COMPLAINT
The plaintiff, by his attorney, MURREL R. WALTERS, III, ESQUIRE, brings this
action in divorce for a Decree of Divorce from the bonds of matrimony and respectfully
represents:
1. The plaintiff is JOSEPH S. MORlTZ, an adult individual, who currently resides
at 500 Allenview Drive, Mechanicsburg, Cumberland County, Pennsylvania.
2. The defendant is MADELINE R. MARCOTTE, an adult individual, who
currently resides at 1086 King Road, Apt. DI13, Malvern, Chester County, Pennsylvania.
3. Plaintiff and defendant are both bona fide residents of the Commonwealth of
Pennsylvania and have been for at least six (6) months immediately previous to the filing of this
Complaint.
4. The plaintiff and defendant were married on February 23, 1991 in Wildwood
Crest, New Jersey.
5. There have been no prior actions of divorce or for annulment between the
parties.
6. The plaintiff avers that the marriage is irretrievably broken.
7. The plaintiff requests the Court to enter a Decree of Divorce.

8. Plaintiff has been advised of the availability of marriage counseling and that he
may have the right to request the court to require the parties to participate in such counseling.
Being so advised, plaintiff does not request that the court require the parties to participate in
counseling prior to a Divorce Decree being handed down by the court.
WHEREFORE, the Plaintiff prays that a Decree in Divorce be entered divorcing
Plaintiff from the bonds of matrimony heretofore existing between Plaintiff jIlld Defendant.

MOTION AND STIPULATION

, 2001, petitioner/plaintiff, Joseph S.
Moritz, of 500 Allenview Drive, Mechanicsburg, Cumberland County, Pennsylvania, and his
attorney, Murre! R. Walters, III, Esquire, and respondent/defendant, Madeline R. Marcotte, of
1086 King Road, Apt. Dl13, Malvern, Chester County, Pennsylvania, with regard to custody
and visitation of their minor child, stipulate and agree as follows:
1. The parties desire to enter into an amicable agreement for custody and visitation
of their minor child, namely, Casey E. Moritz, born September 27, 1991.
2. The child presently resides with Madeline R. Marcotte, respondent herein, at
1086 King Road, Apt. Dl13, Malvern, Chester County, Pennsylvania.
3. The parties have reached an agreement with regard to the custody of the child
and they do hereby stipulate and agree as follows:
a. Madeline R. Marcotte shall have primary physical custody of Casey E.
Moritz.
b. Joseph S. Moritz shall have partial physical custody of Casey E. Moritz
during every weekend from 7:00 to 8:00 p.m. on Friday through Sunday at 7:00 to 8:00 p.m.,
with the exception of every third weekend of every month.
