The legal term negligence, otherwise known as carelessness, is the absence of ordinary care which a reasonably prudent person would exercise in the circumstances here presented. Negligent conduct may consist either of an act or an omission to act when there is a duty to do so. In other words, negligence is the failure to do something which a reasonably careful person would do, or the doing of something which a reasonably careful person would not do, in light of all the surrounding circumstances established by the evidence in this case. It is for you to determine how a reasonably careful person would act in those circumstances. Pa. SSJI (Civ) 3.01; Archer v. Pennsylvania R.R. Co" 166 Pa. Super. 538, 72 A.2d 609 (l950); Fisher v. Ordinary care is the care a reasonably careful person would use under the circumstances presented in this case. It is the duty of every person to use ordinary care not only for his own safety and the protection of his property, but also to avoid injury to others. What constitutes ordinary care varies according to the particular circumstances and conditions existing then and there. The amount of care required by the law must be in keeping with the degree of danger involved. Pa. ssn (Civ) 3.02; Maternia v. Pennsvlvania RR Co., 358 Pa. 149,56 A.2d 233 (1948); Potere v. Philadelphia, 380 Pa. 581, 112 A.2d 100 (1955). C', fQ-'-~'~ . .'((\1 252737.1\MEKIMMM 4. An Act of Assembly of this Commonwealth, in effect at the time this accident occurred, provided in part: (b) Duties at stop signs.--Except when directed to proceed by a police officer or appropriately attired persons authorized to direct, control or regulate traffic, every driver of a vehicle approaching a stop sign shall stop at a clearly marked stop line or, if none, before entering a crosswalk on the near side. of the intersection or, if none, then at the point nearest the intersecting roadway where the driver has a view of approaching traffic on the intersecting roadway before entering. After having stopped, the driver shall yield the right-of-way to any pedestrian in a crosswalk or to any vehicle in the intersection or approaching on another roadway so closely as to constitute a hazard during the time when the driver is moving across or within the intersection or junction of roadways. This Act dictates the duty of care required of someone in the same situation as the Defendant. If you find that there was a violation of this Act, you must find the Defendant negligent as a matter of law. However, before you answer the question of Defendant's liability, you must determine whether this negligence was a substantial factor in bringing about Plaintiff's injury. The operator of a motor vehicle that is planning to enter a through highway from a stop sigh has the duty not only to look both ways, but is charged with seeing what should be visible to her in terms of approaching traffic, and she must yield the right-of-way to approaching traffic. A driver has a duty to maintain a proper lookout and to observe what is occurring in front of her vehicle and approaching on an intersecting street. Lavelvv. Wolot!, 253 Pa. The duty to exercise ordinary care to keep a proper lookout involves not only the duty to look when such looking would be effective, but also the duty to see what an ordinarily prudent person, exercising ordinary care, would have seen under the circumstances then and there existing. Joannides v. Norris, 146 Pa. Super. 488, 23 A.2d 53 (1941); Kmetz v. Lochiatto, 421 Pa. 363,219 A.2d 588 (1966); Frisina v. Dailev. 395 Pa. 280, 150 A.2d 348 (1959); Meyer, Law of Vehicle Negligence in Pennsvlvani!!, ~ 1.46, pp. 66-68 (1970). ...... . ~. ~ ilJ ..', ~"-'~'\ 252737.1\MEKIMMM 8. In order for the Plaintiff to recover in this case, the Defendant's negligent/reckless conduct must have been a substantial factor in bringing about the accident. This is what the law recognizes as legal cause. A substantial factor is an actual, real factor, although the result may be unusual or unexpected, but is not an imaginary or fanciful factor or a factor having no connection or only an insignificant connection with the accident. Pa. ssn (Civ) 3.25; Whitner v. Loieski, 437 Pa. 448, 263 A.2d 889 (1970). ~, 252737.1\MEKIMMM . " '. ..' 9. In civil cases such as this one, the Plaintiff has the burden of proving those contentions which entitle her to relief. When a party has the burden of proof on a particular issue, his contention on that issue must be established by a fair preponderance of the evidence. The evidence establishes a contention by a fair preponderance of the evidence if you are persuaded that it is more probably accurate and true than not. To put it another way, think, if you will, of an ordinary balance scale, with a pan on each side. Onto one side of the scale, place all of the evidence favorable to the Plaintiff; onto the other, place all of the evidence favorable to the Defendant. If, after considering the comparable weight of the evidence, you feel that the scales tip, ever so slightly or to the slightest degree, in favor of the Plaintiff, your verdict must be for the Plaintiff. If the scales tip in favor of the Defendant, or are equally balanced, your verdict must be for the Defendant. In this case, the Plaintiff has the burden of proving the following propositions: that the Defendant was negligent, and that that negligence was a substantial factor in bringing about the accident. If, after considering all of the evidence, you feel persuaded that these propositions are more probably true than not true, your verdict must be for the Plaintiff. Otherwise, your verdict should be for the Defendant. Pa. ssn (Civ) 5.50; Sisk v. Duffy. 201 Pa. Super. 213, 192 A.2d 251 (1963); Reist v. Manwiller, 231 Pa. Super. 444, 332 A.2d 518 (1974). Gamber, Renyo, and Campana gave testimony of their qualifications as an expert in the field of chiropractic and Dr. Ellenberger gave his qualification as an expert in the field of neurology. A witness who has special knowledge, skill, experience, training or education in a particular science, profession or occupation may give his/her opinion as an expert as to any matter in which he is skilled. In determining the weight to be given to his/her opinion, you should consider the qualifications and reliability of the expert and the reasons given for his/her opinion. You are not bound by an expert's opinion merely because he is an expert; you may accept or reject it, as in the case of other witnesses. Give it the weight, if any, to which you deem it entitled. Pa. ssn (Civ) 5.30. ~.~ 252737.l\MEKIMMM 11. In general, the opinion of an expert has value only when you accept the facts upon which it is based. This is true whether the facts are assumed hypothetically by the expert or they come from his/her personal knowledge, from some other proper source, or from some combination of these. Pa. ssn (Civ) 5.31. ~, 252737.1\MEKIMMM . 12. The number of witnesses offered by one side or the other does not, in itself, determine the weight of the evidence. It is a factor, but only one of many factors which you should consider. Whether the witnesses appear to be biased or unbiased; whether they are interested or disinterested persons, are among the important factors which go to the reliability of their testimony. The important thing is the quality of the testimony of each witness. In short, the test is not which side brings the greater number of witnesses or presents the greater quantity of evidence; but which witness or witnesses, and which evidence, you consider most worthy of belief. Even the testimony of one witness may out weigh that of many, if you have reason to believe his testimony in preference to theirs. Obviously, however, where the testimony of the witnesses appear to you to be of the same quality, the weight of numbers assumes particular significance. Pa. ssn (Civ) 5.03. Cr~ 252737.1\MEKIMMM . 13. If you find that the Defendant is liable to the Plaintiff, you must then find an amount of money damages you believe will fairly and adequately compensate the Plaintiff for all the physical and financial injury she has sustained as a result of the accident. The amount you award today must compensate the Plaintiff completely for damage sustained in the past, as well as damage the Plaintiff will sustain in the future. Pa. ssn (Civ) 6.00; Miller v. The damages recoverable by the Plaintiff Tina Derr in this case and the items that go to make them up, each of which I will discuss separately, are as follows: (a) Future medical expenses; (b) Past lost earnings; (c) Past and future pain and suffering; In the event that you fmd in favor of the Plaintiff, you will add these sums of damage together and return your verdict in a single, lump sum. In this case you have heard testimony concerning various medical services provided to the Plaintiff in an effort to bring her back to health. Under Pennsylvania law, a certain portion of ;,c/i',;,,_ ~.'..lIp"",f.i\t'"~' the Plaintiff's medical bills were paid by Plaintiff's automobile insurance company and are not recoverable in this action. The medical bills that have been received into evidence represent those bills which have not been paid from this other source. If you award damages to the Plaintiff and you find that the medical bills received into evidence were the proximate result of the injuries sustained by the Plaintiff and were reasonable and necessary, you should award the amount of those bills to the Plaintiff. However, you may consider all of the medical services performed in determining the extent of the Plaintiff's pain and suffering and other non-economic damages, whether or not the bills for those particular services have been placed in evidence. The Plaintiff is entitled to be compensated for the amount of earnings that she has lost up to the time of the trial as a result of her injuries. This amount is the difference between what she probably could have earned but for the harm and any less sum which he actually earned in any employment. [I)t is immaterial that the plaintiff would not have worked during the period of incapacity if he could have worked. In such case his earning capacity was hurt, whether or not he would have chosen to exercise it and he is entitled to damages measured by the extent to which his capacity for earnings has been reduced. The broad term "pain and suffering" includes a wide range of not only physical, but also emotional reactions to injuries and their consequences. In calculating damage for pain and suffering, you may place a value on the following: (a) Mental pain and distress; (b) Fear; (c) Shock; (d) Emotional suffering; (e) Anxiety; (f) Frustration; (g) Degradation; (h) Loss of the feeling of well-being; and (i) Limitation on activities. The Plaintiff is entitled to be fairly and adequately compensated for such physical pain, mental anguish, discomfort, inconvenience and distress as you believe she will endure in the future as a result of her injuries. If you find that the Plaintiff's injuries will continue beyond today, you must determine the life expectancy of the Plaintiff. According to statistics compiled by the United States Department of Health, Education and Welfare, the average life expectancy of all persons of the Plaintiff's age at the time of accident, sex and race was 43.8 years. This figure is offered to you only as a guide, and you are not bound to accept it if you believe that the Plaintiff would have lived longer or less than the average individual in her category. In reaching this decision you are to consider the Plaintiff's health prior to the accident, her manner of living, her personal habits and other factors that may have affected the duration of her life. Sometimes a witness forgets; sometimes he remembers incorrectly. It is also true that two persons witnessing an accident may see or hear it differently. If different parts of the testimony of any witness or witnesses appear to be inconsistent, you, the jury should try to reconcile the conflicting statements, whether or the same or of different witnesses, and you should do it if it can be done fairly and satisfactorily. If, however, you decide that there is a genuine and irreconcilable conflict of testimony, it is your function and duty to determine which, if any, of the contradictory statements you will believe. Statement of the Case This case arises out of a motor vehicle accident which occurred on August 28, 1998 at approximately 1:31 p.m. at the intersection of St. Johns Church Road and Gettysburg Road in Lower Allen Township, Cumberland County, Pennsylvania. At that time, Plaintiff Tina Derr was operating a 1996 Pontiac Grand Am westbound on Gettysburg Road, which is a through highway at the intersection. Defendant Barbara Thumma was operating a 1996 Dodge Caravan and had stopped facing southbound at a stop sign on St. John's Road. Almost immediately before Plaintiff Tina Derr entered into the intersection, Defendant Thumma proceeded into the intersection directly into Tina Derr's path resulting in a collision in Plaintiff Tina Derr's lane of travel. As a result of the impact, Plaintiff Tina Derr was thrown forward within her car suffering personal injuries set forth hereinafter. Plaintiff Tina Derr maintains that Defendant Thumma was negligent in failing to yield the right-of-way and proceeding in an intersection after stopping or failing to properly stop and proceeding directly into her path while she was travelling below the posted speed limit in a through lane of travel. 249473,l\MEKIMMM ....'.,.c . II. Tvnes and Amounts of Damages Claimed Plaintiff Tina Derr suffered primarily soft tissue injuries as a result of the accident including a sprain to her left knee as well as to her neck and low back. Although she did not initially seek treatment at the scene, shortly after the accident, she followed up at the emergency room at Seidel Memorial Hospital where she was diagnosed with a left knee contusion and strain and a left cervical muscle strain. Plaintiff Tina Derr initially followed up with a chiropractor by the name of Dr. Matthew Gamber who also diagnosed it as a strain of the neck, low back, and left knee. She was referred to Dr. Jason Litton at Orthopedic Institute by Dr. Gamber who also confinned a contusion to her left patellofemoral joint. Tina Derr continued to treat with Dr. Gamber for approximately four months, and when she did not have any significant improvement, switched her treatment to Dillsburg Chiropractic in January of 1999. Tina Derr treated with Dr. Renyo at Dillsburg Chiropractic until August of 2000 when Dr. Renyo became medically on disabled. His practice was taken over by Dr. Jasper Campana. Tina Derr has treated with Dr. Campana through November, 2001. Plaintiff Tina Derr's condition has waxed and waned but she has continued to have chronic symptoms with respect to her neck, low back, and left knee. Plaintiff Tina Derr seeks to recover for pain and suffering and loss of enjoyment of life, inconvenience in carrying out her daily activities because she continued to have restrictions as a result of injuries sustained in the motor vehicle accident. Her husband, Ronald Derr, has a claim for loss of consortium. Plaintiff has unpaid medical bills incurred after her first-party automobile coverage exhausted. Plaintiffs' initiated a civil action against the Defendant arising out of a motor vehicle accident on August 28, 1998. 4. Suit was filed on July 27,2000 when the case could not be settled with the Defendant's msurance company. 5. Plaintiffs through their counsel exchanged discovery with the Defendants and depositions of the parties were completed on January 19, 2001. 6. On August 14, 2002, Plaintiff Tina Derr contacted Plaintiffs' counsel's office after receiving correspondence indicating the case had been listed for trial and trial would take place the week of September 9, 2002. 8. Plaintiff Tina Derr indicated that she was surprised that the case would come to trial this quickly after the listing and indicated that she wanted the case to be continued. 9. Plaintiffs' counsel spoke with Tina Derr on August 15,2002 and advised her that in addition to obtaining the consent of defense counsel, Plaintiffs would have to provide the Court with a good reason for requesting a continuance. 10. Plaintiff Tina Derr indicated that she had not anticipated that the case would be scheduled for trial as quickly after filing a Certificate of Readiness and that she had just begun medical treatment which she thought might impact upon her case. II. Plaintiffs counsel spoke with Attomey Jeff Shipman, counsel for the Defendant, Barbara Thununa, who indicated that he had no objection to Plaintiff seeking a continuance from the court. 12. Defense counsel indicated that he had two other cases on the trial list in Cumberland County for the same week. 13. As indicated in Plaintiffs' Pre-Trial Memorandum, one of Plaintiff's treating chiropractic physicians is not available later in the week of September 23. 14. Plaintiff Tina Derr believes that the delay of her case at least one trial term will provide her with the opportunity to complete her medical treatment or at least determine whether it will have any impact upon her claim. Statement of the Case This case arises out of a motor vehicle accident which occurred on August 28, 1998 at approximately 1:31 p.m. at the intersection of St. Johns Church Road and Gettysburg Road in Lower Allen Township, Cumberland County, Pennsylvania. At that time, Plaintiff Tina Derr was operating a 1996 Pontiac Grand Am westbound on Gettysburg Road, which is a through highway at the intersection. Defendant Barbara Thumma was operating a 1996 Dodge Caravan and had stopped facing southbound at a stop sign on St. John's Road. Almost immediately before Plaintiff Tina Derr entered into the intersection, Defendant Thumma proceeded into the intersection directly into Tina Derr's path resulting in a collision in Plaintiff Tina Derr's lane of travel. As a result of the impact, Plaintiff Tina Derr was thrown forward within her car suffering personal injuries set forth hereinafter. Plaintiff Tina Derr maintains that Defendant Thumma was negligent in failing to yield the right-of-way and proceeding in an intersection after stopping or failing to properly stop and proceeding directly into her path while she was travelling below the posted speed limit in a through lane of travel. Tvoes and Amounts of Damages Claimed Plaintiff Tina Derr suffered primarily soft tissue injuries as a result of the accident including a sprain to her left knee as well as to her neck and low back. Although she did not initially seek treatment at the scene, shortly after the accident, she followed up at the emergency room at Seidel Memorial Hospital where she was diagnosed with a left knee contusion and strain and a left cervical muscle strain. Plaintiff Tina Derr initially followed up with a chiropractor by the name of Dr. Matthew Gamber who also diagnosed it as a strain of the neck, low back, and left knee. She was referred to Dr. Jason Litton at Orthopedic Institute by Dr. Gamber who also confinned a contusion to her left patellofemoral joint. Tina Derr continued to treat with Dr. Gamber for approximately four months, and when she did not have any significant improvement, switched her treatment to Dillsburg Chiropractic in Jannary of 1999. Tina Derr treated with Dr. Renyo at Dillsburg Chiropractic until July of 2000 when Dr. Renyo became medically on disabled. His practice was taken over by Dr. Jasper Campana. Tina Derr has treated with Dr. Campana through the present time. Plaintiff Tina Derr's condition has waxed and waned but she has continued to have chronic symptoms with respect to her neck, low back, and left knee. Plaintiff Tina Derr seeks to recover for pain and suffering and loss of enjoyment of life, inconvenience in carrying out her daily activities because she continued to have restrictions as a result of injuries sustained in the motor vehicle accident. Her husband, Ronald Derr, has a claim for loss of consortium. Plaintiff has unpaid medical bills incurred after her first-party automobile coverage exhausted. Plaintiff maintains that these unpaid bills, as reflected in the bill summary 249473.1\MEKIMMM II Ii attached as Exhibit A, can be plead and recovered. Plaintiffs have scheduled the deposition of Dr. Jasper Campana but plan to have Dr. Clifford Renyo testify life at trial. Unfortunately, Dr. Renyo will not be available for Friday, September 27,2002, and if the case is not started by Wednesday afternoon, Plaintiffs may need to take Dr. Renyo's deposition so that his testimony will be available at trial. Plaintiffs Tina and Ronald Derr are citizen of the Commonwealth of Pennsylvania, who resides at 23 Old Mill Road, Dillsburg, York, County, Pennsylvania. 2. Defendant Barbara Thununa is a citizen of the Commonwealth of Pennsylvania, who resides at 207 St. John's Road, Camp Hill, Cumberland County, Pennsylvania. 3. The facts and occurrences hereinafter related took place on or about August 28, 1998, at approximately 1:31 p.m., at St. John's Church Road and Gettysburg Road in Camp Hill, Cumberland County, Pennsylvania. 4. In the area of the accident, Gettysburg Road (SR 2027) is a through highway which travels generally east and west. 5. Plaintiff Tina Derr, operating a 1996 Pontiac Grand-Am, was traveling west on Gettysburg Road, approaching the intersection ofSt. John's Road. 6. At that time and place, Defendant Barbara Thununa, operating a 1996 Dodge Caravan SE, was stopped facing southbound at a stop sign on St. John's Road. 8. At that time and place, Defendant Barbara Thununa proceeded into the intersection directly into the pathway of Plaintiff Tina Derr's car and collided with the front driver's side area. 9. As a result of the impact, Plaintiff Tina Derr was violently thrown within her car. 10. The foregoing accident and all the injuries and damages set forth hereinafter sustained by Plaintiffs Tina and Ronald Derr are the direct and proximate result of the negligent, careless, and reckless manner in which Defendant Barbara Thununa operated her automobile as follows: (a) failure to keep alert and maintain a proper watch for traffic on the roadway; (b) failure to keep alert and maintain a proper watch for the presence/absence of turning signals of other motor vehicles on the roadway; (c) failure to remain stationary at a stop sign until the roadway was clear of other motor vehicles (d) failure to yield to the right-of-way to Plaintiff's vehicle; (e) failure to drive her vehicle with due regard for the highway and traffic conditions which were existing and of which she was or should have been aware; (f) driving her vehicle upon the highway in a manner endangering persons and property and in a reckless manner with careless disregard to the rights and safety of others and in violation of the Motor Vehicle Code of the Commonwealth of Pennsylvania. By reason of the aforesaid injuries sustained by Plaintiff Tina Derr, she was forced to incur liability for medical treatment, medications, physical therapy, and similar miscellaneous expenses. 14. Because of the nature of her injuries, Plaintiff Tina Derr has been advised and, therefore, avers that she may be forced to incur similar expenses in the future, and claim is made therefor. 15. As a result of the aforementioned injuries, Plaintiff Tina Derr has undergone and in the future will undergo physical and mental suffering, great inconvenience in carrying out her daily activities, loss oflife's pleasures and enjoyment, and claim is made therefor. 16. As a result of the aforesaid injuries, Plaintiff Tina Derr has been and in the future will be subject to humiliation and embarrassment, and claim is made therefor. 17.
