COMPLAINT
AND NOW, comes the Plaintiff, James C. Bartoli, Inc., by
and through its undersigned attorneys, Saidis, Shuff &
Masland, and avers in support of its Complaint against
Defendants as follows:
1. plaintiff James C. Bartoli, Inc., is a corporation
duly organized and existing under the laws of the Commonwealth
of Pennsylvania with a principal place of business located at
325 South cemetery Avenue, Carlisle, Cumberland County,
Pennsylvania 17013.
2. Defendants, James J. Froso and Kosta Touloumes are
adult individuals who own and operate a restaurant known as
Kosta's Restaurant located at 451 North 21st Street, Camp Hill,
Cumberland County, Pennsylvania 17011.
3.
Plaintiff sold and delivered produce to the
Defendants at their restaurant on North 21st Street beginning
in August of 1996 through December 14, 1999. All produce

items were delivered by Plaintiff to Defendants upon
Defendants oral orders given to plaintiff over the telephone.
4. Despite taking receipt of the produce delivered by
Plaintiff, Defendants have failed to pay the outstanding
invoices and there is due from Defendants to Plaintiff the sum
of Forty-Three Thousand Eight Hundred Fifty-Three and 42/100
($43,853.42) Dollars plus, interest at the rate of 1.5% per
month or 18% per year. A true and correct copy of the account
status is attached hereto, incorporated herein by reference
and marked as Exhibit ~A".
5. Despite Plaintiff's repeated demands for payment,
Defendants have failed and refused to pay the entire amount
due or any part thereof.
WHEREFORE, Plaintiff, James C. Bartoli, Inc., demands
judgment in its favor and against Defendants in the amount of
$43,853.42 together with interest at an annual rate of 18%,
costs and such further relief as the Court deems appropriate,

1. The Plaintiff has failed to state a cause of action upon which relief can
be granted; the Plaintiff seeks to recover significant interest charges at the rate of
eighteen percent (18%) per annum but has failed to plead that this rate was agreed
to by the Defendants.
NON-JOINDER OF NECESSARY PARTIES
2. The Plaintiff has failed to file a joinder of necessary parties. The
Plaintiff has named, as Defendants, two individuals who do not exist. The Plaintiff
has failed to name a defendant associated with the operation of Kosta's Restaurant.
3. There is no one, to the Defendants' knowledge or belief by the name of
James J. Froso who is involved in the operation known as Kosta's Restaurant.

Pursuant to Pa. R.C.P. 1028(a) (2), plaintiff, James C.
Bartoli, Inc., by its undersigned attorney, preliminarily
objects to defendants' preliminary objections, as follows:
1. Defendants filed preliminary objections on or about
September 27, 2001.
2. Defendants style their preliminary objections as
a remedy to the entry of a default judgment taken by
Plaintiff.
3. On or about June 21, 2001, a default judgment was
entered against Defendants for failure to file a responsive
pleading to a complaint.
4. Where a judgment upon default has been entered
against a Defendant upon Plaintiff's praecipe, relief can be
obtained by petitioning the court to either strike off or open
the default judgment. N.H. Weidner, Inc. v. Berman, 310 Pa.
Super. 590, 593, 456 A.2d 1377, 1379 (Pa. Super. 1983).
5. Defendants have failed to file a petition to either
strike off or open the default judgment entered against them,
prior to filing their preliminary objections.
6. Defendants have failed to set forth a proper basis
for preliminary objections pursuant to Pa. R.C.P, 1028(a) (1),
therefore their preliminary objections should be stricken for
failure to conform to law or rule of court.
