1. Ladies and gentlemen of the jury, based on the evidence and law in this case, I hereby

2. The legal term negligence, otherwise known as carelessness, is the absence of ordinary
care which a reasonably prudent person would exercise in the circumstances here presented.
Negligent conduct may consist either of an act or an omission to act when there is a duty to do so.
In other words, negligence is the failure to do something which a reasonably careful person would
do, or the doing of something which a reasonably careful person would not do, in light of all the
surrounding circumstances established by the evidence in this case. It is for you to determine how a
reasonably careful person would act in those circumstances.
Pa. SSJI (Civ) 3.01; Archer v. Pennsylvania R.R. Co" 166 Pa. Super. 538, 72 A.2d 609 (l950);
Fisher v. Strader, 399 Pa. 222, 160 A.2d 203 (1960); Vaughn v. Philadelphia Transo. Co., 417 Pa.

3. Ordinary care is the care a reasonably careful person would use under the circumstances
presented in this case. It is the duty of every person to use ordinary care not only for his own safety
and the protection of his property, but also to avoid injury to others. What constitutes ordinary care
varies according to the particular circumstances and conditions existing then and there. The amount
of care required by the law must be in keeping with the degree of danger involved.

4. An Act of Assembly of this Commonwealth, in effect at the time this accident
occurred, provided in part:
(b) Duties at stop signs.--Except when directed to proceed by a police
officer or appropriately attired persons authorized to direct, control or regulate
traffic, every driver of a vehicle approaching a stop sign shall stop at a clearly
marked stop line or, if none, before entering a crosswalk on the near side. of the
intersection or, if none, then at the point nearest the intersecting roadway where the
driver has a view of approaching traffic on the intersecting roadway before entering.
After having stopped, the driver shall yield the right-of-way to any pedestrian in a
crosswalk or to any vehicle in the intersection or approaching on another roadway so
closely as to constitute a hazard during the time when the driver is moving across or
within the intersection or junction of roadways.
This Act dictates the duty of care required of someone in the same situation as the
Defendant. If you find that there was a violation of this Act, you must find the Defendant negligent
as a matter of law. However, before you answer the question of Defendant's liability, you must
determine whether this negligence was a substantial factor in bringing about Plaintiff's injury.

8. In order for the Plaintiff to recover in this case, the Defendant's negligent/reckless
conduct must have been a substantial factor in bringing about the accident. This is what the law
recognizes as legal cause. A substantial factor is an actual, real factor, although the result may be
unusual or unexpected, but is not an imaginary or fanciful factor or a factor having no connection or
only an insignificant connection with the accident.

9. In civil cases such as this one, the Plaintiff has the burden of proving those contentions
which entitle her to relief.
When a party has the burden of proof on a particular issue, his contention on that issue must
be established by a fair preponderance of the evidence. The evidence establishes a contention by a
fair preponderance of the evidence if you are persuaded that it is more probably accurate and true
than not.
To put it another way, think, if you will, of an ordinary balance scale, with a pan on each
side. Onto one side of the scale, place all of the evidence favorable to the Plaintiff; onto the other,
place all of the evidence favorable to the Defendant. If, after considering the comparable weight of
the evidence, you feel that the scales tip, ever so slightly or to the slightest degree, in favor of the
Plaintiff, your verdict must be for the Plaintiff. If the scales tip in favor of the Defendant, or are
equally balanced, your verdict must be for the Defendant.
In this case, the Plaintiff has the burden of proving the following propositions: that the
Defendant was negligent, and that that negligence was a substantial factor in bringing about the
accident. If, after considering all of the evidence, you feel persuaded that these propositions are
more probably true than not true, your verdict must be for the Plaintiff. Otherwise, your verdict
should be for the Defendant.

10. You will recall that Drs. Gamber, Renyo, and Campana gave testimony of their
qualifications as an expert in the field of chiropractic and Dr. Ellenberger gave his qualification as
an expert in the field of neurology.
A witness who has special knowledge, skill, experience, training or education in a particular
science, profession or occupation may give his/her opinion as an expert as to any matter in which he
is skilled. In determining the weight to be given to his/her opinion, you should consider the
qualifications and reliability of the expert and the reasons given for his/her opinion. You are not
bound by an expert's opinion merely because he is an expert; you may accept or reject it, as in the
case of other witnesses. Give it the weight, if any, to which you deem it entitled.

11. In general, the opinion of an expert has value only when you accept the facts upon

12. The number of witnesses offered by one side or the other does not, in itself, determine
the weight of the evidence. It is a factor, but only one of many factors which you should consider.
Whether the witnesses appear to be biased or unbiased; whether they are interested or disinterested
persons, are among the important factors which go to the reliability of their testimony. The
important thing is the quality of the testimony of each witness. In short, the test is not which side
brings the greater number of witnesses or presents the greater quantity of evidence; but which
witness or witnesses, and which evidence, you consider most worthy of belief. Even the testimony
of one witness may out weigh that of many, if you have reason to believe his testimony in
preference to theirs. Obviously, however, where the testimony of the witnesses appear to you to be
of the same quality, the weight of numbers assumes particular significance.

the Plaintiff's medical bills were paid by Plaintiff's automobile insurance company and are not
recoverable in this action. The medical bills that have been received into evidence represent those
bills which have not been paid from this other source. If you award damages to the Plaintiff and
you find that the medical bills received into evidence were the proximate result of the injuries
sustained by the Plaintiff and were reasonable and necessary, you should award the amount of those
bills to the Plaintiff. However, you may consider all of the medical services performed in
determining the extent of the Plaintiff's pain and suffering and other non-economic damages,
whether or not the bills for those particular services have been placed in evidence.

[I)t is immaterial that the plaintiff would not have worked during the period of

5. You may find inconsistencies in the evidence. Even
actual contradictions in the testimony of witnesses do not
necessarily mean that any witness has been wilfully false. Poor
memory is not uncommon. Sometimes a witness forgets; sometimes
he remembers incorrectly. It is also true that two persons
witnessing an accident may see or hear it differently.
If different parts of the testimony of any witness or
witnesses appear to be inconsistent, you, the jury should try to
reconcile the conflicting statements, whether or the same or of
different witnesses, and you should do it if it can be done
fairly and satisfactorily.
If, however, you decide that there is a genuine and
irreconcilable conflict of testimony, it is your function and
duty to determine which, if any, of the contradictory statements
you will believe.

7. In order for the Plaintiff to recover in this case, the
Defendant's conduct must have been a substantial factor in
bringing about the injuries the Plaintiff is claiming. This is
what the law recognizes as a legal cause. A substantial factor
is an actual, real factor, although the result may be unusual or
unexpected, but is not an imaginary or fanciful factor or a
factor having no connection or only an insignificant connection
with the accident.

11. You have heard testimony from witnesses that are
considered experts. A witness who has special knowledge, skill,
experience, training or education in a particular science,
profession or occupation may give his opinion as an expert as to
any matter in which he is skilled. In determining the weight to
be given to his opinion, you should consider the qualifications

14. The Plaintiff has the burden of proving every element
of her case, including damages which flowed from the alleged
accident. In order to sufficiently prove the damage element of
his case, the Plaintiff must introduce sufficient facts so that
you can arrive at an intelligent estimate of damages without
speculation or conjecture. Failure by the Plaintiff to place
into evidence all the necessary elements for an accurate
determination of damages is fatal to her case, and damages may
not be awarded as to those claims made by Plaintiff for which she

party to a lawsuit is vitally interested in the jury's verdict,

16. The number of witnesses offered by one side or the
other does not, in itself, determine the weight of the evidence.
It is a factor, but only one of the many factors which you should
consider. Whether the witnesses appear to be biased or unbiased;
whether they are interested or disinterested persons, are among
the important factors which can go to the reliability of their
testimony. The important thing is the quality of the testimony
of each witness. In short, the test is not which side has the

evidence, but rather which witness or witnesses and which
evidence you consider most worthy of belief. Pressler v.

CIVIL ACTION - LAW

JURY TRIAL DEMANDED
PLAINTIFFS' PRETRIAL MEMORANDUM
1. Statement of the Case
This case arises out of a motor vehicle accident which occurred on August 28, 1998 at
approximately 1:31 p.m. at the intersection of St. Johns Church Road and Gettysburg Road in
Lower Allen Township, Cumberland County, Pennsylvania. At that time, Plaintiff Tina Derr was
operating a 1996 Pontiac Grand Am westbound on Gettysburg Road, which is a through highway at
the intersection. Defendant Barbara Thumma was operating a 1996 Dodge Caravan and had
stopped facing southbound at a stop sign on St. John's Road.
Almost immediately before Plaintiff Tina Derr entered into the intersection, Defendant
Thumma proceeded into the intersection directly into Tina Derr's path resulting in a collision in
Plaintiff Tina Derr's lane of travel. As a result of the impact, Plaintiff Tina Derr was thrown
forward within her car suffering personal injuries set forth hereinafter.
Plaintiff Tina Derr maintains that Defendant Thumma was negligent in failing to yield the
right-of-way and proceeding in an intersection after stopping or failing to properly stop and
proceeding directly into her path while she was travelling below the posted speed limit in a through
lane of travel.

II. Tvnes and Amounts of Damages Claimed
Plaintiff Tina Derr suffered primarily soft tissue injuries as a result of the accident including
a sprain to her left knee as well as to her neck and low back. Although she did not initially seek
treatment at the scene, shortly after the accident, she followed up at the emergency room at Seidel
Memorial Hospital where she was diagnosed with a left knee contusion and strain and a left cervical
muscle strain. Plaintiff Tina Derr initially followed up with a chiropractor by the name of Dr.
Matthew Gamber who also diagnosed it as a strain of the neck, low back, and left knee. She was
referred to Dr. Jason Litton at Orthopedic Institute by Dr. Gamber who also confinned a contusion
to her left patellofemoral joint. Tina Derr continued to treat with Dr. Gamber for approximately
four months, and when she did not have any significant improvement, switched her treatment to
Dillsburg Chiropractic in January of 1999.
Tina Derr treated with Dr. Renyo at Dillsburg Chiropractic until August of 2000 when Dr.
Renyo became medically on disabled. His practice was taken over by Dr. Jasper Campana. Tina
Derr has treated with Dr. Campana through November, 2001. Plaintiff Tina Derr's condition has
waxed and waned but she has continued to have chronic symptoms with respect to her neck, low
back, and left knee.
Plaintiff Tina Derr seeks to recover for pain and suffering and loss of enjoyment of life,
inconvenience in carrying out her daily activities because she continued to have restrictions as a
result of injuries sustained in the motor vehicle accident. Her husband, Ronald Derr, has a claim for
loss of consortium. Plaintiff has unpaid medical bills incurred after her first-party automobile
coverage exhausted. Plaintiff maintains that these unpaid bills, as reflected in the bill sununary

CIVIL ACTION - LAW
vs.

BARBARA THUMMA,
Defendant
IN RE: PRETRIAL CONFERENCE
Presentat a pretrial conference held this date were Richard Sadlock, Esquire, attorney for
the plaintiffs, and Jefferson 1. Shipman, Esquire, attorney for the defendant.
This case arises out of an intersection accident that occurred on August 28, 1998.
Michael E. Kosik will be trying the case on behalf of the plaintiffs.
This is not a complicated case and should take no more than two days to try. Mr.
Shipman, however, will be in federal court on November 4th and has asked that this case not
commence prior to November 5, 2002. While not desirable, it is possible that someone else from
Mr. Shipman's office could pick a jury on November 4th.

At the pretrial conference, counsel for the plaintiff made a motion to continue the case
indicating that the plaintiff had not anticipated that the case would be scheduled for trial as
quickly after filing and that she has just begun medical treatment which she believes will impact
upon her case. This matter will be continued generally, the matter to be relisted by counsel. The

receiving correspondence indicating the case had been listed for trial and trial would take place the

8. Plaintiff Tina Derr indicated that she was surprised that the case would come to trial this
quickly after the listing and indicated that she wanted the case to be continued.

it will have any impact upon her claim.

15. Plaintiff Tina Derr believes that a continuance at this time would not adversely affect
the Defendant's especially given the fact that defense counsel is likely to be attached in other
cases within Cumberland County at least until later in the trial week.
16. Plaintiff Tina Derr would like to have her treating chiropractor Clifford Renyo testify
live at trial, and if the case does not get called until late in the week, this would not be possible.
WHEREFORE, Plaintiff Tina and Ronald Derr request this Honorable Court to grant a
continuance from the September 9 trial term with either party being permitted to relist the case
for trial.

II. Tvoes and Amounts of Damages Claimed
Gamber for approximately
four months, and when she did not have any significant improvement, switched her treatment to
Dillsburg Chiropractic in Jannary of 1999.
Tina Derr treated with Dr. Renyo at Dillsburg Chiropractic until July of 2000 when Dr.
Renyo became medically on disabled. His practice was taken over by Dr. Jasper Campana. Tina
Derr has treated with Dr. Campana through the present time.
Plaintiff maintains that these unpaid bills, as reflected in the bill summary

attached as Exhibit A, can be plead and recovered. Plaintiffs have scheduled the deposition of Dr.
Jasper Campana but plan to have Dr. Clifford Renyo testify life at trial. Unfortunately, Dr. Renyo
will not be available for Friday, September 27,2002, and if the case is not started by Wednesday
afternoon, Plaintiffs may need to take Dr. Renyo's deposition so that his testimony will be available
at trial.

VI. Stipulations
Plaintiff's none.
VII. Estimated Length of Trial
Two days.
VIII. Scheduling Problems
Plaintiff Tina Derr has requested a continuance of her case from the September, 2002 term.
Defense counsel, Jeff Shipman, has indicated he would have no objection since he has two other
cases on the list before this case. Plaintiffs will present a formal written request for a continuance at
the time of the Pre-Trial Conference.

TINA DERR and RONALD DERR,
Her Husband,
IN THE COURT OF COMMON PLEAS
CUMBERLAND COUNTY, PENNA.
Plaintiff
v.
CIVIL ACTION - LAW
BARBARA THUMMA,
Defendant
NO. 00-5300
JURY TRIAL DEMANDED
PLAINTIFFS' REPLY TO DEFENDANT'S NEW MATTER
22. Denied. lbis averment is a conclusion of law to which no responsive pleading is
required. To the extent that a response may be deemed proper, it is specifically denied that Plaintiff
Tina Derr was negligent in any manner upon the cause of action stated in Plaintiffs' Complaint, and
therefore, it is denied that the Pennsylvania Comparative Negligence Act is in any way applicable to
Plaintiffs' claim. By way of further answer, Plaintiff Tina Derr avers that she was travelling below
the posted speed limit on a through highway when the Defendant failed to stop at a stop sign and
pulled directly into her path presenting her with a sudden emergency and no opportunity to avoid
the accident. As set forth in Plaintiffs' Complaint, Defendant Barbara ThlUlla was solely
responsible for this accident.
23. Denied. lbis averment is a conclusory statement unsupported by any factual
averments to which no further response is required. To the extent that further response may be
deemed proper, it is specifically denied that Tina Derr failed to exercise reasonable care for her own
safety. To the contrary, Plaintiff averred in the Complaint that the accident occurred when Tina
Derr was travelling below the posted speed limit on a through highway and Defendant pulled from a

stop sign without yielding and pulled directly across Plaintiff's path presenting her with a sudden
emergency and no opportunity to avoid the accident.
24. Denied. This averment is a conclusion of law to which no responsive pleading is
required. To the extent that a response may be deemed proper, it is specifically denied that Plaintiff
Tina Derr was negligent in any manner upon the cause of action stated in Plaintiffs' Complaint, and
therefore, it is denied that she was comparatively negligent or failed to exercise reasonable care for
her own safety. The remaining allegations of this paragraph are denied as follows:
(a.) It is specifically denied that Plaintiff Tina Derr failed to maintain control of her
vehicle. To the contrary, it is averred that Plaintiff Tina Derr was in full control of her vehicle at all
times but was presented by a sudden emergency when the Defendant pulled from a stop sign
without yielding and proceeded directly into her path presenting Plaintiff with a sudden emergency
which prevented her from avoiding the accident.
(b) It is specifically denied that Plaintiff Tina Derr failed to drive her vehicle at a safe
speed. To the contrary, it is averred that Plaintiff Tina Derr was travelling below the posted speed
limit on a through highway where no adverse conditions existed and she had no reason to anticipate
the negligence of the Defendant in failing to stop for the stop sign and pulling directly into her path.
(c) It is specifically denied that Plaintiff Tina Derr operated her vehicle without due
regard for the rights, safety, and position of other vehicles on the highway. To the contrary, it is
averred that Plaintiff Tina Derr was operating her vehicle in accordance with the Pennsylvania
Motor Vehicle Code and was travelling below the posted speed limit on a through highway and had

no reason to anticipate that the Defendant would ignore the stop sign and proceed directly into
Plaintiff's path.
(d) It is specifically denied that Plaintiff Tina Derr failed to maintain a proper lookout.
To the contrary, it is averred that at all times Tina Derr was maintaining a proper lookout but was
unable to stop when the Defendant presented her with a sudden emergency by failing to stop at the
stop sign and pulling directly into her path.
(e) It is specifically denied that Plaintiff Tina Derr was travelling too fast for conditions
which existed at the time and place of the accident. To the contrary, it is averred that Plaintiff Tina
Derr was travelling below the posted speed limit and at a speed which was safe for the highway and
weather conditions had the Defendant not failed to yield the right-of-way by proceeding through a
stop sign directly into Plaintiff's path.
(1) It is specifically denied that Plaintiff Tina Derr was inattentive to the conditions then
and there existing. To the contrary, it is averred that Tina Derr was attentive to both the highway
and traffic conditions but had no duty to anticipate that the Defendant would fail to stop at the stop
sign and pull directly into Plaintiff's path presenting her with a sudden emergency without an
opportunity to avoid the accident.
(g) This is an allegation which is incapable of interpretation since there are no factual
averments on which to base the statement that the turn signal was being used "inappropriately." By
way of further answer, it is specifically denied that Plaintiff Tina Derr was using her turn signal, and
therefore, it is denied that Plaintiff was using her turn signal inappropriately.
219349.1IMEKIMMM
25. Denied. This averment is a conclusion of law to which no responsive pleading is
required. To the extent that a response may be deemed proper, it is specifically denied that Plaintiff
Tina Derr failed to exercise reasonable care for her own safety and, therefore, it is denied that her
conduct was in any way a contributing or substantial contributing factor to the happening of the
accident.
26. Denied. This averment is a conclusory statement unsupported by any factual
statements. By way of further response, Plaintiff specifically denies that her injuries and damages
were not the result of the acts, omissions, and breach of duty by the Defendant. To the contrary,
Plaintiff avers that Defendant was the direct and sole cause of her injuries and damages as set forth
in Plaintiffs' Complaint.
27. Denied. This averment is a conclusion of law to which no responsive pleading is
required. To the extent that a response may be deemed proper, it is specifically denied that the
defense of voluntary assumption of the risk is any way applicable to a motor vehicle intersectional
collision. It is further denied that Plaintiff either knowingly or voluntarily assumed the risk of
injuries resulting from the Defendant's failure to stop at a stop sign and pull directly into Plaintiff s
path while presenting Plaintiff with a sudden emergency for which she could not avoid.
28. Denied. This averment is a conclusion of law to which no responsive pleading is
required. To the extent that a response may be deemed proper, it is specifically denied that any of
the damages that the Plaintiff seeks to recover in her Complaint are limited by the provisions of the
Pennsylvania Motor Vehicle Financial Responsibility Law, (sic) 75 Pa.C.SA S 1701, et. seq.

29. Denied. lbis averment is a conclusion of law to which no responsive pleading is
required. To the extent that a response may be deemed proper, it is specifically denied that Plaintiff
Tina Derr is limited or barred by the "limited tort" option pursuant to 75 Pa.C.S.A. S 1705. To the
contrary, it is averred that all times Plaintiff Tina Derr maintained a policy with full tort coverage
and that her injuries have resulted in serious impairment of her bodily fimctions.
(29.sic)Denied. This averment is a conclusory statement unsupported by any factual
statements and, therefore, no further response is required. To the extent that further response may
be deemed proper, it is specifically denied that the accident and Plaintiff's resulting injuries were
caused by the negligence of any unidentified third party or entities not presently involved in this
action. To the contrary, it is averred that all of Plaintiff's injuries and damages were the direct and
proximate result of the negligence of the Defendant.
30. Denied. lbis averment is a conclusion of law to which no responsive pleading is
required. To the extent that a response may be deemed proper, it is specifically denied that
Defendant's negligence was not the proximate cause of Plaintiff's damages and injuries. To the
contrary, it is averred that all of Plaintiff Tina Derr's injuries and damages are a direct and
proximate result of the negligence of the Defendant as set forth in Plaintiffs' Complaint.
31. Denied. lbis averment is a conclusion of law to which no responsive pleading is
required. To the extent that a response may be deemed proper, it is specifically denied that the
accident occurred as a result of an intervening or superseding cause. To the contrary, it is averred
that the accident occurred as a result of the negligence of the Defendant in failing to stop for a stop

through highway below 1he posted speed limit.
32. Denied. This averment is a conclusion of law to which no responsive pleading is
required. To 1he extent that a response may be deemed proper, it is specifically denied 1hat 1he
accident was caused by a sudden emergency effecting Defendant Thuma's actions. To the
contrary, it is averred 1hat 1he accident occurred because of 1he negligence of 1he Defendant in
failing to stop at 1he stop sign and proceeding directly into Plaintiff's pa1h. It is admitted 1hat when
1he Defendant proceeded in 1he Plaintiffs pa1h, Plaintiff was proceeding below 1he posted speed
limit on a through highway and that Plaintiff was presented wi1h a sudden emergency created by 1he
Defendant's negligent conduct 1hereby preventing Plaintiff from avoiding 1he accident.
33. Denied. This averment is a mixed conclusion oflaw and law to which no responsive
pleading is required. To 1he extent 1hat a response may be deemed proper, it is specifically denied

1hat the accident was unavoidable as far as Defendant Thuma's actions are concerned. To the
contrary, it is averred that Defendant failed to yield for 1he stop sign posted at 1he intersection in the
direction that she was travelling. Defendant pulled directly into 1he pa1h of Plaintiff, while Plaintiff
was proceeding below 1he posted speed limit on a through highway, creating a sudden emergency
Ii for Plaintiff Tina Derr and making 1he accident unavoidable as far as Tina Derr was concerned.

BARBARA THUMMA,

IN RE: PRETRIAL CONFERENCE
Present at a pretrial conference held this date were Michael E. Kosik, Esquire, attorney
for the plaintiffs, and Jefferson 1. Shipman, Esquire, attorney for the defendant.
The
attorneys in the matter have discussed the possibility of alternative dispute resolution.
