COMPLAINT
1. Plaintiffs Jennifer and Russell Kulp are citizens of the Commonwealth of
Pennsylvania, who reside in Carlisle, Cumberland County, Pennsylvania.
2. Defendant John Bishop resides at 501 N. Pitt Street, Carlisle, Cumberland County,
Pennsylvania.
3. The facts and occurrences hereinafter related took place on December 23, 1998, at the
intersection of Hanover Street and Pomfret Street, Carlisle, Cumberland County, Pennsylvania.
4. At that time and place, Plaintiff Jennifer Kulp was a passenger in a 1994 Geo Prism,
operated by Sharon McKelvey, traveling in a northern direction Hanover Street.
5. At the same time, Defendant John Bishop was operating a vehicle also traveling in a
northenl direction on Hanover Street.
6. Immediately before the subject motor vehicle accident, Mrs. McKelvey's vehicle was
stopped at a red traffic light.
7. Defendant Bishop approached the rear of Mrs. McKelvey's vehicle and caused the
front of his vehicle to collide into the rear of Mrs. McKelvey's stationary vehicle.
8. At the time of the aforementioned collision, Plaintiff Jennifer Kulp was seven weeks
pregnant.

9. The foregoing accident and all of the injuries and damages sustained by the Plaintiffs
Jennifer and Russell Kulp are the direct and proximate result of the negligent, careless, wanton,
and reckless manner in which Defendant Bishop operated his motor vehicle as follows:
a) failure to abide by the assured clear distance ahead rule;
b) failure to keep alert and maintain a proper watch for the presence of other
motor vehicles on Hanover Street;
c) failure to apply his brakes in sufficient time to avoid striking the rear of the
Mrs. McKelvey's vehicle;
d) failure to travel at a safe speed;
e) driving his vehicle upon the highway in a manner endangering persons and
property and in a reckless and outrageous manner with careless disregard to the rights and
safety of others in violation of the Motor Vehicle Code of the Commonwealth of
Pennsylvania.

10. Paragraphs 1 through 9 of the Complaint are incorporated herein by reference as if set
forth at length.
11. Mrs. Kulp sustained painful and severe injuries which include but are not limited to
chronic lower back pain, chronic neck pain, and pain and numbness in her legs and emotional
distress as she was pregnant at the time of the subject accident.

12. By reason of the aforesaid injuries sustained by Mrs. Kulp, she was forced to incur
liability for medical treatment, chiropractic treatment, medications and similar miscellaneous
expenses in an effort to restore herself to health, and claim is made therefor.
13. As a result of the aforementioned injuries, Mrs. Kulp has undergone and in the future
may undergo physical and mental suffering, inconvenience in carrying out her daily activities,
loss oflife's pleasures and enjoyment, and claim is made therefor.
14. As a result of the aforementioned injuries, Mrs. Kulp has been and in the future may
be subject to humiliation and embarrassment, and claim is made therefor.
15. Mrs. Kulp continues to be plagued by persistent pain and limitation, and, therefore,
avers that her injuries may be of a permanent nature, causing residual problems for the remainder
of her lifetime, and claim is made therefor.

16. Paragraphs 1 through 15 of the Complaint are incorporated herein by reference as if
set forth at length.
17. As a result of the aforementioned injuries sustained by his wife, Plaintiff Jennifer Kulp,
Plaintiff Russell Kulp has been and may in the future be deprived of the care, companionship,
consortium, and society of his wife, all of which will be to his great detriment, and claim is made
therefor.

WHEREFORE, Plaintiffs Jennifer and Russell Kulp, demand judgment against Defendant
John Bishop, in an amount in excess of Twenty-five Thousand Dollars ($25,000.00), exclusive of
interest and costs and in excess of any jurisdictional amount requiring compulsory arbitration.
