STIPULATION AGAINST LIENS
THIS AGREEMENT made the 31st of July, 2000, by and between
CARLSON CONSTRUCTION, INC., Contractor
AND
DAVID W. THOMPSON and KIMBERLY R. THOMPSON, Husband and Wife,
hereinafter referred to as Owner, whereby the former undertook
and agreed to erect and construct a single family dwelling on that
certain lot of ground situate in
the Township of East Pennsboro, County of Cumberland, and
Commonwealty of Pennsylvania, more particularly bounded and
described in attached Exhibit "A", and also known as Lot K-S
Saratoga Place, Camp Hill, Pennsylvania.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for and in consideration of the sum of ($1.00) Dollar
to Carlson Construction, Inc. in hand paid by Owner, the receipt
whereof is hereby acknowledged, and the further consideration
mentioned in the agreement aforesaid, for themselves and their
subcontractors, and all parties acting through or under them,
covenant and agree that no mechanic's liens or claims shall be
filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings, on the lot
above described, and the said Contractor, for themselves, their
subcontractors and others under them hereby expressly waive and
relinquish the right to have, file, and maintain any mechanic's
liens or claims against the said buildings or any of them, and
agree that this instrument, waiving the right of lien, shall be
an independent covenant.

ALL THAT CERTAIN lot of land situate in the Township of East
Pennsboro, County of Cumberland, and Commonwealth of
Pennsylvania, bounded and described as follows, in accordance with
the Final Subdivision Plan for Floribunda Heights, Phase II,
Sections K &H, dated October 5, 1999, prepared by Melham
Associates, P. C. and recorded in Plan Book 80, Page 45, and
revised on February 17, 2000, and recorded in Plan Book 80, Page
104, viz, and Plan Book 81, Page 73.
BEGINNING at a point on the southern side of Saratoga Place at
the northwestern corner of Lot No. K-4 on the above mentioned
Plan of Lots; thence along the western line of Lot No. K-4, South
20 degrees 08 minutes 48 seconds East, 171.35 feet to a point at
the lands now or formerly of Floribunda Associates; thence along
the said same lands, South 73 degrees 50 minutes 00 seconds West,
91.31 feet to a point along the said same lands of Floribunda
Associates; thence along the said same lands, North 73 degrees 50
minutes 00 seconds East, having a chord distance of 15.00 feet to
a point at theso1.ltheflstern corrier of Lot No. K-6 on the above
mentioned Plan of Lots; thence along the eastern side of Lot No.
K-6, North 16 degreeEl10',minutes 00 seconds West, 103.22 feet to
a point on the sOuthern side of Saratoga Place; thence along the
same side of Saratoga Place, by a curve to the left having a
radius of 50.00 .feeL and an arc length of 15.23 feet to a point;
thence along the same: side of Saratoga Place, by a curve to the
left having a radius. of 50.00 .feet and an arc length of 66.42
feet to a point;,therice along the same side of Saratoga Place, by
a curve to the right having a radius of 10.00 feet and an arc
length of 14.76 feet to a point; thence along the same side of
Saratoga Place, by a cUrve to the right having a radius of 415.00
feet and an arc length of 36.35 feet. to a point, the point and
place of BEGINNING.
CONTAINING 14,189.592 square feet.
BEING LOT NO. K-5, on the .above mentioned Plan of Lots.
UNDER AND SUBJECT to a 1/2 30' drainage and sanitary sewer
easement running along the western side of the lot, as shown on
the above mentioned plan.
BEING THE SAME PREMISES which Floribunda Associates Limited
Partnership, a Pennsylvania limited partnership, by its deed to
be recorded simultaneously herewith, . in the Office of the Recorder
of Deeds of Cumberland County, granted and conveyed unto David
W. Thompson and Kimberly R. Thompson. '
