STIPULATION AGAINST LIENS
THIS AGREEMENT made the ~.;tt..... day of JUly, 2000, by and between W. LEE
ROLAND BUILDER, hereinafter referred to as Contractor, and JAMES N. LAROCCA and
DIANE M. LAROCCA, husband and wife. hereinafter referred to as Owner, whereoy the
former undertakes and agrees to erect and construct a single family dwelling on:
ALL THAT CERTAIN tract or parcel of land situate in Silver Spring Township,
Cumberland County, Pennsylvania, bounded and described as follows, to wit:
BEGINNING at a point <in the southern dedicated right-at-way line of the cul-de-sac
of Winchester Court, at the westernmost corner of Lot No. 17 on the hereinafter described
Final Subdivision Plan: thence along the western line of said Lot No. 17 South 19 degrees
18 minutes 51 seconds West a distance ot 155.05 feet to a point on the northern line of
land now or formerly Max C. Hempt; thence along the northern line of said Hempt land and
continuing along the northern line of land now or formerly William E, Keller, South 71
degrees 49 minutes 55 seconds West a distance of 213.13 feet to a point at the southeast
corner of Lot No. 15 on the hereinafter described Final Subdivision Plan; thence along the
eastern line of said Lot No. 15 Norttl 07 degrees 59 minutes 19 seconds West a distance
of 245.35 feet to a point on the southern dedicated right-of-way line of Winchester Court;
thence along the southern dedicated rig,ht-of-way line of Winchester Court by a curve to the
left haVing a radius 825.00 feet, an arc length of 36.80 feet to a point; thence continuing
along the same by a curve to the right having a radius of 60.00 foot, an arc length of 56.55
feet to a point on the southern dedicated right-of-way line of the cul-de-sac of Winchester
Court; thence along the southern deq/cated right-of-way line of the cul-de-sac of
Winchester Court by a curve to the left having a radius of 95.00 feet, an arc length of
104.07 feet to a pOint at the westernmost corner of Lot No. 17 on the hereinafter described
Final Subdivision Plan, the point and place of BEGINNING.
CONTAINING 38,713 square feel, more or less
BEING lot No. 16, Final Subdivision Plan for Hillside Farms - Phase II, dated
September 17, 1998. last revised June 23, 2000, recorded in the Office of the Recorder of
Deeds of Cumberland County in Plan Book 81, Page 67.
EXCEPTING AND RESERVING to Grantors, their successors and assigns, a 7.5
foot utility eiilsement over the western portion of the premises, the western line of said
easement being the common property line between Lots Nos. 15 and 16 on the above
referenced Final Subdivision Plan, for the purpose of extending a water line from
Winchester Court to the lands abutting the southern line of the herein described premises,

UNDER AND SUBJECT to the Second Amendment and Supplement to Declaration
of Covenants and Restrictions applicable to Hillside Farms, dated June 29, 2000, recorded
in the Office ofthe RecOrder of Deeds of Cumbe~land County, in Misc. 800k 648, Page
702, pursuant to which the Declaration of Covenants and Restrictions applicable to Hillside
Farms, dated August 30, 1996, recorded in the Officer of the Recorder of Deeds of
Cumberland County, in Miscellaneous Book 529, Page 333, and the Bylaws of Hillside
Farms Homeowners' Association, Inc. dated August 30, 1996, recorded In the Office of the
Recorder of Deeds of Cumberland County in Miscellaneous aook 529, Page 354, were
made applicable to the real estate within the above referenced Final Subdivision Pian.
BEING PART OF THE SAME PREMISES which Martha D. Hempt, widow, by her
deed daled November 10, 1999, recorded in the Office of the Recorder of Deeds in and for
Cumberland County in Deed Book 211, page 710, granted and conveyed unto Hempt
Realty, LTD.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor,
for and in consideration of the sum of One and 00/100 ($1.00) Dollar to him in ~land paid
by Owner, the receipt whereof is hereby acknowledged, and the further consideration
mentioned in the agreement aforesaid, for themselves and their subcontractors, and all
parties acting through or under them, covenant and agree that no mechanic's liens or
claims thereto for or on account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about the erection and
construction of the said buildings on the lot above described, and the said Contractor, for
themselves, their subcontractors and others under them hereby expressly waive and
relinquish the right to have, file and maintain any mechanic's liens or claims against the
SOlid buildings Or any of them. and agree that this instrument, waiving the right of lien, shall
be an independent covenant.
