AND NOW, this J 'f ~ day of August, 2002, upon consideration of the attached
Custody Conciliation Summary Report, it is hereby ordered and directed as follows:
1. Legal, Custody. The parties, Robert F. Curran and Debra Lee, shall have
shared legal custo8y of the minor child, Sarah Curran, born September 30, 1998. Each
parents~all have an equal right, to be exercised jointly with the other parent, to make all
major non-emergency decisions affecting the child's general well-being including, but not
limited to, all decisi,ons regarding her health, education and religion. Pursuant to the terms
of Pa. C. S. ~5309, each parent shall be entitled to all records and information pertaining to
the child including, but not limited to, medical, dental, religious or school records, the
residence address of the child and of the other parent. To the extent one parent has
possession of any such records or information, that parent shall be required to share the
same, or copies thereof, with the other parent within such reasonable time as to make the
records and information of reasonable use to the other parent. In the event that Father is
not participating in the developmental therapy and educational programming arranged for
this child through the Early Intervention Program, Mother shall have the authority to
authorize services recommended as she shall deem appropriate.
2. Physical Custody. Mother shall have primary physical custody of the child
subject to Father's rights of partial custody which shall be arranged as follows:
A. Father shall have custody from August 5, 2002 through August
11, 2002 at 7:00 p.m.
B. On alternating weekends from Friday at 10:00 a.m. until Sunday
at 7:00 p.m., to commence August 23, 2002.
3. In the event the child is ill or hurt, the parent presently having custody will
notify the other parent as promptly as is practical under the then existing circumstances.

4. In the event that one parent is not able to exercise their custodial rights for a
period of three (3) days or more, they shall first offer to trade custodial periods with the other
parent prior to arranging alternate childcare.
5. Father shall attend a seminar for separating families within thirty (30) days of
the date of this Order. .

ORDER OF COURT

the attached Custody Conciliation Summary Report, it is hereby ordered and directed as
follows:
1. Legal Custody. The parties, Robert F. Curran, and Debra Barker (Lee), shall have
shared legal custody of the minor Child, Sarah Michelle Curran, born September 30, 1998.
Each parent shall have an equal right, to be exercised jointly with the other parent, to make all
major non-emergency decisions affecting the Child's general well-being including, but not
limited to, all decisions regarding her health, education and religion. Pursuant to the terms of
this paragraph, each parent shall be entitled to all records and information pertaining to the
Child including, but not limited to, school and medical records and information. To the extent
one parent has possession of any such records or information, that parent shall be required to
share the same, or copies thereof, with the other parent within such reasonable time as to
make the records and information of reasonable use to the other parent.
2. Physical Custody. The parties shall continue the shared physical custody
arrangement whereby the Child spends alternating weeks with each parent. Therefore,
Father's week shall commence October 15,2000. The exchange days for custody shall be
Sundays, at such time as the parties shall mutually agree. Holidays shall be shared in as
equitable a manner as possible as the parties shall mutually agree.
3. In the event that the Child is ill or hurt, the parent presently having custody will notify
the other parent as promptly is as practical under the then existing circumstances.
4. In the event that one parent is not able to exercise their custodial rights for a period

to arranging alternate childcare.
5. The parents shall attend the Seminar for Separating Parents which is being offered
by Inner Works in Harrisburg.
6. Both parties shall participate in the completion of the evaluation and any
recommemded follow-up for Sarah as indicated by the professional staff of the Infant
Development Program.

AND NOW, comes the Petitioner, Debra Lee, formerly known as Debra

4. On October 23, 2000, following a custody conciliation, an Order of Court
was entered providing for custody on an alternating week basis. A true and correct
copy of the order is attached hereto.

5. Paragraph #5 of the current order provides that the parties should attend
the Seminar for Separating Parents. It is unknown whether the Respondent has
completed the Seminar. A copy of Petitioner's certificate of completion is attached.
6. Paragraph #6 of the current order provides that both parties shall
participate in an evaluation and any recommended follow-up indicated for Sarah
through the Infant Development Program.
7. Respondent has not participated in Sarah's developmental therapy since
August 24, 2001.
8. Respondent did not attend recent meetings and evaluations with the Infant
Development Program; specifically he did not participate in reviewing Sarah's
progress during the first year of her therapy or in planning for the following year.
9. Because of the shared legal custody and Respondent's failure to
participate, Sarah's therapy has been suspended since February 15, 2002.
10. When the Capital Area Intermediate Unit provides transportation for
services, as it will for Sarah, transportation must be to and from the same address
each time, which will result in Sarah's therapy being provided only on alternating
weeks when she is with Petitioner.
11. Communication with Respondent for the purpose of discussing matters
relating to custody is difficult at best, largely because, to the best of Petitioner's
knowledge, Respondent has been without a telephone for more than a year.
12. Because Respondent has no telephone, Petitioner is unable to
communicate with Sarah when she is with Respondent.
13. The terms of both the Legal Custody and Physical Custody provisions of
the current order have had a negative impact on Sarah's well being.

follows:
1. Legal Custody. The parties, Robert F. Curran, and Debra Barker (Lee), shall have
shared legal custody of the minor Child, Sarah Michelle Curran, born September 30, 1998.
Each parent shall have an equal right, to be exercised jointly with the other parent, to make all
major non-emergency decisions affecting the Child's general well-being including, but not
limited tO,all decisions regarding her health, education and religion. Pursuant to the terms of
this paragraph, each parent shall be entitled to all records and information pertaining to the
Child including, but not limited to, school and medical records and information. To the extent
one parent has possession of any such records or information; that parent shall be required to
share the same, or copies thereof, with the other parent within such reasonable time as to
make the records and information of reasonable use to the other parent
2. Physical Custody. The parties shall continue the shared physical custody
arrangement whereby the Child spends alternating weeks with each parent Therefore,
Father's week shall commence October 15,2000. The exchange days for custody shall be
Sundays, at such time as the parties shall mutually agree. Holidays shall be shared in as
equitable a manner as possible as the parties shall mutually agree.
3, In the event that the Child is ill or hurt, the parent presently having custody will notify
the other parent as promptly is as practical under the then existing circumstances.
4. In the event that one parent is not able to exercise their custodial rights for a period
of three days or more, they shall first offer to trade custodial periods with the other parent prior
to arranging alternate childcare.
5. The parents shall attend the Seminar for Separating Parents which is being offered
by Inner Works in Harrisburg,
6.. Both parties shall participate in the completion of the evaluation and any
recommended follow-up for Sarah as indicated by the professional staff of the Infant
Development Program.

limited to, all decisions regarding her health, education and religion. Pursuant to the terms
of Pa. C. S. 95309, each parent shall be entitled to all records and information pertaining to
the child including, but not limited to, medical, dental, religious or ,school records, the
residence .address of the, child and of the other parent To the extent one parent has
pcjssession of any such records or information, that parent shall' be required to share the
same, or copies thereof, with the other parent within such reasonable time as to make the
records and information of reasonable use to the other parent In the event that Father is
not participating in the developmental therapy and educational programming arranged for
this child through the Early Intervention Program, Mother shall have the authority to
authorize services recommended as she shall deem appropriate.
2. Physical CustOdy. Mother shalf have primary physical custody of the child
subject to Father's rights of partial custody which shall be arranged as follows:
