The Defendant is Joanne Painter, an adult individual residing at 2200 Ritner Highway, Shippensburg, Cumberland County, Pa 17257 3, On June 15, 1999 at approximately 7:00 am the Plaintiff and his daughter, Danielle Sheppard (aged 18 yrs) was traveling about 35 MPH at least 3 car lengths behind a green minivan., heading east on Alexander Spring Road. 4. The Defendant was stopped at the stop sign at the intersection of Commerce Ave & Alexander Spring Road, She had a clear line of view of 2/10 of a mile down Alexander Spring Road. Once the Green minivan passed she pulled out directly into the path of the Plaintiff. In order to avoid hitting the Defendant the Plaintiff swerved to the right in front of the Defendant's car. There was gravel in the intersection causing the Plaintiff to skid & end up traveling up onto the sidewalk on Sprint Drive. 5. The Defendant got out of her car and apologized saying she didn't see us, the sun was in her eyes. This statement made no sense since we were traveling east the sun was in the opposite direction. But that was her explanation at that time. 6. Plaintiffs daughter, Danielle went into the Police Station, which is located right at the intersection to get an officer & make a phone call to her mother. 7. When the officer came out & questioned the Defendant; she denied causing the accident, saying it happened after she crossed the intersection and she only stopped to help. The defendant stated there was no one coming down Alexander Spring Road when she proceeded to cross the intersection 8. Agree 2, Agree 3, Disagree: From the point of impact to the point of where the car came to rest, would prove the plaintiff was going at a higher rate of speed than 35 mph to cause that much damage to a vehicle and also causing both air bags to go off There is also the question on the time of the daugher having to be at work, at a day care center, at 7: 15 am. 4. Disagree: The defendant did not pull into the path of an oncoming vehicle as the vehicle slid behind the defendant's vehicle, up a 12" curb, around a pole, a tree, and onto the sidewalk. There was no gravel in the intersection, It seemed as if the plaintiff was in a rush, missed the turn, and lost control of his vehicle, 5. Disagree: The defendant did not apologize and say they couldn't see the plaintiff because the sun was in her eye, but did stop to ask everyone if they were alright, or needed any help. The plaintiffwas helping his daughter of his car who was crying and confused. 6, Agree 7. Agree 8. Agree 9. Disagree: This may have been true if the plaintiff was traveling at 35 mph, but he was not. Ifhe was I would have waited for him to pass, as not to endanger a 13 year old, an II year old, and my I year old child. I was stopped waitng to cross the intersection and in now hurry to be anywhere. 10. Disagree: I do not believe the plaintiff's estimations of distances and speed are accurate. II. Disagree: The officer spoke to us at 7:25. I looked at my watch and heard the plaintiff's daughter ask the plaintiff what she should do. The plaintiff told her to call her mother and told her she was not going to make it to work. Also, the accident took place in front ofthe state police barricks, 12. Disagree: I believe I do not owe this amount as I did not cause the accident. This was determined by the police officer and the district justice.
