JAMES M. GUYER, tldlbla JIM GUYER, BUILDER, hereinafter referred to as Contractor, and
TREVOR E. ROSENBERRY and COURTNEY L. ROSENBERRY, hereinafter referred to as
Owners, whereby the former undertook and agreed to erect and construct a I:ustom built home on
that certain lot of ground situate at Lot No, 17, Shed Road, Lower Mifflin Township, Cumberland
County, Pennsylvania, more Rilly descrihed in Exhibit "A" attached hereto and made a part hereof,
NOW THEREFORE" WITNESSETH: That the said Contractor, for and in considtll'lItion of
the sum of ($1 ,00) Dollar to Contractor in hand paid by Owners, the receipt whereof is hereby
acknowledged, and the furtht.'t' consideration mentioned in the agreement aforesaid, for themselves
and their subcontractor8, and aU parties acting through or under them, covenant and agree that no
mechanic's liens (IT claims shall be filed or maintain,,-d by them or any of theln against the said
buildings and the Jotof ground appurtenant thereto for or on account of allY work done or lllllterialS
furnished by them or any of thcm under said contract or otherwise, for, towards, in, or about the
erection and construction of the said buildings on the lot above described, and the said Contractor,
for themsel ves, their subc'ontraclors and others under them hereby cxpres~ly waive and relinquish
the right to have, me, and maintain any mechanic's liens or claims against the said buildings or any
of them, and agree that this instrument, waiving the right oflien, shall be an independent covenant

Mifflin Township, Cumberland County, Pennsylvania, bounded and limited as follows, to wit:
BEGINNING at a point in the eenter line of Shed Road (f -412) at a common property eorner of Lot
# I 0 and #1 7 as shown on the Preliminary /Final Subdivision Plan of Scenic View; thence from said
point of beginning along the center line of Shed Road (T-412) South 42 degrees 23 minutes 56
seeonds East, a distance of 98.29 feet to a point; thence continuing along same by a curve, curving
to the right, having a radius of 790.00 fcet an are length of 278.49 feet to a point at a eommon
property corner of Lot #17 and Lot #21; thence along Lot #21 South 68 degrees 31 minutes 27
seconds West, a distance of 497.39 feet toa point at a common property comer of Lot #17 and Lot
#20; thence along a portion of Lot #20 South 42 degrees 56 minutes 06 seconds West, a distance of
52.21 feet to a point at a common property corner of Lot #17 and Lot #16; thenee along Lot #16
North 26 degrees 44 minutes 54 seconds West, a distance of319 .26 feet to a point; thence continuing
along same North 24 degrees 46 minutes 22 seconds West, a distance of 50.01 feet to a point at a

BEING identified as Lot #17 as shown on a plan of lots prepared for Realand, Ine. by Hoover
Engineering Services, Inc., dated March 30, 2000 and recorded July 25, 2000 in the office of the
Recorder of Deeds in and for Cumberland County, Pennsylvania in Plan Book 81 at Page 93.
