COMPLAINT
1. Plaintiff, Lift Inc., is a Pennsylvania corporation organized under the laws of the
Commonwealth Pennsylvania with its principle office located at 2969 Old Tree Drive, Lancaster,
PAI7603,
2, Defendant, Spectra Services, Inc. is believed to be and therefore averred to be a
Pennsylvania corporation with its office located at 608 Market Street, New Cumberland, P A
17070,
3. On or about December of 1999, Lift, Inc. commenced providing services on an open
account to the Defendant herein, for servicing of its equipment.
4, In accordance with the terms and conditions of this open account, all invoices were to
be paid within thirty (30) days ofthe date of mailing.
5, The Plaintiff had performed several jobs for the Defendant herein, In accordance
with the attached statements, attached as Exhibit "A" incorporated herein by reference,
6. All work that has been performed by the Plaintiff was done in a worIanan like manner.
7. As of the date of the filing of this complaint, the outstanding balance on said open
account is $4,152.30. Attached as Exhibit "A" and incorporated herein is a copy ofthe most
recent statement.
8. In addition, a hearing at the District Justice level was held in which Judgement was
entered in favor of the Plaintiff and against the Defendant and costs were assessed in the amount
of$97,00,

9, Demand for payment has been made in accordance with Exhibit "B" which is attached
and incorporated herein by reference
10. As of the date of the filing of the complaint, the outstanding balance due is $4,152.30
plus the $97 .00 for the District Justice costs,
WHEREFORE, the Plaintiff demands judgement against the Defendant in the amount of
$4,249.30 plus additional accrued interest and cost.

Dear Torn:
As we recently discussed, my client, Spectra Services, Inc.,
ceased its operations several months ago and is winding up its
financial affairs. Additionally, Spectra's principal, Ed
Kellogg, and his wife, Mary, have filed a Chapter 7 bankruptcy,
as confirmed by the enclosed petition.
Spectra has a small pool of money available to satisfy the
claims of its competing creditors. Spectra has reserved $400.00
to settle the above litigation. If your client is unwilling to
accept this final settlement offer, Spectra will agree to
stipulated judgment in the amount currently due Lift, Inc.
Please contact your client and advise me of your final position.
Since the scheduled arbitration hearing appears to be

11. Plaintiff did not perform the alleged work in a
good and workmanlike manner which was in accordance with industry
standards.
12. Assuming plaintiff's work was adequately
performed, its charges were not reasonable and necessary and were
in accordance with the parties' agreement and/or industry
standards.
13. Defendant defends the complaint based on such
other grounds as will be established during discovery or at
trial.

I have s heduled the hearing for March 8 at 10 a.m. in the old courthouse.
Kerry Voss Smith was originally scheduled to be an arbitrator. Judge Hoffer's secretary,
Sandy, and I have been unable to find the whereabouts of Ms. Smith, so Sandy said we could
vacate her appointment and put in Galen Waltz. I have prepared a proposed Order vacating Ms.
Smith's appointment. The only thing I'm wondering is if we need to wait until Judge Hoffer
signs the order to send out the notice, or can I send the notice out now?

EMERGENCY PETITION FOR SPECIAL RELIEF
AND NOW, this ~~j). day of March, 2005, comes Petitioner, Tina M. Wright, by and
through her attorneys, Knight & Associates, P.c., and files the following Emergency Petition for
Special Relief and in support thereof avers as follows:
1. The Petitioner is Tina M .Wright, the natural mother of Kimberly Wood (hereinafter
"Kimberly"), and Plaintiff in the above-captioned matter. Petitioner is an adult individual residing
at 45 Scrafford Street, Shippensburg, Pennsylvania.
2. The Respondent is Brian N. Wood, the natural father of Kimberly, and Defendant in
the above-captioned matter. Respondent is an adult individual whose last known mailing address
is 5145 N. Susquehanna Trail, York, Pennsylvania.
3. Kimberly, born November 23, 1991, is thirteen years of age and presently resides with
Respondent due to Respondent retaining custody of the child in violation of the October 3, 2000
Order or Court in the above-captioned matter, which is incorporated herein, made a part hereof, and
attached hereto as Exhibit "A".
4. The October 3, 2000 Order of Court grants shared legal custody to both parties and
primary physical custody to Petitioner ofthe parties' children, Kimberly Wood, born November 23,
1991; Kayla Wood, born March 2,1993; and Kasey Wood, born July 17,1994.
5. On or about February 24,2005, Respondent took custody of the child, Kimberly, in
violation of the October 3,2000 Order of Court and has retained custody of the child ever since.
6. It is believed, and therefore averred, that Respondent is driving without a valid
driver's license and has a disposition pending regarding his allegedly driving while intoxicated on
or about December 31, 2004.
7. Kimberly continues to accumulate unlawful absences from the school, Shippensburg
Middle School, while she has been in the custody of Respondent; Kimberly faces having her twelfth
unlawful absence from school on March 9, 2005, and therefore, possible failure of the school year.
8. Petitioner is being denied all access to Kimberly without cause.
9. Petitioner reasonably believes that the Kimberly's affections are being alienated.
10. Due to Respondent's alleged driving violation, Kimberly may be put in physical
danger if she is not removed from Respondent's custody.
11. Kimberly is at continuing risk of being truant from school if she is not returned to the
custody of Petitioner.
12. Petitioner has incurred and continues to incur attorneys fees and court costs due to
Respondent's willful failure to obey the October 3,2000 Order of Court.
WHEREFORE, Petitioner respectfully requests this Court to direct that the child, Kimberly
Wood, and Respondent or other person having physical custody of the child be brought before the
Court; that custody of Kimberly be returned to Petitioner according to the October 3, 2000 Order of
Court; that Respondent be ordered to pay all of Petitioner' s reasonable attorneys fees and court costs,
in relation to this Petition; that the October 3, 2000 Order of Court be modified to prohibit
Respondent from operating a motor vehicle without a valid driver's license or while intoxicated with
the children as passengers; and any other relief the Court deems appropriate,

ordered and directed as follows:
1. The Mother, Tina M. Wright, and the Father, Brian N. Wood, shall
have shared legal custody of Kimberly Wood, born November 23, 1991, Kayla
Wood, born March 2, 1993 and Kasey Wood, born July 17, 1994. Each parent
shall have an equal right, to be exercised jointly with the other parent,
to make all major non-emergency decisions affecting the Children's general
well-being including, but not limited to, all decisions regarding their
health, education, and religion.
2. The Mother shall have primary physical custody of the Children.
3. The Father shall have partial physical custody of the Children on
alternating weekends from Friday at 6:00 p.m. through Sunday at 4:00 p.m.,
beginning September 22, 2000, and at any additional times arranged by
agreement of the parties.
4. The parties shall communicate with each other to establish custody
arrangements for holidays and birthdays at lE!ast 5 days in advance of the
holiday or birthday.
5. Unless otherwise agreoo betwe",n the pari:ies, the Father shall
provide transportation for exchanges of custody at the Mother's residence
in Shippensburg, Pennsylvania.
6. In the event the Father is unable to exercise a period of custody
under this Order, he shall provide notice to the Mother at least one day in
advance.
7. Each party shall ensure that the other party has his or her
current address and telephone number on an ongoing basis.
8. The non-custodial parent shall be entitled to have reasonable
telephone contact with the Children.
9. The parties may modify the provisions of this Order. by, mutual
