COMPLAINT
Cumberland Truck Equipment, by its attorneys, Brigid Q, Alford, Esquire, and Boswell,
Tintner, Piccola & Wickersham, presents its Complaint as follows:
1. Plaintiff is Cumberland Truck Equipment Co., is a Pennsylvania corporation
registered to do business in Pennsylvania, with a place of business located at 25 Roadway Drive,
Carlisle, Cumberland County, Pennsylvania 17013.

2, Defendant is Sunrise Travel Center, Inc., a Pennsylvania corporation, registered to
do business in Pennsylvania, with a place of business located at RD #3, PO Box 6208,
Harrisburg, Dauphin County, County, Pennsylvania 17112,
3, On or about December 6, 1999, Defendant purchased truck equipment, truck parts
and supplies from Plaintiff on their existing credit account.

4. Defendant continued to purchase materials from Plaintiff on its account from
December through April, 2000,
5. Defendant has not made any payments on its account since April 21, 2000.
6. The current outstanding balance due is $6,384.42, which includes finance charges
accrued.
7, Despite Plaintiffs numerous attempts to collect this amount, Defendant has
continuously refused to make payment to Plaintiff for the balance due.
WHEREFORE, Plaintiff demands judgment in an amount not in excess of $25,000.00,
which amount requires submission of this matter to compulsory arbitration, plus interest and
costs of suit.
COUNT I - BREACH OF CONTRACT
8, Plaintiff hereby incorporates Paragraphs 1-7 herein by reference,

$6,384.42.
10. Defendant's failure to pay constitutes a breach of the contract for goods
purchased.
WHEREFORE, Plaintiff Cumberland Truck Equipment Company, demands
judgment in its favor in an amount not in excess of $25,000,00, which is the compulsory
arbitration limit for Cumberland County.
