They are the parents and custodians of Cody Durming, a minor, age 8, who was injured in a motor vehicle accident on July 20, 1997. 2. Cody Durming, a minor, currently resides with his parents, Eugene and Tamara Durming, at 22 Ivy Terrace in Carlisle, Cumberland County, Pennsylvania 17013. 3. This petition is brought in Cumberland County and the accident also occurred in Cumberland County, Pennsylvania. 4. The accident occurred when the vehicle in which Cody Dunning was a passenger, was struck by a vehicle driven by Kenneth L Compo 5. As a result of the aforesaid incident, Cody Dunning sustained a bump over his eye. 6. Cody Dunning was observed by the Carlisle Hospital Emergency Room while there with his family. - ,~" - -, ~. ~~"'.' - 7. There were no expenses as a result of his injuries. 8. Counsel was retained upon a 35% contingent fee basis by Petitioner, but has agreed to reduce that fee to 25%. Additionally, counsel has incurred the following expenses: Cumberland County Prothonotary (Filing Minor's Petition) Total Expenses 45.50 $ 45.50 9. Petitioners and counsel recommend approval of the lump sum amount of Two Thousand Five Hundred Dollars ($2,500) with Allstate, Mr. Comp's insurance company, because they consider it fair and reasonable and that it adequately compensates the minor for the injuries sustained, expenses incurred and they further approve ofthe proposed distribution set forth in the Order attached hereto.
