall look to and hold
Contractor personally liable for all sub-contracts, materials furnished and work and labor done, so that
there shall not be any legal or lawful claim of any kind whatever against Owner for any work done or
labor or materials furnished under said contract for and ahout the erection, constructiOll and completion
of said buildings as aforesaid, or under any contracts for extra work, or for work supplemental thereto,
or otherwise
AND, in order to give the Owner full power and authority to protect himself and the lot or lots of
ground against any and all Claims filed by the Contractor or anyone acting under or through him or it in
violation of the foregoing covenant, the said Contractor for himself, themselves, itself, hereby irrevocably
authorizes .and empowers any Attorney of any Court of Common Pleas of the Commonwealth of Penn-
sylvania, to appear for him, them, it, Or any of them, in any of the said Courts of Common Pleas as
Attorney for him, them or it and in his, their, its, name, mark satisfied of record at the cost and expense
of the Contractor or of any Sub-Contractor dr Materialman, or Materialmen, any and all claims or claim,
lien or Iien.s, filed by or for the Contractor, or any Sub-Contractor or Materialman, or in his or their name
against said building or buildings, lot or lots of ground or any part thereof and for such act or acts this
shall be good and sufficient warrant and authority, and a reference to the Court, Term and Number in
which" and where this Agreement shall have been filed shall be a sufficient exhibit of the authority herein
contained to warrant such action, and the Contractor for himself, themselves, itself, do hereby remise, release
and quit-claim all rights and all manner of errors, defects and imperfections whatsoever in entering such
satisfaction or in anywise touching or concerning the same.

ALL THAT CERTAIN lot or tract of land situate in Hampden Township, Cumberland
County, Commonwealth of Pennsylvania, more particularly bounded and described as
follows, to wi't:
BEGINNING at a point on the Southern dedicated right-of-way line of Falkstone
Drive, said point being on the dividing line of Lots #496 and #493 of Highlands
of Hampden Square, Phase VII; THENCE by line of Lot #496 South 32 degrees 04
minutes 26 seconds East 44.70 feet to a pin; THENCE by Lots #495 and #494 of
Highlands of Hampden square, Phase V, recorded in Plan Book 69, Page 113, in the
Office of the Recorder of Deeds of Cumberland County, South 45 degrees 27
minutes 55 seconds West 243.91 feet to a pin; THENCE by Lot #492 of Highlands of
Hampden Square, Phase V, South 21 degrees 19 minutes 01 seconds West 43.70 feet
to a pin; THENCE by Lot #470 of Highlands of Hampden Square, Phase V, North 68
degrees 40 minutes 59 seconds West 96.03 feet to a point; THENCE by lands now or
formerly of Kingswood North 14 degrees 10 minutes 46 seconds East 107.16 feet to
a pin; THENCE by the same North 75 degrees 32 minutes 05 seconds West 15.77 feet
to a pin; THENCE continuing by the same North 13 degrees 53 minutes 42 seconds
East 110.00 feet to a point on the Southern dedicated right-of-way line of
Falkstone Drive; THENCE by tbe Southern dedicated right-of-way line of Falkstone
Drive South 75 degrees 30 minutes 58 seconds East 84.06 feet to a point; THENCE
by the same by a curve to the left having a radius of 175.00 feet and an arc
length of 142.20 feet to a point, the place of beginning.
CONTAINING 37,761 square feet.
BEING Lot #493 as shown on the Final Subdivision Plan of Highlands of Hampden
Square, Phase VII, recorded in the Cumberland County Office of the Recorder of
Deeds in Plan Book 80, Page 56.
AND BEING SUBJECT to certain wetlands restrictions as shown on the above
mentioned Subdivision Plan.
AND ALSO BEING SUBJECT to certain drainage easements as shown on a revised
Easement Plan prepared by ACT ONE Consultants, Inc., dated June 17, 2000, and
more fully described in proposed deed.
BEING PART OF THE SAME PREMISES which South Central Service Corporation, by
Indenture dated April 2, 1993 and recorded at Carlisle in the County of
Cumberland on April 3, 1993 in Deed Book 36-F, Page 154, granted and conveyed
unto Highlands of Hampden Square, a Pennsylvania partnership, in fee.
